Excluded Maintenance. 5.1 The Supplier is not obliged to perform any Maintenance Service required to restore any malfunctioning or failed Equipment to Good Working Order or suffer any liability in relation thereto where the malfunction or failure results from or is caused by any of the following (“Excluded Causes”):
Excluded Maintenance. 6.1 Avoira is not obliged to perform any Excluded Maintenance but, subject to clause 6.2, shall use reasonable endeavours to provide assistance to ensure that the Customer has effective use of the Maintained Equipment.
Excluded Maintenance. 5.1 The Supplier is not obliged to perform any Excluded Maintenance.
Excluded Maintenance. Maintenance-Custodians shall not be required to maintain the personal possessions of Board staff.
Excluded Maintenance. Any necessary maintenance due to improper and/or unauthorized use of the Software by Licensee shall not be covered under the maintenance provisions of this Agreement. Improper and/or unauthorized use of the Software includes modifying or accessing the main database for the Software by means other than the user interface provided with the Software. Charges for maintenance not covered under the terms of this Agreement shall be billed at Licensor’s then effective rates. Determination that specific support or maintenance requests are non-covered maintenance shall be made in Licensor’s reasonable discretion.
Excluded Maintenance. 5.1 Under this maintenance agreement Chess accepts no obligations or liability whatsoever:
Excluded Maintenance. Xxxx Business Solutions is not obliged to perform any Maintenance required as a result of the Customer doing any act, omission or thing or using the Equipment other than in accordance with the terms of this Agreement. Excluded Maintenance. The responsibility for reasonable maintenance and improvement of Longview Drive under this Agreement shall not include construction damage, excavation and utility tie-in, and other work that solely benefits an individual owner. Costs to repair and restore Longview Drive to the standards established by Jefferson County as a result of such damage and work shall be borne by the individual owners specifically benefiting from the work.
Excluded Maintenance. 4.1 Sycous is not obliged to perform any Excluded Maintenance.
