Exclusion Requests. Class Members (including Minor Subclass Members) may elect not to be part of the Class and not to be bound by this Settlement Agreement.

Exclusion Requests. A Settlement Class Member may request to be excluded from the Settlement Class by sending a written request postmarked on or before the Objection/Exclusion Deadline to the Settlement Administrator providing his/her name and address, the name of the Xxxxxx Publication to which he or she is a subscriber, a signature, the name and number of the case, and a statement that he or she wishes to be excluded from the Settlement Class for purposes of this Settlement. A request to be excluded that does not include all of this information, or that is sent to an address other than that designated in the Notice, or that is not postmarked within the time specified, shall be invalid, and the individual who submitted such a request shall be a member of the Settlement Class and shall be bound as a Settlement Class Member by this Agreement. Any member of the Settlement Class who validly elects to be excluded from this Agreement shall not: (i) be bound by any orders granting preliminary or final approval to this settlement; (ii) be entitled to relief under this Settlement Agreement; (iii) gain any rights by virtue of this Agreement; or (iv) be entitled to object to any aspect of this Agreement. The request for exclusion must be personally signed by the individual requesting exclusion. So-called “mass” or “class” opt-outs shall not be allowed.

To make this election, Class Members must send a letter or postcard to the Claims Administrator stating: (a) the name of the Action, “In re EasySaver Rewards Litigation”; (b) the full name, address, and telephone number of the person requesting exclusion; and (c) a statement that he/she does not wish to participate in the Settlement, postmarked no later one hundred thirty-five (135) calendar days after entry of the Preliminary Approval Order.
Exclusion Requests. Exclusion requests must: (a) be signed (if sent by mail or fax) or electronically signed (if submitted via the Settlement Website); (b) include the full name, address, and fax number of the person(s) requesting exclusion; and (c) include the following statement: “I/we request to be excluded from the class settlement in Prairie Pointe Orthodontics, P.A., x. Xxxxx & Associates, LLC., et al., Case. No. 2:22-cv-2451.” No exclusion request will be valid unless all of the information described above is included. A request to be excluded that is sent by means other than that designated in the notice, or that is not timely received by the Claims Administrator, shall be invalid. No putative Settlement Class Member, or any person acting on behalf of or in concert or participating with that person, may exclude any other putative Settlement Class Member from the Settlement Class. Any putative Settlement Class Member who elects to be excluded shall not: (i) be bound by the Final Approval Order and Judgment; (ii) be entitled to relief under this Settlement Agreement; (iii) gain any rights by virtue of this Settlement Agreement; or (iv) be entitled to object to any aspect of this Settlement Agreement.
Exclusion Requests. 1. If a Settlement Class Member chooses to Opt-Out of the Settlement Class, such Settlement Class Member is required to submit an Exclusion Request to the Claims Administrator, post-marked on or before the date specified in the Class Notice, which shall be no later than twenty (20) days before the date of the Fairness Hearing or as the Court otherwise may direct. 2. A Settlement Class Member who submits an Exclusion Request using the procedure identified above in Section IV(J)(1) shall be excluded from the Settlement Class for any and all purposes. 3. A Settlement Class Member who does not file a timely Exclusion Request shall be bound by all subsequent proceedings, orders, and judgments in the Actions. Prior to the date of the Final Order and Judgment, the Court, upon application of Equifax’s Counsel or Class Counsel, may permit a Settlement Class Member who has filed a timely Exclusion Request to withdraw such Exclusion Request and to participate in the Settlement Class and the Settlement Agreement as if such Exclusion Request had never been made.

Exclusion Requests. 19. Any member of the Settlement Class who wishes to opt-out or exclude himself or herself from the Settlement Class must submit an appropriate, timely request for exclusion sent to the Settlement Administrator at the address on the Class Notice and to be postmarked no later than 35 days after dissemination of the Mail Notice. (the “Opt-Out and Objection Date”). 20. The opt-out request must be personally signed by the Settlement Class Member requesting exclusion and contain the following information: a) The name, address, telephone number of the Person opting out; b) Identify the case name; c) Identify the cellular telephone number(s) where the person received a text message from Checkers; d) Be personally signed by the Settlement Class Member, and class or group requests for exclusion shall be prohibited; and e) Contain a statement that indicates a desire to be excluded from the Settlement Class. A timely and valid request to opt-out of the Settlement Class shall preclude the person opting out from participating in the proposed Settlement and he or she will be unaffected by the Agreement. The Settlement Administrator shall compile a list of all Settlement Class Members who properly and timely submit an opt-out request (the “Opt-Out List”). 21. Any Settlement Class Member who does not submit a timely and valid written request for exclusion shall be bound by all subsequent proceedings, orders and judgments in this Litigation, regardless of whether he or she currently is, or subsequently becomes, a plaintiff in any other lawsuit, arbitration or other proceeding against any of the Released Parties asserting any of the Released Claims.

The Settlement Administrator shall compile a list of all Settlement Class Members who properly and timely submit an opt-out request (the “Opt-Out List”).

Class Members may not both request exclusion and raise a valid, written objection to the Settlement Agreement. If a Class Member submits both, the Settlement Administrator will treat the submissions as a request for exclusion and process them accordingly.
