Exclusions - What. Is Not Covered) This Vehicle ESA does not cover certain parts or any Vehicle damage or malfunction directly or indirectly caused by, due to or resulting from normal wear or deterioration, abuse, misuse, negligence, accident, lack of or improper maintenance, operation, storage or transport, including, but not limited to, any of the following: • The Battery; • Repairs, modifications or alterations, or the installation or use of fluids, parts or accessories, performed by any service provider other than a Tesla Authorized Service Center without prior authorization from Tesla; • Failure to take the Vehicle to a Tesla Authorized Service Center upon discovery of a defect covered by this Vehicle ESA; • Negligence, misuse or abuse, such as carrying passengers and cargo exceeding specified load limits or otherwise overloading the Vehicle or using the Vehicle as a stationary power source, or a lack of or improper repair or maintenance, including not performing all vehicle maintenance and service requirements, including those indicated by the vehicle’s systems, observing scheduled inspections or making all services and repairs, non-compliance with any recall advisories, or use of fluids, parts or accessories other than those specified in your owner documentation (see maintenance requirements in Section B. Your Responsibilities); • Accidents, collision, objects striking the Vehicle, theft, vandalism, riots, or acts of God, including, but not limited to, exposure to sunlight, airborne chemicals, tree sap, animal or insect droppings, road debris (including stone chips), industry fallout, rail dust, salt, hail, floods, acid rain, fire, explosion, earthquake, windstorm, water, contamination, lightning and other environmental conditions; • Tires and wheels; • Vehicles used for commercial purposes, which includes but is not limited to government purposes, pick-up, and delivery service, company pool use, or for service or repair calls, route work, or hauling; • Racing on or off road, competition, speed contests or autocross or for any other purposes for which the Vehicle is not designed or driving the Vehicle off-road, over uneven, rough, damaged or hazardous surfaces, including but not limited to, curbs, potholes, unfinished roads, debris, or other obstacles; • Vehicles used for towing; • Where the odometer is inaccurate, inoperative or altered so that the Vehicle’s true mileage cannot be ascertained or verified; • Vehicles that have been transported or driven outside the Te...
Exclusions - What. Is Not Covered) This Battery ESA does not cover certain parts or any Battery damage or malfunction directly or indirectly caused by, due to or resulting from normal wear or deterioration, abuse, misuse, negligence, accident, lack of or improper maintenance, operation, storage or transport, including, but not limited to, any of the following: • Allowing the Battery to reach a zero state of charge or neglecting to follow proper charging procedures as specified in your Owner’s Manual; • Exposing the Vehicle to ambient temperatures above 140°F (60°C) or below -22°F (-30°C) for more than 24 hours at a time;1 • Physically damaging the Battery or intentionally attempting, either by physical means, programming, or other methods, to extend (other than as specified in Your Owner’s Manual) or reduce the life of the Battery; • Exposing the Battery to direct flame; • Immersing any portion of the Battery in water or fluids; • Opening the Battery enclosure; • Repairs, modifications or alterations performed by any service provider other than a Tesla Authorized Service Center without prior authorization from Tesla; • Failure caused by negligence, misuse or abuse, such as driving over curbs, overloading or using the Vehicle as a stationary power source, or caused by a lack of maintenance (see maintenance requirements in Section B. Your Responsibilities); • Failure caused by an external event such as accidents, collision, objects striking the Vehicle, theft, vandalism, or acts of God; • If Your Vehicle is used for commercial purposes, which includes but is not limited to government purposes, pick-up, and delivery service, company pool use, or for service or repair calls, route work, or hauling;
Exclusions - What. This Agreement Won’t Cover Aircraft employees. We won’t cover bodily injury to any employee who is injured while employed as a member of the flying crew of any aircraft. Contract liability. We won’t cover bodily injury for which the protected person has assumed liability under any contract or agreement. But we won’t apply this exclusion to bodily injury for which the protected person would have liability without the contract or agreement. Employment subject to federal laws. We won’t cover bodily injury to any employee who is injured while employed in operations or work subject to any of the following federal laws, or any amendment to those laws: Defense Base Act. Federal Coal Mine Health and Safety Act of 1969. Federal Employer’s Liability Act. Xxxxxxxxx and Harbor Workers’ Compensation Act. Migrant and Seasonal Agricultural Worker Protection Act. We won’t cover bodily injury that results from any: refusal to employ a person; termination of a person’s employment; or other employment-related act, omission, policy or practice directed at a person, such as coercion, defamation, demotion, discipline discrimination, evaluation, harassment, humiliation, or reassignment. Expected or intended bodily injury. We won’t cover bodily injury that is expected or intended by the protected person. But we won’t apply this exclusion to bodily injury that results from the use of reasonable force to protect people or property. Failure to comply with workers compensation law. We won’t cover bodily injury to any employee for which your failure to comply with the workers compensation law of a state or territory shown in the Coverage Summary causes the protected person to: lose their common law defenses; or incur a penalty. Failure to control or eliminate unsafe working conditions. We won’t cover bodily injury that results from a specific unsafe working condition if: the unsafe working condition is identified in a directive, notice, or order issued by or for a federal, state, or local government agency or authority to the protected person; the directive, notice, or order requires the protected person to control or eliminate the unsafe working condition by a certain date or within a certain period; the protected person fails to control or eliminate the unsafe working condition ...

  • Eligibility Exclusions Subject to Clause 2.5 of this Schedule 1, an individual is not eligible for training subsidised through the Skills First Program under this VET Funding Contract if the individual is: a student enrolled in a school (excluding a school based Apprentice/Trainee). This includes: any government, non-government, independent or Catholic school; or a student registered for home schooling in Victoria. Government schools are responsible for funding these opportunities for VET within the school curriculum through their Student Resource Package (SRP) allocation, including targeted VET in schools funding. Non-government schools make similar decisions for students on the basis of the resources available to them; within the meaning of the Corrections Act 1986 (Vic), a prisoner held at a prison, including: Xxxxxxx Correctional Centre (Ararat); Barwon Prison; Beechworth Correctional Centre; Dame Xxxxxxx Xxxxx Centre; Dhurringile Prison; Langi Kal Kal Prison; Loddon Prison Precinct; Marngoneet Correctional Centre; Tarrengower Prison; Metropolitan Remand Centre; Melbourne Assessment Prison; Fulham Correctional Centre; Port Xxxxxxx Prison; or Karrenga Annex; a person who is detained under the Mental Health Act 2014 (Vic), or the Crimes (Mental Impairment and Unfitness to be Tried) Act 1997 (Vic) or the Sentencing Act 1991 (Vic) at the Xxxxxx Xxxxxxx Hospital; or a person who is detained (other than on weekend detention) under the Children, Youth and Families Act 2005 (Vic) or the Sentencing Act 1991 (Vic) or who is held on remand in one or more of the following youth justice facilities: Malmsbury Youth Justice Centre; Parkville Youth Residential Centre; or Melbourne Youth Justice Centre. The exclusions described in Clauses 2.4(b), (c) and (d) of this Schedule 1 do not apply to: young people on community based orders made under the Children, Youth and Families Act 2005 (Vic); or individuals held in Xxxx Xxxxxxx Transition Centre, who, subject to otherwise complying with the requirements in this Clause 2, may be eligible for training subsidised through the Skills First Program as they are able to physically access training outside of a custodial setting without supervision.
