Existing and Proposed Utilities. The Contract Documents show existing utilities lying within the limits of the Work, such as sewers, manholes, catch basins, gas lines, water lines, telephone and electrical duct lines, CTA facilities, and similar structures. The City of Chicago or SCC does not guarantee the completeness or accuracy of the information regarding utilities, whether public or privately owned. Contractor must make its own investigation to determine the existence, nature and location of all utilities at the Work site. Contractor must verify the exact location of all utilities that may interfere with performance of the Work and must report to SCC any differences from the locations shown on the Contract Documents. Contractor must so arrange and conduct its Work that utilities may be removed, relocated or supported during excavation and maintained in service until the Work is completed. In addition, the Contractor arranges and conducts its Work that utilities may be replaced, rearranged or relocated prior to backfill being placed. Contractor must cooperate with the owners of such utilities in the performance of the Work. Where existing utilities are abandoned and it is necessary to remove them due to the performance of the Work, the utilities shall be removed by Contractor at no additional cost to SCC or the City of Chicago, and shall become Contractor's property. It is Contractor's responsibility to protect those existing utilities which are to remain in operation during and after completion of the Work, and any new utilities installed by others during the performance of the Work. Contractor will be held fully responsible for any damage resulting from its performance of the Work, and will be required to repair, replace or reconstruct any utilities damaged, at its own expense, to the satisfaction of the City of Chicago and/or SCC. The protection of the utilities as specified herein shall be at no additional cost to the City of Chicago or SCC.

  • Bidding and Proposal Phase 1.5.1 In conjunction with the development of the Guaranteed Maximum Price and at other times as appropriate to the Project, the Architect/Engineer shall assist the Owner and Construction Manager by receiving and recording requests for Bid and Request for Proposal (“RFP”) Documents, receiving and resolving questions about Bid and RFP Documents; preparing addenda, issuing addenda, and accounting for addenda issued; attending pre-bid and pre-proposal conferences and HUB meetings; evaluating bids and proposals; and assisting in preparing and awarding multiple contracts for construction. Architect/Engineer shall answer inquiries from bidders and proposers at Owner’s request, and shall prepare and issue any necessary addenda to the bidding or proposal documents.

  • New utilities (i) The Contractor shall allow, subject to the permission from the Authority and such conditions as the Authority may specify, access to, and use of the Site for laying telephone lines, water pipes, electricity lines/ cables or other public utilities. Where such access or use causes any financial loss to the Contractor, it may require the user of the Site to pay compensation or damages as per Applicable Laws. For the avoidance of doubt, it is agreed that use of the Site under this Clause 9.3 shall not in any manner relieve the Contractor of its obligation to construct and maintain the Project Highway in accordance with this Agreement and any damage caused by such use shall be restored forthwith at the cost of the Authority.

  • Agreement Exceptions/Deviations Explanation If the proposing Vendor desires to deviate form the Vendor Agreement language, all such deviations must be listed on this attribute, with complete and detailed conditions and information included. TIPS will consider any deviations in its proposal award decisions, and TIPS reserves the right to accept or reject any proposal based upon any deviations indicated below. In the absence of any deviation entry on this attribute, the proposer assures TIPS of their full compliance with the Vendor Agreement. No response

  • COMMON UTILITIES Expenses for serving/supply of common facilities and utilities and all charges incidental thereto.

  • CONTRACTOR NAME CHANGE An amendment is required to change the Contractor's name as listed on this Agreement. Upon receipt of legal documentation of the name change the State will process the amendment. Payment of invoices presented with a new name cannot be paid prior to approval of said amendment.

  • Pending Charges and Proposed Exclusions If Xxxxxx has actual notice that a Covered Person is charged with a criminal offense that falls within the scope of 42 U.S.C. §§ 1320a-7(a), 1320a-7(b)(1)-(3), or is proposed for exclusion during the Covered Person’s employment or contract term, Xxxxxx shall take all appropriate actions to ensure that the responsibilities of that Covered Person have not and shall not adversely affect the quality of care rendered to any beneficiary or the accuracy of any claims submitted to any Federal health care program.‌

  • Provisioning Line Splitting and Splitter Space 3.8.1 The Data LEC, Voice CLEC or BellSouth may provide the splitter. When EZ Phone or its authorized agent owns the splitter, Line Splitting requires the following: a non-designed analog Loop from the serving wire center to the NID at the End User’s location; a collocation cross connection connecting the Loop to the collocation space; a second collocation cross connection from the collocation space connected to a voice port; the high frequency spectrum line activation, and a splitter. The Loop and port cannot be a Loop and port combination (i.e. UNE-P), but must be individual stand-alone Network Elements. When BellSouth owns the splitter, Line Splitting requires the following: a non designed analog Loop from the serving wire center to the NID at the End User’s location with CFA and splitter port assignments, and a collocation cross connection from the collocation space connected to a voice port.
