Expansion of Capacity. The District will take reasonable steps to expand Pole Capacity when necessary to accommodate Licensee’s request for Attachment. Notwithstanding the foregoing sentence, nothing in this Agreement shall be construed to require the District to install, retain, extend or maintain any Pole for use when such Pole is not needed for District service requirements.
Expansion of Capacity. The Utility will take reasonable steps, at Licensee’s sole expense, to expand Pole Capacity when necessary to accommodate Licensee’s request for Attachment. Notwithstanding the foregoing sentence, nothing in this Agreement shall be construed to require the Utility to install, retain, extend or maintain any Pole for use when such Pole is not needed for the Utility’s service requirements.
Expansion of Capacity. Under the CIWW 28E-28F Agreement CIWW is responsible for planning, engineering, financing, and construction of all new drinking water source, treatment and transmission system facilities needed to expand the capacity of CIWW to meet the requirements of its customers. Such new facilities are referred to herein as “Expansion Facilities”, and may include, in CIWW’s discretion, facilities constructed or installed to increase the capacity of the WDMWW Designated Water Supply Facilities. WDMWW shall cooperate and assist CIWW in planning for and constructing any Expansion Facilities that affect the WDMWW Designated Water Supply Facilities.
Expansion of Capacity. The City may take steps as reasonably appropriate, in a competitively neutral manner, to expand Facilities to accommodate Licensee’s request for Attachment. Notwithstanding the foregoing, nothing in this Agreement shall be construed to require the City to install, retain, extend or maintain any Facility or portion of City Facilities for use when such Facilities are not needed for the City’s or any other governmental service requirements.
Expansion of Capacity. District will take reasonable steps to expand, at Licensee’s sole expense, its Pole/Conduit System Capacity when necessary to accommodate Licensee’s request for Attachment. Notwithstanding the foregoing sentence, nothing in this Agreement shall be construed to require District to install, retain, extend or maintain any Pole or portion of the Conduit System for use when such Pole/Conduit System is not needed for District’s service requirements.
Expansion of Capacity. Utility will expand pole capacity for Utility Poles, at Licensee’s expense, when necessary to accommodate Licensee’s Wireless Attachment approved pursuant to the issuance of a Permit, and when consistent with local governmental land use requirements of general applicability and all applicable Laws and Engineering Standards. Notwithstanding the foregoing sentence, Utility is under no obligation to install, retain, extend, or maintain any Pole for the benefit of Licensee when such Pole or system of Poles is not needed for Utility’s core electric or customer service requirements.
Expansion of Capacity. Unless the subject Pole is excluded from joint use, Owner Utility will expand Pole Capacity within a reasonable time when necessary to accommodate Attaching Utility’s request for Attachment, such that subject Pole meets the requirements of a Standard Utility Pole, such expansion or replacement shall be at the Attaching Utility’s expense, as adjusted in accordance with Section IX A. At Owner Utility’s discretion, Owner Utility may rearrange or reconfigure its Attachments on subject pole in lieu of pole replacement as long as the Attaching Utility’s Assigned Space can be accommodated. Notwithstanding the foregoing sentence, nothing in this Agreement shall be construed to require Owner Utility to install, retain, extend, or maintain any Pole for use when such Pole is not needed for Owner Utility's service requirements.
Expansion of Capacity. Chiron shall invest in the expansion of its manufacturing capacity and in making process improvements to increase its ability to supply Betaseron in such amounts and in such manner as Chiron believes appropriate, and consistent with Chiron's obligations under this Agreement. Chiron will use its best efforts to expand its Capacity for the manufacture of Betaseron consistent with the targets set forth in Exhibit 4.1. Except for those items Schering has expressly agreed to pay for under Section 4.2, Chiron will make such investments in an expanded capacity at its own cost and expense.

Notwithstanding the foregoing sentence, nothing in this Agreement shall be construed to require Licensor to install, retain, extend, or maintain any Pole for use by Licensee when such Pole is not needed for Licensor's own service requirements.
Expansion of Capacity. RMU will take reasonable steps to expand Pole Capacity when necessary to accommodate Licensee's request for Attachment. Notwithstanding the foregoing sentence, nothing in this Agreement shall require RMU to install, retain, extend or maintain any Pole for use when RMU does not need such Pole for its service requirements.
