Common use of Express Exclusions Clause in Contracts

Express Exclusions. This Agreement expressly excludes and overrides all other Awards and Agreements. This Agreement expressly excludes and overrides all Protected Award Conditions and Protected Notional Conditions that would otherwise be applicable under any Award or Notional Agreement Preserving a State Award including terms about: o Rest breaks; o Incentive based payments and bonuses; o Annual leave loadings; o Observance of public holidays or payment in respect of those days; o Days to be substituted for public holidays; o Monetary allowances for; o Expenses incurred in the course of employment; or o Responsibilities or skills that are not taken into account in rates of pay for employees; or o Disabilities associated with the performance of work in particular conditions or locations; o Loadings for overtime or shift work; o Penalty rates; o Outworker conditions; and o Any other conditions prescribed by legislation.
