Express Exclusions. This Agreement expressly excludes and overrides all Protected Award Conditions and Protected Notional Conditions that would otherwise be applicable under any Award, or Notional Agreement Preserving a State Award including terms about: • Rest breaks; • Incentive based payments and bonuses; • Annual leave loadings; • Observance of public holidays or payment in respect of those days; • Days to be substituted for public holidays; • Monetary allowances for; o Expenses incurred in the course of employment; or o Responsibilities or skills that are not taken into account in rates of pay for employees; or o Disabilities associated with the performance of work in particular conditions or locations; • Loadings for overtime or shift work; • Penalty rates; • Outworker conditions; and • Any other conditions prescribed by legislation.
Express Exclusions. 28.1 This Agreement contains the complete statement of mutual rights and obligations as between the Employer and its employees covered by this Agreement to the exclusion, to the full extent permitted by law:

Express Exclusions. In no case shall this Agreement include:
a) The special circumstances of the CUSTOMER/DISTRIBUTOR or the new needs arising with the use of IMTLAZARUS.
b) The incorporation of the elements necessary to adapt to technological developments in the CLIENT/SCHOOLS device. By way of illustration, but not by way of limitation, for example, the latest versions of operating systems, the Internet browser, the Internet connection or any other elements not attributable to the PROVIDER.
c) Any travel expenses or similar expenses of other personnel of the CUSTOMER/DISTRIBUTOR.
d) The tasks necessary to restore the previous situation resulting from incorrect operations by the CUSTOMER/DISTRIBUTOR or third parties that cause loss of information, destruction or disorganization of the data. ~ 5 ~
e) The correction of anomalies that are not causally related to the scope of the service defined in this Agreement. THIRD: LICENCE FEES AND BILLING MODE 3.1.- All license fees will be shown in the IMTLazarus Website (xxxxx://xxx.xxxxxxxxxx.xxx/en/resources/). The costs of the different licenses expressed are Retail Price / Final Customer Price.
Express Exclusions. The parties acknowledge and agree that each has a business relationship with MAPFRE. Any efforts by either party to further promote the PDQ brand with MAPFRE will be subject to mutual agreement. MAPFRE is an exclusive medical records online prospect of MIC.

Express Exclusions. For the sake of clarity, the covenants set forth in this Section 12 do not bind or otherwise obligate the shareholders of Mecox and Giosis from time to time even if a shareholder (or group of shareholders) have control over Mecox or Giosis.
