Failure to Report or Submit. If Contractor fails to submit any report or other material required by this Contract to be submitted to the Department, other than Encounter Data, by the date due, the Department will give notice to Contractor of the late report or material and Contractor must submit it within thirty (30) days following the notice. If the accurate and complete report or other material has not been submitted within thirty (30) days following the notice, the Department may, at its sole discretion and without further notice, impose a late fee of $1,000.00 to $5,000.00 for the late report. At the end of each subsequent period of thirty (30) days during which the specific report is not submitted, the Department may, without further notice, impose an additional late fee equal to the amount of the original late fee.

If the Contractor has not submitted the report or other material within (30) days following the second notice, the Department, without further notice, shall impose a sanction of $1,000.00 to $5,000.00 for the late report.
