Common use of Familiarity with Project Clause in Contracts

Familiarity with Project. Consultant, through such knowledgeable and qualified personnel as Consultant deems necessary or appropriate based upon the nature and scope of the Project, has undertaken all actions deemed necessary to acquaint itself with the requirements of the Project and this Agreement, and has evaluated, and is entering into this Agreement on the basis of, Consultant’s own examination, inspection, review and investigation of the Project, this Agreement, all documents related to the performance of the Services with respect to the Project, and to the extent applicable to or impacting upon the performance of the Services, the visible portions of the Project, and is not relying on the opinion or representations of Owner to determine the nature of the Project, the conditions and limitations under which the Work Product is to be prepared, the character and quantity of the labor, materials, equipment, and facilities necessary to timely complete the Services in accordance with the scheduling requirements and the cost commitments of this Agreement in accordance with Consultant’s standard of care, the general and local conditions relating to the Project, and such other matters that may affect Consultant’s performance of the Services within the time provided.
