Farm Lease. The Property is subject to a farm lease (the "Farm Lease") that will expire on March 1, 2022 pursuant to a Notice of Termination of Farm Tenancy served upon the Tenant on July 28, 2021.
Farm Lease. The Property is under a farm cash lease with a current lease year that ends on February 28, 2022. The tenant of the farm has been terminated and the Property will be free of any farm tenancy effective March 1, 2022. SELLER shall retain 100% of the cash rent for the current lease year and there will be NO proration of the rent to BUYER.
Farm Lease. Each of the auction tracts identified in the table below (“Farm Lease Table”) is subject to an existing farm lease which expires not later than December 31, 2018. Xxxxxx 0 - 0 Xxxxxx 0 - 00 Xxxxxx 00 - 00 Xxxxxx 00 & 00 Xxxxx 00 Xxxxxx 00 & 00 Xxxxxx 00 & 00 Xxxxx 00 Xxxxxx 00 & 00 Xxxxx 00 Tracts 67 - 72 Tracts 87 - 89 Tract 82 Tracts 84 & 85 If the Purchased Tract(s) include or consist(s) of any of the tracts identified in the Farm Lease Table above: (a) possession thereof shall be delivered to Buyer subject to the rights of the current farm tenant to retain possession of and to have access to the cropland pursuant to the existing farm lease for the remainder of the current lease term expiring not later than December 31, 2018; (b) the obligations of Seller under said farm lease (including but not limited to the obligation to accommodate the farm tenant’s right to maintain and harvest the 2018 crop) shall be assumed by Buyer in accordance with the provisions of Section 17 below; and (c) the rights of Seller under said farm lease (including without limitation the right of possession upon expiration of said lease) shall be assigned to Buyer in accordance with the provisions of Section 17 below, except that Seller shall retain all rights to collect (and Buyer shall receive no assignment of or credit for) any payments (including any rent and/or reimbursement) due from any tenant pursuant to said farm lease.
Farm Lease. Possession of the real estate to be given at closing subject to a Farm Lease through February 28, 2027. Information regarding the Farm Lease to be provided upon request.
Farm Lease. SELLER represents to BUYERS that as of the date of Closing, a portion of the Property is subject to a cash rent farm lease, which will be assigned to BUYERS at Closing. The first half of rent for the 2023 crop year will be paid by tenant to SELLER and credited to BUYERS at Closing. The second half of rent for the 2023 crop year and all subsequent rent will be paid directly to the BUYERS. If BUYERS desire to terminate said farm lease for future years, it shall be the BUYERS’ responsibility to serve notice of termination on the tenant.
Farm Lease. Seller acknowledges that Buyer has leased the Property to a xxxxxx, to farm the Property. Seller agrees to honor the existing lease during its term and may continue to lease the Property to a xxxxxx, on terms and conditions satisfactory to the Seller.
Farm Lease. THIS LEASE, made the 1 st day of May, 2008, between THE TOWNSHIP OF XXXXXXX, of 00000 Xxx Xxxxxxx Xxxx NE, Xxxxxxx, Michigan 48809 (hereinafter called the "Landlord"), and of , Michigan (hereinafter called the "Tenant"). This Lease is made upon the following terms and conditions, all and every one of which the parties hereto agree to perform:
Farm Lease. Property may be subject to a farm lease until 5/31/2022.
Farm Lease. Buyer and Seller hereby acknowledge and agree that Seller may lease the Fire Station Property for the purpose of growing crops (“Farm Lease”). Any Farm Lease shall include the following specific, minimum terms:
a. shall state that the Farm Lease is a for a term of not more than three (3) years beginning January 1, 2015 and ending on or before December 31, 2107 (“Lease Term”);
b. shall authorize Seller to terminate the lease upon the conclusion of any crop year, if Fishers desire to begin constructing a fire station on the property prior to conclusion of the Lease Term;
c. shall authorize Seller to terminate the lease during the crop year, if the lessee under the Farm Lease is reimbursed for the fair market value of the anticipated crop yield actually planted; and
d. shall state that the Fire Station Property shall only be used for growing crops and for no other purpose. If the Farm Lease is terminated pursuant to subsection (c) above, Buyer shall reimburse Seller for payment made to lessee for anticipated crop yield. Revenue received by Seller as a result of a Farm Lease shall be the property of Seller notwithstanding when such revenue is received. In exchange for the opportunity to lease the Fire Station Property, Seller hereby agrees to indemnify, defend and hold harmless Buyer, its officers, representatives and employees from and against any and all claims, judgments, liabilities, losses, costs, and expenses arising from, or in connection with the Farm Lease, including those made by third parties. Seller's obligation to observe and perform the covenants set forth in this Section 2.12 shall survive the expiration of the Farm Lease or earlier termination thereof.
Farm Lease. Each of the auction tracts except PIN 00-00-000-000, which comprises approximately
