FIFO TWIME ASTS software. It is intended to connect the User Software to the TC SHC Subsystems of the Moscow Exchange FX, Precious Metals, Equity & Bond, Deposit and Credit Markets. The remote access right in respect of the software is provided to Users that are a Trading Member on Moscow Exchange the FX, Precious Metals, Equity & Bonds and/or a Clearing Member of the FX, Precious Metals, Equity & Bond, Deposit and Credit Markets. By granting the right to use the FIFO TWIME ASTS software, the User is also granted the right to use the MFIX Transactional software (in accordance with clause 9 of Appendix 3) in cases where the FIFO TWIME ASTS Technical Access ID cannot be used. Back-up connection shall be made by the User using the MFIX Transactional. It is also recommended that the User has at least one copy of the MOEX Trade series in the relevant market. The User may transfer the right to use the software to its Customers with a Sponsored Access ID (if Sponsored Access IDs are provided for in the applicable trading rules). The remote use of TWIME ASTS FIFO software enables the User to transmit FIX-protocol requests for transactions via the dedicated infrastructure of the Technical Centre, provides the User with information on the transactions already executed by the User and the current status of orders (in the format of FIX protocol messages). Requests is transmitted via a dedicated network channel provided by a recommended telecom operator, independently organised by the User, its Client or a Partner (in case the User is an end user of a Partner's services) under its contract for telecom operator services, exclusively in the Moscow Exchange colocation area and requires ordering a separate service of the telecom operator "Connection of Client's equipment to the dedicated network of the Operator, providing access to low latency transaction services at a bandwidth of up to 10 Gbit/s" for each such User. In the event of a breach of these conditions by the User, the Technical Centre reserves the right to suspend access to the FIFO TWIME ASTS software to the User. The right to use the FIFO TWIME ASTS remotely may be granted by the Technical Centre to the User who is a Clearing Member and who has concluded a clearing services agreement with NCC, regardless of whether or not the User has access to clearing services at the Equity & Bonds Market in order to gain access to services of NCC not related to trading on Moscow Exchange markets, as provided for by the NCC Clearing Rules.
