FILLING OF JOB VACANCIES. 29.1 Except as provided in 29.1.1 and 29.1.2 below job openings shall be posted on all departmental bulletin boards for a minimum of seven (7) working days. The posted notice shall describe the job and pertinent job specifications. At the time of posting, the Union Presidents will be sent a copy of the job posting and selection criteria for posted openings in their Unit. The selection criteria shall be used to determine if candidates, in-house or outside, are qualified for the position. The selection criteria applied shall be in accordance with the current job description, job specification, and posting. If there are qualified applicants and unless there are unusual or emergency circumstances, the vacancy shall be filled within twenty (20) working days from the date of application closing, which date shall appear on the posted notice. This time limit may be extended by the City, when in its sole discretion it is necessary to do so, but to a date not to exceed forty (40) calendar days from the application closing date. 29.1.1 The City is not required to post job openings prior to offering that opening to a bargaining unit employee in order to fulfill its requirement to make reasonable accommodation in accordance with federal or state law. 29.1.2 After a vacancy is posted, if an additional vacancy in the same classification becomes available prior to the close of the selection process on the initial vacancy that vacancy will be posted in-house for an additional five (5) working days to determine if any additional applicants are interested in the position. 29.2 Employees in any City Department may apply for unit vacancies which are posted. The City will evaluate applicants who have submitted an application by the posted submission deadline as follows: 29.2.1 In-house applicants who are in the same job classification as the posted position, but who work in another Division or Department, are considered to be suitable transfers and will receive first consideration providing the City determines that they are qualified in accordance with the job qualifications listed in the job description. In order to be considered a suitable transfer, the applicant must satisfy all requirements of work and necessary special requirements outlined in the job qualifications listed in the job description. 29.2.2 If there are no in-house applicants who meet the definition of suitable transfer, the City will evaluate all other applicants in accordance with the selection criteria. Between applicants including non-city employee applicants who the City considers to be equally qualified, the vacancy shall be filled in the following preferential order: first by the unit applicant employed by the Department in which the vacancy occurs, secondly, by the bargaining unit applicant, and thirdly, all other applicants including non-employee applicants and City employees who are not included in the bargaining unit. 29.3 Employees who, pursuant to Article 27, TRAINING, have completed training courses satisfactorily as determined by the City shall be given a preference for promotion over other applicants, provided that the training relates directly to the duties and/or skills required for the promotional position, and the employee is otherwise qualified for the position. 29.4 Should a successful applicant become convinced within the first twenty (20) working days that s/he cannot cope with the new job, or should the City become convinced, within thirty (30) working days of the employee's appointment that the employee cannot fulfill the requirements of the job, then the reason therefore shall be put in writing, the Union President notified, and the employee shall be returned to his/her former job. 29.5 An employee appointed to a unit position shall be paid from the date of appointment at the permanent rate for the position at that employee's seniority step. Seniority shall be continuous permanent City service. 29.6 If an individual unit applicant for a position has cause for disputing the choice of the City, the employee may appeal the City's action using the established grievance procedure.

If an employee moves to a lower level position, he must meet all licensing requirements for his new position within thirty (30) working days of his appointment. 29.5 30.5 An employee appointed to a unit position shall be paid from the date of appointment at the permanent rate for the position at that employee's seniority step. Seniority shall be continuous permanent City service. 29.6 30.6 If an individual unit applicant for a position has cause for disputing the choice of the City, the employee he may appeal the City's action using the established grievance procedure. 30.7 Notwithstanding the above and regardless of whether or not the applicants are City employees, the City may hire any qualified Island resident applicant to fill an Island position over applicants who are not Island residents.

If the selected employee is able to meet all the requirements of the Maintenance Worker I classification over time, the City shall have the right to promote the employee to Maintenance Worker I at pay grade 16 without posting. 29.3 33.4 Upon execution of this Agreement, the City also retains the right to fill Maintenance Worker III vacancies, at pay grade 18, with individuals as either a Maintenance Worker I, at pay grade 16, or a Maintenance Worker II, at pay grade 17, if the selected applicant, in the sole discretion of the City, does not meet an acceptable portion of the requirements of the Maintenance Worker III job requirements. Probationary and part-time employees will only be considered for the promotional position, and the employee posted vacancies when no applicant with seniority is otherwise qualified for the position. 29.4 Should 16.02 When a successful applicant become convinced temporary vacancy arises due to an employee being on an approved leave of absence for any reason, another employee may be temporarily assigned from that work centre if possible by the Employer to fill that position. Such vacancy shall be filled without posting and assignment shall not exceed thirty (30) working days. 16.03 The Employer shall select the employee to fill the vacancy within the first twenty ten (2010) working days of the expiry date on the posting notice and the successful applicant will be placed on the job as soon as possible after the award. Reason(s) for any delays beyond fifteen (15) workings days will be given to the Union. 16.04 All vacancies created by filling a posted job and which are required to be filled shall be posted in accordance with section 16.02 above. 16.05 The Employer retains the right to fill the vacancy from other sources if bidding employee(s) do not possess the ability needed for the job or if no employee applications are received. Upon request, an employee shall receive a detailed explanation in the event that s/he cannot cope with they are unsuccessful for a posted job. 16.06 Should the new job, or should the City become convincedEmployer, within thirty (30) working days of the employee's appointment assignment, determine that the employee canis not fulfill suited to the requirements position, the employee and all others who have been assigned as a result of the job, then the reason therefore employee assignment shall be put reverted to their previous classification(s) without regard to seniority. The Employer may in writing, this event consider further applicants to the Union President notified, relative job posting. 16.07 A notice shall be posted on the appropriate bulletin boards advising of the successful applicant(s) with a copy forwarded to the National Representative and Recording Secretary. 16.08 The Employer may temporarily fill any position in which event the employee so assigned shall be returned to receive the job rate of the temporary assignment, if greater than his/her former jobown rate for all time worked in the temporary position on completion of one half (1/2) shift or more in the temporary position in any pay period. 29.5 An employee appointed to 16.09 In the event of a unit position transfer of complement between locations, such transfer shall be paid affected on the basis of seniority from amongst those employees in the date of appointment classification at the permanent rate for the position at that employee's seniority steplocation affected expressing an interest. FILLING OF JOB VACANCIES. 29.1 Except as provided in 29.1.1 and 29.1.2 below 16.01 In the filling of job openings shall be posted on all departmental bulletin boards for a minimum of seven (7) working days. The posted notice shall describe the job and pertinent job specifications. At the time of postingvacancies, the Union Presidents will be sent a copy of the job posting and selection criteria for posted openings in their Unit. The selection criteria shall be used to determine if candidatesnewly created jobs, in-house or outside, are qualified for the position. The selection criteria applied shall be in accordance with the current job description, job specification, and posting. If there are qualified applicants and unless there are unusual or emergency circumstances, the vacancy shall be filled transfers within twenty (20) working days from the date of application closing, which date shall appear on the posted notice. This time limit may be extended by the City, when in its sole discretion it is necessary to do so, but to a date not to exceed forty (40) calendar days from the application closing date. 29.1.1 The City is not required to post job openings prior to offering that opening to a bargaining unit employee in order to fulfill its requirement to make reasonable accommodation in accordance with federal or state law. 29.1.2 After a vacancy is posted, if an additional vacancy in the same classification becomes available prior to the close of the selection process on the initial vacancy that vacancy will be posted in-house for an additional five (5) working days to determine if any additional applicants are interested in the position. 29.2 Employees in any City Department may apply for unit vacancies which are posted. The City will evaluate applicants who have submitted an application by the posted submission deadline as follows: 29.2.1 In-house applicants who are in the same job classification as the posted position, but who work in another Division or Department, are considered to be suitable transfers and will receive first consideration providing the City determines that they are qualified in accordance with the job qualifications listed in the job description. In order to be considered a suitable transfer, the applicant must satisfy all requirements of work and necessary special requirements outlined in the job qualifications listed in the job description. 29.2.2 If there are no in-house applicants who meet the definition of suitable transfer, the City will evaluate all other applicants in accordance with the selection criteria. Between applicants including non-city employee applicants who the City considers to be equally qualified, the vacancy shall be filled in the following preferential order: first by the unit applicant employed by the Department in which the vacancy occurs, secondly, by the bargaining unit applicant, and thirdly, all other applicants including non-employee applicants and City employees who are not included in the bargaining unit., the following factors shall govern: 29.3 Employees who, pursuant a) Ability to Article 27, TRAINING, have completed training courses satisfactorily as determined by perform the City shall be given a preference for promotion over other posted job b) Seniority Where factor (a) is relatively equal amongst applicants, provided that the training relates directly to the duties and/or skills required then factor (b) shall govern.
