Common use of Formal Level (Level II) Clause in Contracts

Formal Level (Level II). In the event the grievant is not satisfied with the decision at the informal conference, the decision may be appealed, in writing, to the immediate supervisor, or designee within five (5) days of receiving a decision at Level I. The immediate supervisor, or designee, shall respond, in writing, within five (5) days of receipt of the appeal. The grievant’s writing shall be on the Grievance Form or may be in letter form. Such letter shall, in order to be processed or considered, include the following: 10.5.2.1 A statement in capital letters stating, THIS IS A GRIEVANCE, at or near the center of the top of the letter. 10.5.2.2 Employee name; college or location in the District; department. 10.5.2.3 Date of alleged grievance; date of informal conference and name of immediate supervisor/designee; date of oral response. 10.5.2.4 Date of filing of the formal grievance. 10.5.2.5 The specific articles and sections alleged to have been violated. 10.5.2.6 Employee’s statement of the alleged violation and grievance, the factual contention, what occurred, providing full facts necessary to support the allegation. 10.5.2.7 A statement of the full relief, remedy, action, believed required to resolve the alleged grievance. The immediate supervisor, or designee, shall respond, in writing, within five (5) days of receipt of the appeal.
