Common use of Foundation Day Clause in Contracts

Foundation Day. Any other day declared by or under a law of a State to be observed generally within the State or a region of the State, other than: ▪ A union picnic day or ▪ A day that is excluded by the Regulations to the Act from counting as a public holiday. Where a Public Holiday falls on a weekend and is subsequently gazetted on a substituted day, then the substituted day shall be the Public Holiday for the purpose of payment of penalty rates and the original day shall not be a Public Holiday.
