Functionality Warranty. True Influence, LLC warrants that the Platform Application will operate in a manner consistent with general industry standards reasonably applicable to the provision hereof and in substantial conformity with the then current version of the applicable documentation provided by True Influence, LLC.
Functionality Warranty. GNXCOR warrants that the Platform Services will operate in substantial conformity with the applicable documentation provided by GNXCOR. Functionality Warranty. Cerner warrants that, beginning on the date of First Productive Use and extending for as long as Client (a) remains continuously on Support and (b) is operating the most current or next to most current New Release, the Licensed Software will, without Material Error, perform the functions set forth in the Product Descriptions when operated in accordance with the Documentation. In the event of a breach of this warranty, Cerner will repair or replace the failing item of Licensed Software so that it performs in accordance with such warranty. If, however, after repeated efforts (not to exceed six months from the date Cerner receives written notice from Client concerning the warranty breach), Cerner is unable to repair or replace the failing item of Licensed Software so that it performs in accordance with such warranty, Client may, at Cerner's expense, return the failing item of Licensed Software and receive a refund of the item's license fee (calculated on a 5-year straight line depreciated basis), as well as the item's Support fees paid since the failure was first reported to Cerner. CLIENT’S RIGHTS UNDER THIS PARAGRAPH 8.2 CONSTITUTE ITS SOLE AND EXCLUSIVE REMEDY AND CERNER’S SOLE AND EXCLUSIVE OBLIGATIONS WITH RESPECT TO ANY BREACH OF THIS WARRANTY.

TrelaTech warrants that it will support Trela360 in accordance with the applicable support documentation for Trela360. To submit a warranty claim under this Section 7(b), Customer shall (1) reference that it is making a warranty claim under this Agreement, and (2) submit a support request to resolve the non-conformity. If the non-conformity persists without relief more than thirty (30) days after written notice of a warranty claim provided to TrelaTech under this Section 7(b), then Customer may terminate the affected Service and TrelaTech, as its sole liability in connection with a breach of this warranty, shall refund to Customer any prepaid subscription fees covering the remainder of the Subscription Term of the affected subscription after the effective date of termination. Notwithstanding the foregoing, this warranty shall not apply to any non-conformity due to any modification of or defect in the Service that is made or caused by someone other than TrelaTech (or someone acting at TrelaTech’s direction).
