Grievance Steps. A. Level Three If the grievant is not satisfied with the employee and disposition of his/her grievance at Level Two, the Association Representative in an effort to resolve may file a written grievance with the matter. Within Senior Management Consultant for the General Service Team within ten (10) work working days after the written response at Level Two is due or received, whichever is earlier. The written appeal shall state specifically which Article(s) and/or Section(s) of the Agreement the Employer may have violated. The Senior Management Consultant shall submit his/her decision and the reasons therefore in writing to the Association within twenty (20) working days after receipt of the grievance, grievance at Level Two. Settlements reached at Level One or Level Two shall be binding only if such settlements are consistent with the Superintendent provisions of this Agreement and policies and regulations of the Employer. Grievances settled at Level One or his/her designated representative, shall indicate in writing his/her Level Two found to be inconsistent with this Agreement may be reopened by the Employer through a written notice to the Association within fifteen (15) working days from the date of the settlement.
D. Level Four If the Association is not satisfied with the disposition of the grievance to the grievant and Association Representative.

STEP III If the grievance remains unresolved within five (5) work days of the receipt of the written decision in Step IIat Level Three, the Association may appeal in writing the Level Three decision to the Commissioner of the Department of Administration within twenty (20) working days after the decision at Level Three is due or received, whichever is earlier. The written appeal shall refer it state, when appropriate, specifically which Article(s) and Section(s) of the Agreement the Employer may have violated. The Commissioner of the Department of Administration, or designee, shall submit his/her decision and the reasons therefore in writing to the Board Association within twenty (20) working days after receipt of Education. B. The parties will have ten (10) working days from submission of the written statement of grievance to meet and resolve it by indicating on the superintendentstatement of grievance the disposition. If an agreeable disposition is made, or his/her designated representative, who within five (5) work days of the receipt of all parties to the grievance shall sign it. Grievance forms may be found in the back of the contract book as Appendix D or from any Association Team representative.
14.2.3 If no settlement has been reached within the ten (10) working days referred to in the preceding subsection, and the Association believes the grievance to be valid, a written statement of grievance shall be submitted within 15 working days to the District superintendent or the superintendent's designee. After such submission, the parties will have 30 calendar days from submission of the written statement of grievance to meet with and resolve it by indicating on the employee statement of grievance, the disposition. If an agreeable disposition is made, all parties to the grievance shall sign it.
14.2.4 If no settlement has been reached within the 30 days referred to in the preceding subsection, and the Association Representative in an effort believes the grievance to resolve be valid, the matterAssociation may demand arbitration of the grievance. The arbitration panel shall consist of one (1) representative from the Association, one (1) representative from the District, and a third person to be selected by the two. Within ten (10) work days of the receipt expiration of the grievance30-day period referred to in the preceding subsection, the Superintendent or his/her designated representative, shall indicate in writing his/her disposition of the grievance to the grievant District and Association Representative.
D. STEP III If the grievance remains unresolved within five (5) work days of the receipt of the written decision in Step II, the Association shall refer it in writing submit to the Board other the names of Education. Step 1 An employee who has a formal grievance shall first go to the Director or Manager directly in charge of the department. Within The employee shall be accompanied or represented by a Xxxxxxx or a designated Union representative of his/her choice. The Director/Manager shall be presented with the grievance form. The date of receipt of the complaint shall be within fifteen (15) working days of the occurrence of the alleged grievable act. In exceptional circumstances where the Union can demonstrate that it was unaware of the alleged grievable act, the College agrees that the fifteen (15) working days shall be from the time that the Union could have become aware of the occurrence of the act. The Director/Manager shall explore the complaint verbally. The parties shall be given the maximum of five (5) working days to solve the grievance. The Director/Manager shall submit a written response to the employee and the Union within seven (7) working days of the date of receipt of the complaint. If the grievance is denied at Step 1 the Union and the Exempt Supervisor or Manager shall meet to discuss possible resolution of the grievance. If no resolution can be reached the grievance shall be advanced to Step 2.
Step 2 The Union has a maximum of five (5) working days from the date of receipt of the Director/Manager’s response to advance a grievance to Step 2, which is a written referral to the Grievance Committee and the Labour Committee. These committees shall meet within five (5) working days, upon receipt of the Union’s written notice, to resolve the grievance. The College will provide a written response to the Union within five (5) working days of the Committees’ meeting.
Step 3 If the grievance is not satisfactorily resolved at Step 2, the Union shall submit the grievance, in writing, to the College President within ten (10) work working days of receipt of the reply as set out in Step 2. The Union President (or designate) and the College President (or designate) shall meet within five (5) working days of the receipt of the grievance, the Superintendent . The College President (or his/her designated representative, designate) shall indicate in writing his/her disposition of the grievance to the grievant and Association Representative.
D. STEP III If the grievance remains unresolved submit a written reply within five (5) work working days of the receipt of meeting. If the written decision in grievance is not resolved at Step II3, the Association shall Union may refer it in writing the grievance to Arbitration or to the Board of EducationEarly Intervention Procedure. If no settlement has been reached within the five (5) days referred to in the preceding subsection, and the employee believes the grievance to be valid, a written statement of grievance shall be submitted within ten (10) work days of its alleged occurrence, or the discovery thereof (if the discovery could not reasonably have been made at the time of occurrence), discuss it with the immediate supervisor. At this and subsequent steps in the grievance procedure, an Association representative may accompany the employee upon request of the employee. The immediate supervisor will render his/her decision within five (5) work working days to the District Superintendent or his designee. After such submission, the Superintendent shall have ten (10) working days in which to meet with the grievant and association representativerender a decision with regard to the grievance.
B. STEP I If D. The grievant may appeal the discussion at Superintendent's decision within ten (10) working days to the informal level above does not resolve the grievance, within five (5) work days following the decision the Association Representative shall Board of Directors. b. Arbitrators shall be selected from a hearing within thirtypanel of seven (7) provided by FCMS. The employer shall strike the first name, the parties shall then alternate striking names. The last name remaining shall ne the arbitrator. Each of these arbitrators shall agree to all of the Arbitration Rules of the American Arbitration Association.
c. The arbitrators shall have no authority to add to, subtract from, change or modify any provisions of this Agreement. However, nothing contained herein shall be construed to limit the authority of the arbitrator or the judgment of the arbitrator to sustain, or reverse, or modify any alleged dispute put before the arbitrator.
d. The decision of the arbitrator shall be binding on both the Union, the employee and the Employer and not subject to further appeal.
e. Expenses and fees of the arbitrator shall be shared equally by the Union and the College.
