GUARANTEES & WARRANTIES. Vendor warrants to APS that all goods furnished under this Purchase Order will be new unless otherwise specified in writing by APS, and that all performance will be of first class quality, free from faults and defects. All Deliverables provided not conforming to these requirements shall be considered defective. All manufacturer warranties shall be assigned to APS. Nothing stated herein shall in any way limit any applicable implied warranties. The warranty shall be for a period of minimum of one-(1) year, from acceptance by APS of the goods furnished under this Purchase Order, or the manufacturer’s standard warranty, whichever is longer. The warranty shall include all parts, labor, transportation, and any other costs (except general supply items) necessary to keep the product in good operating condition. The cost of this one (1)-year warranty shall be included in the price quoted.
GUARANTEES & WARRANTIES. 19.1 The Processor guarantees the testing procedure used to test milk samples.
19.2 The Processor guarantees accuracy of volumetric measuring of milk collected.
19.3 The Processor guarantees cleanliness of all equipment upon taking ownership of the milk and the Xxxxxx guarantees the cleanliness of all equipment before delivery of the milk.
19.4 Both the Processor and Xxxxxx warrant that they are possessed of all necessary authorisations, licences, approvals and permits for the conduct of their respective businesses.
19.5 If a party becomes aware of a wilful breach, false or misleading representation in relation to any warranty under this agreement, they will inform the other party.
19.6 Both parties respectively warrant that at the date of signing the agreement each party has the power to lawfully execute the agreement and all necessary actions have been taken to authorise the execution of the agreement.
GUARANTEES & WARRANTIES. 1. In addition to the general guarantee, provide all written guarantees specified in the technical sections of the Specifications. Where the guarantee terms are included in the Specifications or a specific guarantee is referenced, submit guarantee in the specified form. Submit guarantees prior to final payment. The Contractor shall provide a checklist of required guarantees, by section numbers. D Test Reports and Certificates: Provide all test reports and certificates required in the technical sections prior to final payment. Provide a checklist of required reports and certificates, by Specifications sections. E Retention of Records: Retain all records as required by law and good business practice. F Deliver the Owner’s Copies to the Elevator Consultant upon final Completion of the Project. Review the set with the Elevator Consultant to clarify or explain changes that may be necessary.

53.4 If seasonal limitations prevent performance of any required testing of the product, the warranty period for such equipment shall begin after the tests have been successfully performed.

Web Matters does not provide any guarantee or warranty whatsoever on any third party software that is used in the construction of the website including the code used in Open Source content management systems or plugins or commercial premium WordPress plugins or themes. If the client is not satisfied with the website design service provided, they must inform Web Matters in writing of the specific issues they have within 30 days of the website going live. Web Matters may at its discretion supply additional services as a remedy.

2. Licensor guarantees the operability of the currently available version of the NNIME Database.
3. Licensor has made all efforts possible to avoid NNIME Datasets being subject to the rights of third parties, in particular that its use does not infringe patents, copyrights or other intellectual property rights of third parties. However, Licensor does not guarantee that NNIME Datasets are not subject to the rights of third parties. Licensee shall notify Licensor immediately and in writing if any third party should assert an infringement claim against Licensee in connection with the NNIME Database.
4. Licensor does not guarantee the accuracy, completeness, correctness, non-infringement of third party rights or fitness for a particular purpose of information available from the currently available version of the NNIME Database.
5. Licensor does not guarantee that the technical details of the NNIME Database are suitable for a specific purpose beyond the specifications in the NNIME document and quality guideline.
6. In case of programming errors (e.g. technical corruption) limiting the usability of the currently available version of the NNIME Database, the warranty period shall be one year after purchase of a license.
