The Agencies Health and Safety Committees will be es tablished within the appropriate facilities operated by the Departments of Education, Community Health, Department of Human Services, and Military and Veterans Affairs. In the Departments of Natural Resources, Licensing and Regulatory Affairs and State Police, the Union's representation on Health and Safety committees shall be an appropriate subject for secondary negotiations. In the Department of Corrections, subjects concerning Health and Safety shall be a proper agenda item for Labor-Management meetings at the Facility and/or Department level. In the Departments of Education, Community Health, Department of Human Services, and Military and V eterans Affairs, should a D epartmental Health and Safety Committee(s) be established, the Union shall establish Laborbe entitled to designate one (1) representative and may designate one (1) or more alternates to serve in the absence of the designated representative. The designated Local Union representative shall be allowed time off with pay to attend authorized committee meetings scheduled during his/Management Health her working hours. For purpose of pay only, properly designated Union representatives or alternates serving on t hese committees shall be permitted an equivalent amount of time off from their upcoming or previous shifts in accordance with Article 8, Section B. In the Departments of Education, Community Health, Department of Human Services, and Safety Committees. Each Military and V eterans Affairs each Agency shall have continue a Health and Safety Committee. This committee may shall be combined with appointed by the Agency Labor/Management Committee upon mutual agreement of Agency Management Appointing Authority and shall include the Union's designated representative. In each Agency that operates with institutions/geographic districts or regions, there shall be a Health and Safety Committee per institution/geographic district or region, unless otherwise mutually agreed upon. Unless mutually agreed otherwise each The chairperson of the committee shall be composed of no more than three (3) representatives appointed by the Employer Agency Appointing Authority and three (3) employees appointed by s hall be responsible for notifying the Union committee members of meetings, conducting the meetings, preparation and distribution of minutes, reports and other documents, arranging for conference rooms, and similar administrative tasks. Such committee shall meet bimonthly or more often if mutually agreed at the request of either party for the purpose of identifying and c orrecting unsafe or unhealthy working conditions which may exist. Appointments to the committee shall be co-chaired by a Union and an Employer representative. The general responsibility of all the committees will be to provide a safe and healthful workplace by recognizing hazards and recommending abatement of hazards and recommending education programs. To fulfill this responsibility the committees shall: A. Meet on a definitely established schedule, but in no case more frequently than once a quarter, unless otherwise mutually agreed; B. Arrange periodic inspections to detect, evaluate and offer recommendations for control of potential health and safety hazards including working alone situations; C. Appoint members of the Union to accompany inspections; D. Discuss Agency plans and policies for preventing workplace violence; E. Receive copies of all accident and illness reports, lists of toxic materials and exposure records; when incident reports involve resident(s), client(s), patient(s), youth(s) and/or inmate(s), for purposes of confidentiality, a separate accident report will be prepared omitting the name(s) of the resident(s), client(s), patient(s), youth(s) or inmate(s); F. Promote health and safety education; and G. Maintain and review minutes of all committee meetings. H. The Employer will make available to Agency Health and Safety Committees information regarding ergonomic requirements that can be used to make appropriate adjustments in existing workplace settings. Members of the Health and Safety Committee shall be allowed paid time off from their regular work while performing committee duties and shall also be allowed paid time off for training relating to health and safety. Each committee shall establish rules consistent with the above principles. A mechanism to coordinate the efforts of individual committees shall be established at each Agency.

This committee may be combined with the Agency Labor/Management Committee upon mutual agreement of Agency Management and the Union. In each Agency that operates with institutions/geographic districts or regions, there shall be a Health and Safety Committee per institution/geographic district or region, unless otherwise mutually agreed upon. Unless mutually agreed otherwise each committee shall be composed of no more than three (3) representatives appointed by the Employer and three (3) employees appointed by the Union and shall be co-chaired by a Union and an Employer representative. Each facility operated by Agencies required to meet health and safety standards established by the Joint Commission on the Accreditation of Health Care Organizations (JCAHCO) or the Accreditations Council for Services for MRDD (AC MRDD) and/or the Medicaid/Medicare reimbursement programs shall have one (1) Health and Safety Committee.
