HEALTH AND SAFETY. 7A01 The parties to this Collective Agreement endorse the importance of a safe and secure environment, in which nurses must work. The parties will work together in recognizing and resolving Occupational Health and Safety issues. 7A02 In accordance with the Workplace Safety and Health Act, the Employer agrees to make reasonable and proper provisions for the maintenance of a high standard of health and safety in the workplace and will provide safety and personal protective equipment where required and install safety devices where necessary. 7A03 The Workplace Safety and Health Committee shall operate with Union representation for the purpose of ensuring health and safety in the workplace and the identification of health and safety hazards. On an annual basis the Workplace Safety and Health Committee will be provided with a copy of the Critical Incident Stress Management or applicable policies for review. 7A04 The Employer and the Union agree that no form of abuse of nurses will be condoned in the workplace. Both parties will work together in recognizing, facilitating the reporting of alleged abuse and resolving such problems as they arise. Any nurse who believes a situation may become or has become abusive shall report this to the immediate supervisor. The Employer shall notify the Union ninety-six (96) hours after the receipt of the report. Every reasonable effort will be made to rectify the abusive situation to the mutual satisfaction of the parties. There shall be a policy supporting a Respectful Workplace and zero tolerance of staff abuse which shall be reviewed annually by the Workplace Health and Safety Committee. Such policy shall address the issue of communication strategies, which will include signage. The Employer’s Respectful Workplace policy shall include a commitment to conclude the investigation as quickly as is reasonably possible and that the investigation process itself will be conducted in an impartial manner. 7A05 At the request of a nurse, the Employer shall provide, at no cost to the nurse, vaccination(s) and/or immunization(s) for occupational illness(es) in accordance with the Canadian Immunization Guide from the Laboratory Centre for Disease for Health Canada. 7A06 Rehabilitation and Return to Work Program - The Employer agrees to actively participate and facilitate the rehabilitation and return to work of ill, injured or disabled nurses even when she/he is not covered under the D & R, WCB or MPI programs. Any such nurse will be supernumerary in nature when reasonably possible. The Union shall be notified by the Employer if there is a request for a Rehabilitation and Return to Work Program for a nurse. The Employer shall include the Union in the initial meeting with the nurse to review the provisions of the program to ensure that the work designated is within her/his restrictions and limitations. If required, the Employer shall schedule subsequent (progress) review(s) with the Union and the nurse and may proceed without the Union’s involvement subject to the Union’s concurrence. Where appropriate, by agreement between the Employer and the Union, job postings may be waived. 7A07 Whistle Blowing Protection - Nurses who exercise their rights in accordance with the Public Interest Disclosure Act shall not be subject to discipline or reprisal. 7A08 Basic pay or equivalent time off with a minimum of one (1) hour guaranteed to nurses who are not on duty, will be granted to nurses appointed by the Union to attend meetings of the Workplace Safety and Health Committee or to perform such other duties as may be specified in the Workplace Safety and Health Act or prescribed by regulation. In accordance with the Workplace Safety and Health Act, a nurse is entitled to take time off from her/his regular work duties in order to carry out her/his duties as a committee member under this Act and the regulations. The nurse shall be paid by the Employer at her/his regular or premium pay, as applicable, for all time spent carrying out her/his duties as a committee member under this Act and the regulations. Upon application, each nurse on the Workplace Safety and Health Committee shall be granted paid educational leave in accordance with the Workplace Safety and Health Act. As part of the above paid education days, new Committee Members shall be required to attend a basics course offered by Manitoba Workplace Safety and Health or an equivalent course approved by the Workplace Safety and Health Committee within their first year on the Committee.

HEALTH AND SAFETY. 7A01 22.01 The parties Company shall maintain safe, sanitary and healthful conditions at all its operations pursuant to this Collective Agreement endorse the importance Canada Occupational Safety and Health Regulations. Employees shall comply with the duties and responsibilities specified in the regulations affecting Occupational Safety and Health in the workplace.
22.02 The Company will make provisions for the safety and health of the employees during working hours. No employee shall be required to use or work with faulty equipment which poses a safety hazard. An employee noting such faulty equipment shall immediately notify the Supervisor who shall in turn make the necessary correction. The employee may also advise the Union Health & Safety Officer.
22.03 An employee may refuse to perform work where she has reasonable grounds to believe and does believe that the particular work is dangerous to her health and safety or the health and safety of another employee. Where an employee invokes their right to refuse under the Canada Labour Code, the Company and the Union shall resolve the problem which initiated work refusal in accordance with the regulations and procedures specified in the Canada Labour Code. The Company shall not take disciplinary action against an employee(s) for refusal to work in accordance with the above.
22.04 Employees injured at work will not be required to make accident reports before they are given medical attention, but will make them as soon as practicable thereafter. Transportation as recommended by the First Aid Attendant will be provided by the Company to and from a doctor or hospital if medical care is required.
22.05 Each employee has an obligation to bring any situation which in her opinion represents a hazard to the safety and/or health of the employees to the attention of her Supervisor. The employee may also advise her Union Health and Safety Officer who will discuss it with the Supervisor. Where the Union Health and Safety Officer is not satisfied that the Supervisor has effectively dealt with the situation the matter may be referred to the Joint Safety Committee.
22.06 The Company will not require employees represented by the Union to participate in searches of Company equipment, property or premises in the event of a safe bomb threat. This understanding does not preclude the voluntary participation by these employees in such searches. However, the Company shall inform the employees that a bomb threat has been reported before requesting the employees to search or service the Company's equipment, property or premises.
(a) The Company shall provide First Aid coverage within the workplace as prescribed in the Canada Occupational Safety and secure environmentHealth Regulations.
(b) All employees selected by the Company and holding a valid First Aid Certification shall be paid a premium of fifteen dollars ($15.00) per month.
(c) The Company shall provide First Aid training where necessary.
(d) Additional training will be provided by the Company to maintain the validity of First Aid certificates.
(a) Joint Occupational Safety and Health Committees shall be established and operated in the workplace pursuant to the Canada Labour Code and the Canada Occupational Safety and Health Regulations.
(b) The Safety Committees will meet monthly to discuss health and safety matters and will be chaired alternately by Union and Company representatives.
(c) It is agreed that no less frequently than twice annually the Committees will discuss ergonomic concerns and/or pending changes in the employees' workplace and will make recommendations for improvements and/or corrections to Senior Management.
22.09 The installation of equipment shall involve consultation with the employees' representatives directed towards assuring that all "ergonomic" factors are dealt with satisfactorily.
22.10 If a permanent employee develops a particular and adverse reaction to exposure at a worksite to certain hazardous substances and she provides a medical certificate supporting such condition, in which nurses must work. The parties will work together in recognizing and resolving the employer shall follow the Canadian Occupational Health and Safety issuesRegulations, Part 10 (ten), Division 1. 7A02 In accordance If there is no other reasonable option which will allow the employee to continue working with such substance, she may elect one of the Workplace Safety and Health Act, the Employer agrees to make reasonable and proper provisions for the maintenance following options:
(a) exchange of a high standard of health and safety positions with another employee in the workplace and will provide safety and personal protective equipment where required and install safety devices where necessarysame classification on a voluntary basis;
(b) mutual exchange of position with another employee in another classification for which both are qualified, on a voluntary basis;
(c) transfer to any vacancy covered by the Collective Agreement for which she is qualified. 7A03 The Workplace Safety and Health Committee shall operate with Union representation for the purpose of ensuring health and safety in the workplace and the identification of health and safety hazards. (a) When a Union representative notes that the quality of the environment is deteriorating, they are obliged to inform the Employer without delay in writing, or orally if they have reason to believe that the situation is urgent. Accordingly, the Employer shall:
(i) place the matter on the agenda of the next meeting of the Workplace Health and Safety Committee.
(b) Any investigation report arising from the examination of a problem will be condoned in the workplace. Both parties will work together in recognizing, facilitating the reporting of alleged abuse and resolving such problems as they arise. Any nurse who believes a situation may become or has become abusive shall report this made available to the immediate supervisorLocal Union.
(c) If the Union or the Local is not satisfied with the results of the investigation report it may request that the Workplace Health and Safety Committee conduct another investigation.
(d) The Union representative must be present at all investigations or inspections arising under paragraph (c) of this Article.
30:05 The Employer agrees to provide at no expense to the employee appropriate transportation to the nearest physician or hospital and from there to their home or place of work depending on the decision of the attending physician when such services are immediately required for an employee as a result of:
(a) injury on the job, or
(b) a heart attack or other serious ailment which occurs on the job. The Employer shall notify the Union ninety-six Workplace Health and Safety Committee and the Local of incidents of this nature.
30:06 The Employer will assume the costs of training employees designated as First Aid Attendants. Employees selected for first aid training will be granted time off with pay to attend first aid courses.
30:07 If the Employer requires an employee to wear safety footwear on a daily basis, it will provide an annual footwear allowance of (96) hours after 300.00 per calendar year. If the receipt Employer requires an employee to occasionally wear safety footwear, it will provide a footwear allowance at the applicable rate once during the life of the reportcollective agreement. Every The Employer shall provide the footwear allowance one (1) additional time during the life of the collective agreement where the employee demonstrates that their boots are no longer serviceable.
30:08 Each year on April 28 at 11:00 a.m., subject to reasonable effort operational requirements, work will stop and one minute of silence will be made to rectify observed in memory of workers killed or injured on the abusive situation to job. Should an employee be involved in an operational matter, the mutual satisfaction minute of the partiessilence will be observed afterwards, as time permits. The Employer shall design and post appropriate signage in an impartial mannersupport of the non abuse policy. 7A05 At the request of a nurse, the Employer shall provide, at no cost to the nurse, vaccination(s) and/or immunization(s) for occupational illness(es) in accordance with the Canadian Immunization Guide from the Laboratory Centre for Disease for Health Canada. 30:03 A Workplace Health and Safety Committee and a Policy Health and Safety Committee of abuse equal representation shall be established in accordance with the provisions of nurses the Canada Labour Code.
(a) When a Union representative notes that the quality of the environment is deteriorating, she/he is obliged to inform the Employer without delay in writing, or orally if she/he has reason to believe that the situation is urgent. Accordingly, the Employer shall:
(i) place the matter on the agenda of the next meeting of the Workplace Health and Safety Committee.
(b) Any investigation report arising from the examination of a problem will be condoned in the workplace. Both parties will work together in recognizing, facilitating the reporting of alleged abuse and resolving such problems as they arise. Any nurse who believes a situation may become or has become abusive shall report this made available to the immediate supervisorLocal Union.
(c) If the Union or the Local is not satisfied with the results of the investigation report it may request that the Workplace Health and Safety Committee conduct another investigation.
(d) The Union representative must be present at all investigations or inspections arising under paragraph (c) of this Article.
30:05 The Employer agrees to provide at no expense to the employee appropriate transportation to the nearest physician or hospital and from there to his/her home or place of work depending on the decision of the attending physician when such services are immediately required for an employee as a result of:
(a) injury on the job, or
(b) a heart attack or other serious ailment which occurs on the job. The Employer shall notify the Union ninety-six Workplace Health and Safety Committee and the Local of incidents of this nature.
30:06 The Employer will assume the costs of training employees designated as First Aid Attendants. Employees selected for first aid training will be granted time off with pay to attend first aid courses.
30:07 When an employee who is pregnant expresses concern about the possible ill effects of her work or work location upon her health or the health of her unborn child and is supported in that concern by a medical certificate issued by a qualified medical practitioner or recognized alternative health practitioner which includes midwives, nurse practitioner and naturopath. The Employer will consider this information in the endeavour to find alternate duties for the employee within or outside the bargaining unit after consultation with the Union.
30:08 If the Employer requires an employee to wear safety footwear on a daily basis, it will provide an annual footwear allowance of (96) hours after 250.00 per calendar year. If the receipt Employer requires an employee to occasionally wear safety footwear, it will provide a footwear allowance at the applicable rate once during the life of the reportcollective agreement. Every The Employer shall provide the footwear allowance one (1) additional time during the life of the collective agreement where the employee demonstrates that his/her boots are no longer serviceable.
30:09 Each year on April 28 at 11:00 a.m., subject to reasonable effort operational requirements, work will stop and one minute of silence will be made to rectify observed in memory of workers killed or injured on the abusive situation to job. Should an employee be involved in an operational matter, the mutual satisfaction minute of the parties.
