Common use of Holiday Falling on a Scheduled Workday Clause in Contracts

Holiday Falling on a Scheduled Workday. (a) An employee who works on a designated holiday which is a scheduled workday shall be compensated at the rate of double-time for hours worked, plus a day off in lieu of the holiday; except for Christmas and New Year's when the compensation shall be at the rate of double-time and one-half for hours worked, plus a day off in lieu of the holiday. The scheduling of the lieu day shall be by mutual agreement. (b) Pursuant to (a) above, days off in lieu of paid holidays shall be scheduled within 60 days following the paid holiday by mutual agreement and be taken within one calendar year from the day following the paid holiday. If the lieu day is not scheduled or taken pursuant to this article, it shall be paid out on the next payday. This article does not apply where the days in lieu of paid holidays are built into the shift pattern.
