House Construction a) The Vendor will or will continue to construct the House on the property with all reasonable speed to achieve Practical Completion. b) The Vendor will not be liable for any delay in achieving Practical Completion due to circumstances beyond its control, such as strikes, accidents, civil commotions, epidemics, floods, bad weather in excess of the norm for that time of year, transportation delays, shortage of materials and acts of God. c) The Vendor will construct and complete the House in a thorough and workmanlike manner and in strict accordance with the Building Consent, the Council bylaws, all applicable legislation and regulations, and the Plans and Specifications. The Vendor may subcontract part of the construction of the House but will remain fully liable for the subcontracted work. d) The Purchaser is able to choose the colours of any product or item to be supplied and installed in the House provided that - i) any colour selected shall be from the manufacturer’s or supplier’s standard colour range and ii) at the time this Agreement becomes unconditional the item or product is not already supplied, installed or ordered and the order cannot be changed. e) To comply with the provisions of the Health and Safety at Work Act (2015) and the Health and Safety at Work (General Risk and Workplace Management) Regulations 2016, the Purchaser may not have access to the property without being accompanied either by the Vendor or the Vendor’s agent.

House Construction. The work on your home will be done in part by you and volunteers. The construction costs will be paid by donations we are given. Construction standards will meet or exceed all local building codes. Every effort will be made to complete the construction work during the projected time period and at the estimated costs. The completion timetable and final costs, however, cannot be guaranteed. We project that construction will begin within ___ [days/weeks] of the execution of this agreement and should take ____ months to complete. We estimate the price of the finished home to be $_____________. You will be responsible for the interior and exterior maintenance of your Xxxxxx Center home and property and will be expected to maintain to meet or exceed neighborhood standards. You are responsible for all utilities and any costs related to the maintenance and upkeep of their house.

House Construction. At the appropriate time and if you fulfill all of the conditions contained in this Agreement, we will begin to review with you the estimated cost of construction of the house, the estimated construction schedule, your estimated mortgage payments, specific house plans and other details regarding the construction and sale of the house. Houses constructed by Habitat for Humanity are built with a combination of skilled labor, unskilled volunteer labor and the labor of you and your family members. In addition, many materials and a significant portion of the money used to build your house will be donated. While we will make reasonable efforts to complete the house in general accordance with the attached basic house description and more specific house plans to be shown to you at a future date, because of changes in circumstances and uncertainty regarding future funding and donations, we are unable to promise that your house will be built according to the original plan, or that it will be built at all. In addition, if the house is built, we cannot guarantee a completion date or the maximum total construction cost of the house. If you are not satisfied for any reason with specific details about the house plans or features, location, price, construction schedule or any other matter, you may withdraw from the Program at any time prior to closing and receive a full refund of any closing costs payment you have made, although you will not be compensated for the value of your “sweat equity” hours, as described under the “Sweat Equity” section of this Agreement.
House Construction. Purchaser shall be responsible for the construction of all units and payments of all costs attendant thereto, including, without limitation: a) Excavation for foundations and erosion control; b) Construction of foundations and all necessary lot utilities; c) Supplying all lumber, steel, insulation, windows, doors, sheetrock, paint, wallpaper, floor coverings, cabinets, countertops, concrete, concrete block, brick, stone, vinyl siding, wood siding, roofing materials, pipe, plumbing fixtures, plumbing supplies, electric wire, electric boxes and connectors, electric devices, lights, appliances, mirrors, tile, nails and any other materials necessary to complete the construction of the units; d) Supplying all labor to erect the units; e) Purchaser shall construct the units in compliance with all applicable federal, state or local building codes; f) All materials and supplies used in connection with the construction of a unit shall be new and both workmanship and materials shall be of good quality; g) Purchaser shall provide all required statutory warranties for the construction and sale of the new homes, and

  • Law; Construction This Agreement and any claim, counterclaim or dispute of any kind or nature whatsoever arising out of or in any way relating to this Agreement (“Claim”), directly or indirectly, shall be governed by, and construed in accordance with, the internal laws of the State of New York.

  • DAF Construction The DAF shall be designed and constructed in accordance with Good Utility Practice. Within one hundred twenty (120) Calendar Days after the Commercial Operation Date, unless the Developer and Connecting Transmission Owner agree on another mutually acceptable deadline, the Developer shall deliver to the Connecting Transmission Owner and NYISO “as- built” drawings, information and documents for the DAF, such as: a one-line diagram, a site plan showing the Large Generating Facility and the DAF, plan and elevation drawings showing the layout of the DAF, a relay functional diagram, relaying AC and DC schematic wiring diagrams and relay settings for all facilities associated with the Developer’s step-up transformers, the facilities connecting the Large Generating Facility to the step-up transformers and the DAF, and the impedances (determined by factory tests) for the associated step-up transformers and the Large Generating Facility. The Developer shall provide to, and coordinate with, Connecting Transmission Owner and NYISO with respect to proposed specifications for the excitation system, automatic voltage regulator, Large Generating Facility control and protection settings, transformer tap settings, and communications, if applicable.

  • ICIF Construction The ICIF shall be designed and constructed in accordance with Good Utility Practice. Within one hundred twenty (120) Calendar Days after the Commercial Operation Date, unless the Parties agree on another mutually acceptable deadline, Interconnection Customer shall deliver to Transmission Provider and Transmission Owner “as-built” drawings, information and documents for the ICIF, such as: a one-line diagram, a site plan showing the Generating Facility and the ICIF, plan and elevation drawings showing the layout of the ICIF, a relay functional diagram, relaying AC and DC schematic wiring diagrams and relay settings for all facilities associated with the Interconnection Customer’s step-up transformers, the facilities connecting the Generating Facility to the step-up transformers and the ICIF, and the impedances (determined by factory tests) for the associated step-up transformers and the Generating Facility. Interconnection Customer shall provide Transmission Provider and Transmission Owner with Interconnection Customer’s specifications for the excitation system, automatic voltage regulator, Generating Facility control and protection settings, transformer tap settings, and communications, if applicable.

  • New Construction If this contract is for a Property that is newly constructed and the new construction option is selected, coverage begins on day one (1) of month thirteen

  • Language Construction The language of this Agreement shall be construed in accordance with its fair meaning and not for or against any party. The parties acknowledge that each party and its counsel have reviewed and had the opportunity to participate in the drafting of this Agreement and, accordingly, that the rule of construction that would resolve ambiguities in favor of non-drafting parties shall not apply to the interpretation of this Agreement.

  • Strict Construction The parties to this Agreement have participated jointly in the negotiation and drafting of this Agreement. In the event an ambiguity or question of intent or interpretation arises, this Agreement will be construed as if drafted jointly by the parties, and no presumption or burden of proof will arise favoring or disfavoring any party by virtue of the authorship of any of the provisions of this Agreement.

  • Liberal Construction The Covenants hereof shall be liberally construed to promote and accomplish the objectives set forth in the Recitals.

  • Project Construction The Contractor agrees to provide continuous on-site supervision on each Job Order, while progress on the project is being accomplished. The Contractor’s Project Manager will ensure: 1. Coordination and providing supervision to all Subcontractor and workers; 2. Posting of the prevailing wage scale; 3. Maintaining a copy of the Contractors safety program manual made available to all construction personnel; 4. Conducting weekly on-site safety meetings; 5. Completing the daily labor and construction progress log on a daily basis and submit copies to the County on a daily basis. Copies of the previous day’s reports must be submitted by 9:00AM of the following day. a. Daily labor log is to include a listing of Subcontractor(s) and a count of workers by trade providing services for the day. b. Construction progress log is to include a narrative of the Work provided by trade(s). Narrative agrees to include the various areas of the jobsite where Work was performed and any problems or conditions that were encountered. c. In the event the Contractor fails to provide a daily log and/or construction progress log, the County may impose damages against the Contractor in the amount of fifty dollars ($50.00) for each log and deduct from the Contractor’s payment request, for each day the Contractor does not provide the documentation. 6. County may suspend Contractor operations if no Contractor Superintendent is observed. All delays caused by the suspension will be the responsibility of the Contractor. No time extension or claims for cost(s) associated with the suspension will be granted by the County.
