Humanitarian Clause. Should an employee, covered by this Agreement, become physically or mentally handicapped to the extent that he cannot perform his regular job, the Employer will make a reasonable effort to place the employee in a position either in or out of the bargaining unit that he is physically and mentally able to perform.
Humanitarian Clause. Should an employee covered by this Agreement become physically or mentally handicapped to the extent that the employee cannot perform his/her regular job, the City will make every reasonable effort to place the employee in a position within City employment that the employee is physically and mentally able to perform, subject to the City's legal or contractual obligations to other City employees.

Should an employee covered by this Agreement become physically or mentally handicapped to the extent he/she cannot perform his/her regular job, Management will make every effort to place the employee in a position that he/she is physically and mentally able to perform. During the life of this agreement, the parties agree to discuss and attempt to arrive at an agreement for a comprehensive program to assist management’s efforts to place the employee in a position that he/she is physically and mentally able to perform.
Humanitarian Clause. Section 1. Should an employee covered by this Agreement become physically or mentally handicapped to the extent the employee cannot perform their regular job, Management will make every effort to place the employee in a position that the employee is physically and mentally able to perform; in so doing, Management will attempt to place the employee in a position as close as possible to their previous wage level. The promotional provisions of Article 12 shall not be construed as a bar to appointing an individual under this provision to a classification with a higher maximum range.
Section 2. The parties agree to form a committee to review and develop a light duty work program. The Union and Management will each designate three individuals to serve on this committee. The committee will develop a plan to maximize the use of employees who have become disabled. The plan will be submitted to the City and the Union by January 1, 1988 (as a result, the parties established the Disabled Employee Program effective June 1, 1990).

Should an employee covered by this Agreement become physically or mentally handicapped to the extent that they cannot perform their regular job, the Employer will make an effort to place the employee in a position within the bargaining unit that they are physically and mentally able to perform. The parties recognize that the Americans with Disabilities Act (ADA) applies to the Sheriff Office. In the event of a conflict with this labor contract and the ADA, the ADA shall supersede that provision.

Should an employee covered by this agreement become physically or mentally handicapped to the extend that he cannot perform his normal job duties, the Sheriff has the right, but shall not be obligated, to place the employee in a position that he is physically and mentally able to perform within the Sheriff’s Department. The determination of the employee’s physical and mental limitations is to be made by a physician selected by the Employer.
Humanitarian Clause. The NFTA will provide to the estate of a Assistant Fire Chief who, while performing his/her duties, dies:
1. All unpaid wages due the Officer
2. All unused vacation leave

Humanitarian Clause. If an Employee dies while employed by the Employer, the Employee’s estate shall receive the following from the Employer:
1. All unpaid wages due the Employee.
2. All unused vacation time and any personal leave time.
3. The pro-rated share of any clothing allowance due the Employee.
Humanitarian Clause. In the event an employee covered by this Agreement is disabled to the extent that he/she cannot fully perform his/her regular job assignments, the Sheriff and/or County will attempt to place the employee in a position with the Department or County for which the employee is fully able and wholly qualified to perform all of the job requirements (with or without accommodation), provided, however, that this Section shall not be construed to require the Sheriff or County to create jobs or vacancies which do not otherwise exist; and provided further, the provisions of this Section shall be implemented only to the extent they do not conflict with other requirements of this or any other collective bargaining agreement.
