ILLNESS LEAVE BANK. The purpose of the Catastrophic Illness Leave Bank is to relieve teachers from undue financial burdens as a result of an absence from work due to illness, injury, or incapacitation sufficiently severe to make the performance of their duties impossible. a. Any member of the bargaining unit (teacher), as defined in Article 1, shall be eligible to become a member of the Catastrophic Illness Leave Bank. b. A teacher may withdraw from the Catastrophic Illness Leave Bank at any time by notifying the Personnel Department in writing. However, any and all donated days lose their identity and become the property of the Catastrophic Illness Leave Bank. c. The Bank shall be formed by voluntary participation and voluntary donations of one (1) sick day by teachers who then become members. d. The Bank will have an open enrollment period for teachers to become members for thirty (30) working days following the opening of each school year. e. New teachers may become members and, if so, their first contribution must be made within thirty (30) contract days following the date of employment. f. Teachers who have been in the school corporation may become members during the open enrollment period by paying all back assessments that would have been paid had the teacher joined the Bank when that teacher first had the opportunity to join. g. At such time as the Catastrophic Illness Leave Bank account falls below fifty (50) days, an obligatory assessment of one (1) sick leave day shall be made upon all current members of the Bank who have sick leave days. Teachers shall be notified prior to this assessment. h. The Bank shall be continuous from year-to-year. i. An annual report of the catastrophic illness leave bank will be published on or before annual Average Daily Membership (ADM) day in the fall semester for each budget year the Bank is in operation. Administration will prepare this report and forward it to the WTCTA President for approval and publication. The report shall include a statement of the number of days contributed to the Bank, the number of days granted from the Bank in the previous school year, and the number of days remaining in the Bank. j. The procedure to obtain use of the Catastrophic Illness Leave Bank (hereafter called Bank) is as follows: 1) Written application by the teacher or a qualified representative of the teacher, accompanied by the health care provider’s certificate stating the nature and length of the disability, as well as a prognosis of the teacher's condition, shall be submitted to the Superintendent's designee. 2) The applicant must be a member of the Bank. 3) The Bank may be used only by the individual contributor for his or her personal illness. 4) Days from the Bank may be used only for those working days that the individual contributor is contracted during the school year. 5) The applicant must exhaust all available sick leave and Income Protection Plan days. 6) The Superintendent's designee shall report each decision to the payroll office and the Association president. 7) The Superintendent's designee shall inform the teacher, or, where advisable, a qualified representative of the teacher, within ten (10) contract days of the decision. If the decision is not satisfactory to the teacher, an appeal may be made to the Catastrophic Illness Leave Bank Committee. k. A written appeal of the designee's decision for use of leave days from the Bank must be made within ten (10) contract days upon receipt of the designee's decision. 1) The appeals committee, with the Association president or his/her designee as chairperson, shall act upon the appeal within ten (10) contract days of receipt of the appeal and render a decision. This decision will be final. 2) The Catastrophic Illness Leave Bank Appeals Committee shall consist of the President of the Association or his/her designee, two (2) additional representatives of the Association, the Superintendent or his/her designee, and a second representative of the administration appointed by the Superintendent. A quorum of three is required for a decision. A majority vote of those present shall make the determination. l. The maximum number of contract days that may be granted per teacher shall be one hundred (100) days per school year. The amount paid will be 75% of the teacher's daily rate. m. Proof of continuing disability must be provided each thirty (30) calendar days by the recipient or the recipient's qualified representative to the Superintendent's designee.

ILLNESS LEAVE BANK. (A) The purpose Board agrees to establish an Illness Leave Bank to cover teachers in the event of the Catastrophic a long-term illness or injury. The Illness Leave Bank is to relieve teachers from undue financial burdens provided as a result part of an absence from work due a comprehensive disability protection plan created in lieu of short-term and long-term disability insurance programs. Teacher participation in the Illness Leave Bank plan is optional. The Illness Leave Bank shall be administered by a committee composed of three (3) members of the Association appointed by the President of the Association. This committee shall hereinafter be called the Illness Leave Bank Administrative Committee (Administrative Committee). (B) Participation in the Illness Leave Bank plan is accomplished, yearly, by the completion of the instrument provided and set forth in the appendices (APPENDIX F) of this Agreement. Completion and submission of this instrument (APPENDIX F) to illness, injurythe Administrative Committee must be made each year by each teacher wishing to participate, or incapacitation sufficiently severe wishing to make continue participation, in the performance Illness Leave Bank plan. This submission, indicating the desire to participate, must be accomplished by October 1 of their duties impossibleeach contract year. Each teacher wishing to participate and to be covered by the Illness Leave Bank plan shall agree to donate one (1) day of the ten (10) days sick leave {thirteen (13) for first and second year teachers and eleven (11) for Illness Leave Bank participants when the Illness Leave Bank is at its maximum of 185 days} that he/she is allowed to accrue in a one-year contract period. This day will be deposited in the Illness Leave Bank. The donated day will be deducted from the teacher’s personal accrued illness leave. Continued participation in the Illness Leave Bank plan is accomplished each year by donation of this day as described above. a. Any member of (C) Participation in the Illness Leave Bank plan may begin as soon as a bargaining unit member (teacher), as defined ) has sick leave days to contribute. Any member of the bargaining unit (teacher), as defined in Article 1, shall be eligible to become leave days when a member of the Catastrophic bank has used all of his/her own illness leave days, To voluntarily join this bank, a bargaining unit member must contribute one (1) illness leave day to the bank during the first five (5) work days of the school year, by giving notice to the Association president. Bargaining unit members may join the Illness Leave Bank. b. A teacher may withdraw from leave bank only during the Catastrophic Illness Leave Bank at first five (5) work days of any time by notifying school year. New hires after the Personnel Department beginning of the school year have ten (10) work days to join the illness leave bank Bargaining unit members then remain a member of this bank until they resign, retire, or otherwise leave the cooperative’s employment as a bargaining unit member, provided that each bank member makes an additional bank contribution If and when the total bank accumulation drops below ten (10) days. Failure to donate a day as requested will result in writingloss of membership in the illness leave bank. However, any and all donated in the event a member has zero (0) sick leave days lose their identity and become at the property time of assessment of an additional day contribution, such member may remain in the bank but must donate an additional day at the beginning of the Catastrophic next school year. The governing board of the illness leave bank shall consist of two (2) illness bank members appointed by the Association president, the Association president, and the Director. The Association President will serve as the chairperson of the illness leave bank board, Should a member of the governing board need to request days from the illness leave bank, he/she shall remove him/herself from the board and be replaced with another member for the vote on the request. If a member of the Illness Leave Bank. c. leave bank has a personal illness or injury, and will need more leave days than they have accumulated, the bank member or a person on the bank member's behalf may request days from the illness leave bank by sending a letter to the Association president. Accompanying said letter will be written certification from the teacher’s physician substantiating the illness. The Bank governing board will meet after receipt of the letter, and will notify the bank member of the decision of the governing board. No illness leave bank days may be used until the bank member has used all of his/her own personal and sick leave days. No illness bank days can be used by an employee once the elimination period for long­term disability insurance has been satisfied. An applicant may draw up to five (5) days per draw, provided, however that the maximum accumulative draw per teacher over a period of five (5) school years does not exceed twenty (20) days. After a member of the illness leave bank has drawn a number of days and has returned to active employment with the cooperative, the member shall repay one (1) day for every two (2) days borrowed from the bank. These days shall be formed by voluntary participation and voluntary donations repaid at the rate of one (1) sick day by teachers who then become members. d. The Bank will have an open enrollment period for teachers to become members for thirty (30) working days following per school year, deducted at the opening beginning of each school year. e. New teachers . At the end of each school year, the employee may become members and, if so, their first contribution must be made within thirty (30) contract days following the date of employment. f. Teachers who have been in the school corporation may become members during the open enrollment period by paying all elect to pay back assessments that would have been paid had the teacher joined the Bank when that teacher first had the opportunity to join. g. At such time as the Catastrophic Illness Leave Bank account falls below fifty (50) days, an obligatory assessment of additional one (1) sick leave day shall be made upon all current members of the Bank who have sick leave days. Teachers shall be notified prior to this assessment. h. The Bank shall be continuous from year-to-year. i. An annual report of the catastrophic illness leave bank will be published on or before annual Average Daily Membership (ADM) day in the fall semester for each budget year the Bank is in operation. Administration will prepare this report and forward it to the WTCTA President for approval and publication. The report shall include a statement of the number of days contributed to the Bank, the number of days granted from the Bank in the previous school year, and the number of days remaining in the Bank. j. The procedure to obtain use of the Catastrophic Illness Leave Bank (hereafter called Bank) is as follows: 1) Written application by the teacher or a qualified representative of the teacher, accompanied by the health care provider’s certificate stating the nature and length of the disability, as well as a prognosis of the teacher's condition, shall be submitted to the Superintendent's designee. 2) The applicant must be a member of the Bank. 3) The Bank may be used only by the individual contributor for his or her personal illness. 4) Days from the Bank may be used only for those working days that the individual contributor is contracted during the school year. 5) The applicant must exhaust all available sick leave and Income Protection Plan days. 6) The Superintendent's designee shall report each decision to the payroll office and the Association president. 7) The Superintendent's designee shall inform the teacher, or, where advisable, a qualified representative of the teacher, within ten (10) contract days of the decision. If the decision is not satisfactory to the teacher, an appeal may be made to the Catastrophic Illness Leave Bank Committee. k. A written appeal of the designee's decision for use of leave days from the Bank must be made within ten (10) contract days upon receipt of the designee's decision. 1) The appeals committee, with the Association president or his/her designee as chairperson, shall act upon the appeal within ten (10) contract days of receipt of the appeal and render a decision. This decision will be final. 2) The Catastrophic Illness Leave Bank Appeals Committee shall consist of the President of the Association or his/her designee, two (2) additional representatives of days, Once any illness leave bank contribution is made by a bargaining unit member and that day is deducted from the Associationbargaining unit member’s leave accumulation, the Superintendent or his/her designee, and a second representative of the administration appointed by the Superintendent. A quorum of three is required for a decision. A majority vote of those present bank contribution shall make the determination. l. The maximum number of contract days that may never be granted per teacher shall be one hundred (100) days per school year. The amount paid will be 75% of the teacher's daily rate. m. Proof of continuing disability must be provided each thirty (30) calendar days by the recipient or the recipient's qualified representative returned to the Superintendentbargaining unit member's designeeown leave accumulation. On or before September 1 of each school year and as frequently as necessary throughout the year, the Association president will confer with the Xxxxxx-Xxxxxxxx Special Education Cooperative office staff to verify the bank accumulation and membership in the illness leave bank.
