Income Determinations. The Annual Household Income for a prospective tenant of a Rental Affordable Unit shall be determined as of the date of the lease and any lease renewals for such Rental Affordable Unit. A Household’s income eligibility to rent a Rental Affordable Unit is determined by calculating both the Maximum Annual Household Income for a Household occupying the Rental Affordable Unit and the Minimum Annual Household Income for a Household occupying the Rental Affordable Unit. The Certifying Authority shall verify that the Household’s Annual Household Income is between the MAXI and MINI.

Income Determinations. From and after the Final Completion Date (as defined in the Lease) until the expiration or earlier termination of the Term of this Lease, and thereafter so long as Grantor remains in occupancy of the Premises, Grantor shall lease all the Units to Qualifying Households in accordance with the terms of this Lease. Grantor represents, warrants and covenants that the determination of whether a household is a Qualifying Household shall be made by Grantor at the time of leasing of each Unit and thereafter at least annually on the basis of the current income of such household. In initially verifying a household’s income, Grantor shall examine the source documents evidencing annual income (e.g. wage statements, interest statements, unemployment compensation statements) for the household. Grantor shall maintain, until eight (8) years after the respective tenant vacates the premises, as part of its Project records copies of all leases of the Units in the Project and all initial and annual income certifications by tenants of the Units. Grantor shall also provide Town upon request such other information as Grantor is required to provide under the Public Subsidy Program, if any, subject to statutory and regulatory requirements regarding tenant confidential information. Grantor shall also provide the Town with a copy of such other information as the Town may reasonably request in order to ensure compliance with the terms of this Affordable Housing Restriction, subject to statutory and regulatory requirements regarding tenant confidential information and the provisions of the Public Records Law.

  • Expert Determination If a Dispute relates to any aspect of the technology underlying the provision of the Goods and/or Services or otherwise relates to a financial technical or other aspect of a technical nature (as the Parties may agree) and the Dispute has not been resolved by discussion or mediation, then either Party may request (which request will not be unreasonably withheld or delayed) by written notice to the other that the Dispute is referred to an Expert for determination. The Expert shall be appointed by agreement in writing between the Parties, but in the event of a failure to agree within ten (10) Working Days, or if the person appointed is unable or unwilling to act, the Expert shall be appointed on the instructions of the relevant professional body. The Expert shall act on the following basis: he/she shall act as an expert and not as an arbitrator and shall act fairly and impartially; the Expert's determination shall (in the absence of a material failure to follow the agreed procedures) be final and binding on the Parties; the Expert shall decide the procedure to be followed in the determination and shall be requested to make his/her determination within thirty (30) Working Days of his appointment or as soon as reasonably practicable thereafter and the Parties shall assist and provide the documentation that the Expert requires for the purpose of the determination; any amount payable by one Party to another as a result of the Expert's determination shall be due and payable within twenty (20) Working Days of the Expert's determination being notified to the Parties; the process shall be conducted in private and shall be confidential; and the Expert shall determine how and by whom the costs of the determination, including his/her fees and expenses, are to be paid.

  • Final Determination His/her determination is final unless, within ten (10) days after notification, a recognized employee organization requests in writing to meet and confer thereon.
