Installed Base. Your installed base (Software licenses available under the MLA Program which You purchased outside the MLA Program) must be transitioned into the MLA Program (be licensed under this Agreement at the product’s most current version and receive Maintenance) through the purchase of Maintenance for the licenses, unless expressly allowed otherwise by Licensor. You will pay Maintenance fees for products so transitioned for as long as this Agreement remains in effect. To transition licenses that are not at the current product version, You must upgrade, at the discounted Upgrade price, the licenses to the current version.
Installed Base. You must purchase SUSE Subscriptions for all Your installations of the SUSE Software for the full duration of the Agreement. This includes SUSE products You previously acquired outside Your current VLA agreement. To receive Subscription services for installations that are not at the current product version, You must upgrade them by purchasing a Subscription for the same quantity of new installations for the current supported version. Each copy must be installed on a machine corresponding to the part number describing such product offering (e.g., Customer cannot apply Subscription benefits received pursuant to a particular subscription offering, such as SLES for X-86, to a different platform for which the offering does not apply, such as SLES for zSeries). Any unauthorized use of the Subscription services will be treated as a material breach of this Agreement. If You wish to increase the number of installations of the Software product, You must purchase the SUSE VLA version 1.0, 2019-02-01 1 of 5 required Software Subscriptions from a Reseller for each additional installation. Upon renewal, Your submission of a purchase order or payment of Subscription fees will be deemed a representation of the number of installations of the Software receiving Subscription benefits.
Installed Base. Axcelis represents that to the best of its knowledge, Axcelis has provided the Licensee with a complete and accurate list of the owner and location of all Products operating in the field.

To include under Maintenance licenses that are not at the current product version, You must upgrade them by purchasing the same quantity of new licenses or, if offered by Micro Focus, upgrade licenses, for the current version. Each copy must be installed on a machine corresponding to the Maintenance sku or part number describing such product or Maintenance offering (e.g., Open Enterprise Server Standard Maintenance cannot be mixed with Open Enterprise Server Priority Maintenance, nor can Customer apply Maintenance benefits received pursuant to a particular subscription offering, such as SLES for X-86, to a different platform for which the offering does not apply, such as SLES for zSeries). Any unauthorized use of Maintenance will be treated as a material breach of this Agreement.
