Common use of Job Selection Clause in Contracts

Job Selection. ‌ Where a job vacancy exists within the Company, the position shall be filled in accordance with the following procedures: (a) The vacancy shall be filled on the basis of the applicant's qualifications, skill, ability, experience, competence and efficiency as required in the specifications set out in the job posting for the vacant position; (b) Where two (2) or more employee applicants have qualifications, skill, ability, experience, competence and efficiency which are relatively equal, the applicant with the greater seniority will be awarded the position; (c) Where there are no successful internal applicants, the Employer may fill the position in whatever way it so chooses; (d) Nothing herein shall restrict the Employer's right to advertise externally for the position at the same time that it is posted.
