Common use of Job Selection Clause in Contracts

Job Selection. In filling vacancies the Business Unit shall consider the following two factors in determining which employees are to be selected: (a) seniority ranking of the employees, and (b) the ability, knowledge, training and skill of the employee to do the job. When in the judgement of the Business Unit, which shall not be exercised in an unfair and unreasonable manner, factor (b) is to all intents and purposes equal as between two or more employees their seniority ranking shall govern except as hereinafter provided. Tests used in the job posting procedure will be relevant to the normal requirements of the job.
