Requests for transfer shall become active upon receipt and must be renewed during the month of January of each year to remain so. Employees shall be selected for positions under either Article or on the basis of their ability, experience and qualifications. Where these factors are relatively equal amongst the employees considered, seniority shall govern providing the successful applicant, if any, is qualified to perform the available work. The name of the successful applicant will be posted on the bulletin board and unsuccessful applicants be notified. Where there are no successful applicants from within this bargaining unit for positions referred to in Article and employees in other service bargaining units at the Employer will be considered for such positions prior to considering persons not employed by the Employer. The employees eligible for consideration shall be limited to those employees who have applied for the position in accordance with Article and and selection shall be made in accordance with Article above. Vacancies which are not to exceed three (3) months will not be posted and may be filled at the discretion of the Employer. In filling such vacancies consideration shall be given to part-time employees in service bargaining units who have recorded their interest in accordance with above prior to considering persons not employed by the Employer. Part-time' employees selected fill a vacancy under this Article will continue to maintain their part-time status and upon completion of the assignment the employee will return to his former position. The Employer shall have the right to fill any vacancy on an interim basis until the posting or the Request for Transfer procedure provided herein has been complied with, and arrangements have been made to assign the employee to fill the vacancy on the job. No grievance may be concerning such temporary arrangements. The successful applicant will be placed in the vacancy for a trial period not exceeding forty-five (45) working days and if the employee proves satisfactory, then he be considered permanently assigned to the vacancy. If the employee proves unsatisfactory during that time, or if the employee feels he is unable to perform the duties of the vacancy to which he is posted, the employee will be returned to his former position at his former salary or rate of pay, as will any other employee in the Bargaining Unit who was promoted or transferred by reason of such placing. Newly hired employees shall be and such termination shall not be subject to the grievance and arbitration procedure. Where a All vacancies of permanent vacancy occurs in a classification jobs, and new positions within Unit with the bargaining unitexception of Class i Employees, or a new position within..the bargaining unit is established by the Employer, or a temporary vacancy which is expected to exceed three (3) months in duration occurs within the bargaining unit, such vacancy shall be posted by in the Employer location for of (5) consecutiveworking days to all employees who are an opportunity to for such vacancies or positions. An employee who be absent due to vacation, leave of absence or certified illness, not exceeding thirty (30)calendar days may record, prior to his absence, his desire to be considered on a providedin the Personnel Department.All such applications shall be in writing and addressed to the Personnel Department. The Company reserves the right to temporarily fill the or new position for thirty (30)working days from the closing of the posting, pending permanent appointment. For the purposeof this Agreement, a successfulapplicant shall mean any employee who eligible for a if, at any time within a trial period of five days excluding Saturday, Sunday, and holidays. The posting shall stipulate the qualifications, classification, rate of pay, department and shift and a copy shall be provided to the Chief Xxxxxxx. All applications are to be made in writing within the posting period. A vacancy created by the filling of an initial permanent vacancy will be posted for a period of three fifteen (315) consecutive working days, excluding Saturday, Sunday and Holidays. Such posting shall stipulate the same information as is set out above, and all applications are to be made in writing within the posting period. Vacancies created by the filling of a posted vacancy under Article need not be posted, however consideration for such subsequent vacancies will be given to employees in this bargaining unit who have a request for transfer on file. Such requests will be considered as applications for posted vacancies as well as subsequent vacancies. The maximum number of positions to which an employee may request a transfer at any one time is four (4). Requests for transfer shall become active upon receipt and must be renewed during the month of January of each year to remain so. Employees shall be selected for positions under either Article or on the basis of their ability, experience and qualifications. Where these factors are relatively equal amongst the employees considered, seniority shall govern providing the successful applicant, if any, is qualified to perform the available work. The name of the successful applicant will be posted on the bulletin board and unsuccessful applicants be notified. Where there are no successful applicants from within this bargaining unit for positions referred to in Article and employees in other service bargaining units at the Employer will be considered for such positions prior to considering persons not employed by the Employer. The employees eligible for consideration shall be limited to those employees who have applied for the position in accordance with Article and and selection shall be made in accordance with Article above. Vacancies which are not to exceed three (3) months will not be posted and may be filled at the discretion of the Employer. In filling such vacancies consideration shall be given to part-time employees in service bargaining units who have recorded their interest in accordance with above prior to considering persons not employed by the Employer. In considering such part-time employees the for selection in shall apply. Part-time' employees selected fill a vacancy under this Article will continue to maintain their part-time status and upon completion of the assignment the employee will return to his former position. The Employer shall have the right to fill any vacancy on an interim basis until the posting or the Request for Transfer procedure provided herein has been complied with, and arrangements have been made to assign the employee to fill the vacancy on the job. No grievance may be concerning such temporary arrangements. The successful applicant will be placed in the vacancy for a trial period not exceeding forty-five (45) working days and if the employee proves satisfactoryunsatisfactory, then he be considered permanently assigned to the vacancy. If the employee proves unsatisfactory during that time, or if the employee feels he is unable to perform the duties of the vacancy to which he is posted, the employee will shall be returned to his former position at his former salary or rate of payposition, as will any other employee in and a second successful applicant shall be selected the Bargaining Unit who was promoted or transferred by reason of such placingoriginal applicants. Newly hired The trial period for Maintenance employees shall be and such termination thirty (30) consecutive working days. All employees new to the mine shall not be subject to the grievance and arbitration procedurea working days orientation period prior to commencingthe working days trial period mentioned above. If the applicant for a posting is not placed for the convenience of the Company in the new position by the sixteenth (16th) day after receivingsaid position, the employee will receive the rate of pay for the new position or the rate of pay for his original position, is greater. If the applicant desires to revert to his former position he must do so within five (5) working days of starting his trial period on the actual posted job. If a successful applicant does not complete is refused the job extension of the trial period as set out in Article is required, a letter to this effect will be sent to the position Union by the Company within three (3) working days of said refusal or extension. Temporary vacancies will be posted immediately if it is known that the vacancy will exist for more than thirty (30)working days.
