Joint Health and Safety Committee. (a) The Employer and the Union agree that they mutually desire to maintain standards of occupational health and safety in the organization, in order to prevent accidents, injury and illness. The parties agree to promote health and safety throughout the organization. The employer shall provide orientation and training in health and safety to new and current employees on an ongoing basis, and employees shall attend required health and safety training sessions. (b) Recognizing its responsibilities under the applicable legislation, the Employer agrees to accept as a member of its Joint Health and Safety Committee, at least one representative from the bargaining unit. (d) The Employer agrees to cooperate reasonably in providing necessary information to enable the Committee to fulfill its functions. The Committee shall respect the confidentiality of the information. (e) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices. (f) Meetings shall be held every third month or more frequently at the call of either co-chair, if required. The Committee shall keep Minutes of all meetings and make the Minutes available for review. (g) All time spent by a member of the Joint Health and Safety Committee attending meetings of the Committee and carrying out the members duties, shall be deemed to be time worked for which the member shall be paid by the Employer at the member's applicable rate of pay, and the member shall be entitled to such time from the member's work as necessary for those duties. (f) Meetings shall be held every third month or more frequently at the call of either co-chair, if required. Joint Health and Safety Committee. (a) A single Joint Health and Safety Committee shall be established per Home (consolidated amongst all employees and Unions within the Home) which is composed of an equal number of Employee and Employer representatives, but with a minimum of one (1) representative selected or appointed by the Association from amongst bargaining unit employees. One (1) representative on the Committee will be trained as a certified worker as defined under the Occupational Health and Safety Act. Hospitals will choose either to include a representative from the bargaining unit. The number of committee members will be no less than that determined by legislation unit from each Hospital site, or to have a separate Joint Health and Safety Committee at each Hospital site, unless the bargaining unit will be entitled to the same membership as any other employee group on the committees. The Union shall notify the employer of their representativesparties agree otherwise. (cii) Such Committee shall identify potential dangers and hazards, ; institute means of improving health and safety programs, programs and recommend actions to be taken to improve conditions related to occupational health safety and safetyhealth. (diii) The Employer Hospital agrees to cooperate reasonably in providing necessary information and management support to enable the Committee to fulfill fulfil its functions. In addition, the Hospital will provide the Committee with access to the Hospital’s pandemic plan and related risk assessment, all accident reports, health and safety records, notifications of exposure to an infectious or contagious disease, and any other pertinent information in its possession. The Hospital will also provide the Committee with reports on fit testing compliance annually and personal protective equipment inventory on a quarterly basis. The Committee shall respect the confidentiality of the information. (e) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices. (fiv) Meetings shall be held every third second month or more frequently at the call of either the co-chairChairs, if required. The Committee shall keep Minutes maintain minutes of all meetings and make the Minutes same available for review. (g) All . Copies shall be sent to the Committee members within a reasonable period of time spent by a member of following the meeting. The Joint Health and Safety Committee attending will determine the appropriate mechanism to communicate the minutes of the proceedings of the Committee to the organization. v) Any representative appointed or selected in accordance with (e) (i) hereof, shall serve for a term of at least two (2) calendar years from the date of appointment. Time off for representatives to perform these duties shall be granted. “A member of a committee is entitled to, A) One hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting. B) Such time as is necessary to attend meetings of the Committee committee. Accordingly, the parties fully endorse the responsibilities of employer and employee under the Occupational Health and Safety Act. The Employer shall take every precaution reasonable in the circumstances for the protection of a worker. (b) Recognizing its responsibilities under the applicable legislation, the Employer agrees to accept as a member of its Joint Health and Safety Committee, at least one (1) representative selected or appointed by the Union from the bargaining unitamongst Bargaining Unit employees. The number of committee members will be no less than that determined by legislation employee shall comply with the Occupational Health and the bargaining unit will be entitled to the same membership as any other employee group on the committees. In addition, the Employer will provide the Committee with access to all accident reports, health and safety records and any other pertinent information in its possession. (e) Meetings shall be held every third month or more frequently at the call of the Chair, if required. The Committee shall respect maintain minutes of all meetings and make the confidentiality of the informationsame available for review. (ef) Any representative appointed or selected in accordance with (b) hereof, shall serve for a term of at least (1) calendar year from the date of appointment. Time off for such representative to attend meetings of the Joint Health and Safety Committee in accordance with the foregoing, shall be granted and any representative attending such meetings during their regularly scheduled hours of work, shall not lose regular earnings as a result of such attendance. (g) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices. (f) Meetings shall be held every third month or more frequently at the call of either co-chair, if required. The Committee shall keep Minutes of all meetings and make the Minutes available for review. (gh) All time spent by a member of the Joint Health and Safety Committee attending meetings of the Committee and carrying out the members her duties, shall be deemed to be work time worked for which the member she shall be paid by the Employer at the member's applicable her regular rate of pay, and the member she shall be entitled to such time from the member's work as is necessary for those dutiesto attend scheduled meetings. (hi) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s physician the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the current contractual maternity leave. (j) Where the Employer identifies high risk areas where nurses are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the nurses. (k) The employer shall take every precaution reasonable parties will determine appropriate solutions to promote health and safety in workplaces, including, but not limited to: • Violence in the circumstances for Workplace (include Verbal Abuse) • Musculoskeletal Injury Prevention • Needle Stick and other sharps injury Prevention • Personal Protective Equipment • Nurses who regularly work alone or who are isolated in the protection of a worker. The Joint Health and Safety Committee will determine the appropriate mechanism to communicate the minutes of the proceedings of the Committee to the organization. (gf) All time spent by Any representative appointed or selected in accordance with 9.07 (a) hereof, shall serve for a member term of at least one (1) calendar year from the date of appointment. Time off for such representative(s) to attend meetings of the Joint Health and Safety Committee attending in accordance with the foregoing, shall be granted. (g) A member of a committee is entitled to: i) one (1) hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting; ii) such time as is necessary to attend meetings of the Committee committee; and iii) such time as is necessary to carry out inspections and carrying out investigations contemplated under subsection 9(26), 9(27) and 9(31) of the members duties, Occupational Health and Safety Act. A member of a committee shall be deemed to be time worked for which at work during the times described above and the member’s employer shall pay the member shall be paid by the Employer for those times at the member's applicable ’s regular or premium rate of pay, and the member shall as may be entitled to such time from the member's work as necessary for those dutiesproper. (h) The employer shall take every precaution reasonable Employer will ensure that there is one (1) ONA Paramedical member certified, as described in the circumstances for the protection of a worker. [Occupational Health and Safety Act, s. 25among the ONA Paramedical bargaining unit(s) at the Employer. Such member on the committee will be selected or appointed by the Union. All issues relating to salary and costs associated with obtaining certification shall be in accordance with Article 16.06. (i) The parties agree that the following items are appropriate for discussion at committee meetings: • proposed changes to diagnostic or medical machines and equipment that will impact the health and safety of employees; • the nature, content and duration of health and safety training programs for employees; • the use of personal protective equipment by employees. The committee may, in addition to the above, discuss other items relating to the health and safety of employees. (j) At committee meetings the Employer shall provide the committee with a summary of all lost time claims, health care claims, occupational disease claims, reports on accidents and critical or fatal injuries. In addition, all relevant government directives and orders shall be provided to the committee. The committee shall review this information and propose methods of reducing the number of injuries or accidents. (k) The committee shall participate in all inquiries and investigations pursuant to the Occupational Health and Safety Act. The co-chairs* will determine the appropriate member or members who will participate in the investigation. If neither co-chair is available, the most appropriate committee member will be designated to participate in the investigation. In determining the appropriate member or members who will participate in the investigation, the parties recognize the interests of an ONA Paramedical representative being involved in an investigation that involves an ONA Paramedical bargaining unit member. *NOTE: If there is only one co-chair available, she will determine who will participate in the investigation.

The Union shall notify the employer of their representatives. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs, and recommend actions to be taken to improve conditions related to occupational health and safety. (d) The Employer agrees to cooperate reasonably in providing necessary information to enable the Committee to fulfill its functions. The Committee shall respect the confidentiality of the information. If no member is available to act as the ONA JHSC member, then JHSC information will be provided to the ONA bargaining unit president (BUP), or if no BUP is available, then such information will be provided to the Labour Relations Officer (LRO). (e) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices. (f) Meetings shall be held every third month or more frequently at the call of either co-chair, if required. The Committee shall keep Minutes of all meetings and make the Minutes available for review. (g) All time spent by a member of the Joint Health and Safety Committee attending meetings of the Committee and carrying out the members duties, shall be deemed to be time worked for which the member shall be paid by the Employer at the member's applicable rate of pay, and the member shall be entitled to such time from the member's work as necessary for those duties. (i) The Employer will ensure adequate stocks of the N95 respirator (or such other personal protective equipment as the parties may in writing agree) to be made available to employees who are patient facing at short notice in the event there are reasonable indications of the emergence of a pandemic or provide an alternate safety measure as determined by the JHSC. The Employer will advise the JHSC of the supply of PPE on an annual basis and whenever the Employer is required to advise the government. (j) When faced with occupational health and safety decisions, s. 25the Employer will not await full scientific or absolute certainty before taking reasonable action(s) including but not limit to providing reasonable accessible personal protective equipment (PPE) that reduces risk and protects employees. (k) Employees will be fit tested on hire and then every two (2) years or at any other time as required by the Employer, the government of Ontario or any other public health authority. (l) The Employer will maintain a pandemic plan, inclusive of an organizational risk assessment, that will be shared annually with the JHSC. (m) The Employer will train certified workers in accordance with Section

Joint Health and Safety Committee. (a) The Employer and the Union agree that they mutually desire to maintain standards of occupational health and safety in the organization, in order to prevent accidents, injury and illness. The employer shall provide orientation and training in health and safety to new and current employees on an ongoing basis, and employees shall attend required health and safety training sessions. (b) Recognizing its responsibilities under the applicable legislation, the Employer agrees to accept as a member of its a. A Joint Health and Safety Committee shall be established which is composed of a minimum of two Union members chosen by the Union. At no time shall the number of Employer members be allowed to outnumber the amount of Union members and vice versa. b. Two Co-Chairpersons shall be elected by, and from, the members of the Committee. One Co-Chair shall be a Union member, the other shall be an Employer member. c. Without limiting the generality of the foregoing, the Committee shall: i. Determine that inspections have been carried out, at least one representative once a month, by the Co-Chairs or designates. These inspections shall be made of all places of employment, including buildings, structures, grounds, excavations, tools, equipment, machinery and work methods and practices including ergonomic assessments. ii. Recommend measures required to attain compliance with appropriate government regulations and the correction of hazardous conditions. iii. Consider recommendations from the bargaining unit. The number of committee members will be no less than that determined by legislation and the bargaining unit will be entitled workforce with respect to the same membership as any other employee group on the committees. The Union shall notify the employer of their representatives. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programsmatters and recommend implementation where warranted. iv. Hold meetings at least bi-monthly for the review of reports of current accidents, occupational diseases and sprains and strains injuries, their causes and means of prevention; remedial action taken or required by the reports of investigations or inspections, and recommend actions any other matters pertaining to be taken to improve conditions related to occupational health and safety. (d) The Employer agrees v. Record the minutes of the meetings which shall be signed by the co-chairs, distributed to cooperate reasonably in providing necessary information to enable the Committee members, posted on the bulletin boards. vi. Have access to fulfill its functionsand promptly receive copies of all reports, records and documents in the Employer's possession or obtainable by the Employer pertaining to health or safety. vii. Time spent by members of the Committee in the course of their duties shall be considered as time worked and shall be paid in accordance with the terms of this Agreement. viii. The Committee shall respect the confidentiality of the information. (e) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices. (f) Meetings shall be held every third month or more frequently at the call of either co-chair, if required. The Committee shall keep Minutes of all meetings and make the Minutes available for review. (g) All time spent by a member of the Joint Health and Safety Committee attending meetings of shall meet without Employer representatives for at least one half (1/2) hour or as per the OHSA, whichever is greater, prior to the Committee and carrying out the members duties, shall be deemed to be time worked for which the member shall be paid by the Employer at the member's applicable rate of pay, and the member shall be entitled to such time from the member's work as necessary for those dutiesmeeting. Employers will choose either to include a representative from the bargaining unit. The number of committee members will be no less than that determined by legislation unit from each Employer site, or to have a separate Joint Health and Safety Committee at each Employer site, unless the bargaining unit will be entitled to the same membership as any other employee group on the committees. The Union shall notify the employer of their representativesparties agree otherwise. (cii) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs, programs and recommend actions to be taken to improve conditions related to occupational health safety and safetyhealth. (diii) The Employer agrees to cooperate reasonably in providing necessary information and management support to enable the Committee to fulfill fulfil its functions. In addition, the Employer will provide the Committee with access to the Employer’s pandemic plan and related risk assessment, all accident reports, health and safety records, notifications of exposure to an infectious or contagious disease, and any other pertinent information in its possession. The Employer will also provide the Committee with reports on fit testing compliance annually and personal protective equipment inventory on a quarterly basis. The committee shall respect the confidentiality of the information. (e) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices. (fiv) Meetings shall be held every third second month or more frequently at the call of either the co-chairChairs, if required. The Committee shall keep Minutes maintain minutes of all meetings and make the Minutes same available for review. (g) All time spent by a member of the . (A) one hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting; (B) such time as is necessary to attend meetings of the Committee and carrying out the members duties, shall be deemed to be time worked for which the member shall be paid by the Employer at the member's applicable rate of pay, and the member shall be entitled to committee; (C) such time from as is necessary to carry out [inspections and investigations under subsection 9(26), 9(27) and 9(31) of the member's work as necessary for those dutiesAct.] ref: Occupational Health and Safety Act. Sec 9(34). (hD) The employer shall take every precaution reasonable in where an investigation is required under the circumstances for the protection of a worker. The number of committee members will be no less than that determined by legislation unit from each Employer site, or to have a separate Joint Health and Safety Committee at each Employer site, unless the bargaining unit will be entitled to the same membership as any other employee group on the committees. The Union shall notify the employer of their representativesparties agree otherwise. (cii) Such Committee shall identify potential dangers and hazards, ; institute means of improving health and safety programs, programs and recommend actions to be taken to improve conditions related to occupational health safety and safetyhealth. (diii) The Employer agrees to cooperate reasonably in providing necessary information and management support to enable the Committee to fulfill fulfil its functions. In addition, the Employer will provide the Committee with access to all accident reports, health and safety records and any other pertinent information in its possession. The Committee shall respect the confidentiality of the information. (e) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices. (fiv) Meetings shall be held every third second month or more frequently at the call of either the co-chairChairs, if required. The Committee shall keep Minutes maintain minutes of all meetings and make the Minutes same available for review. (g) All . Copies shall be sent to the Committee members within a reasonable period of time spent by a member of following the meeting. The Joint Health and Safety Committee attending meetings will determine the appropriate mechanism to communicate the minutes of the proceedings of the Committee and carrying out to the members dutiesorganization. v) Any representative appointed or selected in accordance with (e) (i) hereof, shall be deemed serve for a term of at least two (2) calendar years from the date of appointment. Time off for representatives to be time worked for which the member perform these duties shall be paid by the Employer at the member's applicable rate of pay, and the granted. A member shall be entitled to such time from the member's work as necessary for those duties. (h) The employer shall take every precaution reasonable in the circumstances for the protection of a worker. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs, and recommend actions to be taken to improve conditions related to occupational health and safety. (d) The Employer agrees to cooperate reasonably in providing necessary information to enable the Committee to fulfill fulfil its functions. The Committee shall respect the confidentiality of the information. If no member is available to act as the Nurse Practitioner ONA JHSC member, the JHSC information will be provided to the NP ONA bargaining unit president (BUP), or if no NP BUP is available, then such information will be provided to the Labour Relations Officer (LRO). (e) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices. (f) Meetings shall be held every third month or more frequently at the call of either co-chair, if required. The Committee shall keep Minutes of all meetings and make the Minutes available for review. (g) All time spent by a member of the Joint Health and Safety Committee attending meetings of the Committee and carrying out the members duties, shall be deemed to be time worked for which the member shall be paid by the Employer at the member's ’s applicable rate of pay, and the member shall be entitled to such time from the member's ’s work as necessary for those duties. (b) Recognizing its responsibilities under All incidents involving violence shall be brought to the applicable legislation, attention of the Employer agrees to accept as a member of its Joint Health and Safety Committee, at least one representative from the bargaining unit. The number of committee members Employer agrees that the Joint Health and Safety Committee shall concern itself with all matters relating to violence to employees including but not limited to, policy and/or training recommendations, which will be no less than that determined by legislation and the bargaining unit will be entitled forwarded to the same membership as any other employee group on the committees. The Union shall notify the employer of their representativesEmployer. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs, and recommend actions to be taken to improve conditions related to occupational health and safety. (d) The Employer agrees to cooperate reasonably in providing necessary information and management support to enable the Committee to fulfill fulfil its functions. In addition, the Employer will provide the Committee with all accident reports, health and safety records and any other pertinent information in its possession. The Committee shall respect the confidentiality of the information. d) In workplaces with fewer than twenty (20) employees, the Union shall select at least one (1) bargaining unit member to act as Health and Safety Representative (HSR). The Health and Safety Representative shall have all the powers and responsibilities entitled to a Health and Safety Representative as stipulated under the Act. e) The Union agrees In addition, all employees shall have the power to: (i) identify situations that may be a source of danger or hazard to endeavour employees; (ii) make recommendations to obtain the full cooperation employer and the workers for the improvement of its membership in the observation health and safety of all employees; and (iii) recommend to the employer and the workers the establishment, maintenance and monitoring of programs, measures and procedures respecting the health or safety rules and practicesof employees. (f) Meetings shall be held every third month or more frequently It is agreed that at the call of either co-chair, if required. The Committee shall keep Minutes of all meetings and make the Minutes available for review. least three (g3) All time spent by a member members of the Joint Health and Safety Committee attending shall be trained and maintain certification. Committee members shall also undertake all training which the JHSC deems appropriate to protect workers. Such training will be provided on the Employer’s time and expense, and will be considered as time worked with no loss of wages. g) A member of a committee, or Health and Safety Representative where no committee exists, is entitled to: (i) one hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting; (ii) such time as is necessary to attend meetings of the Committee and carrying committee; and (iii) such time as is necessary to carry out the members member’s duties, h) A member of a committee shall be deemed to be time worked for which at work during the times described in (g) and the member’s employer shall pay the member shall be paid by the Employer for those times at the member's applicable ’s regular, premium rate of paypay or time in lieu, and in accordance with the member shall be entitled to such time from the member's work as necessary for those dutiescollective agreement. (hi) While recognizing the Employer's legal responsibility to ensure that service needs are met, the Employer recognizes that the safety of its employees is of primary importance. The employer Employer shall take every precaution reasonable in consult with the circumstances for the protection of a worker. [Occupational Joint Health and Safety Act, s. 25Committee/Health and Safety Representative(s) in developing and establishing effective measures and procedures for the Health and Safety of workers in order to reduce the potential for violence in the workplace

That committee shall be comprised of at least one representative three (3) representatives from the bargaining unitUnion and three (3) representatives from the employer. The number of committee members will Union representatives to the Joint Health and Safety Committee shall be no less than that determined by legislation and the bargaining unit members selected by the local union membership. b) The committee will identify situations that may be entitled a source of danger or hazard to workers and make recommendations to the same membership as any other employee group on Employer and workers for the committees. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety of workers. c) The committee will make recommendations to the Employer and the workers regarding the establishment, maintenance and monitoring of programs, training, measures and recommend actions to be taken to improve conditions related to occupational procedures respecting the health and safetysafety of workers. (d) The Employer agrees In all work locations the Union shall select one (1) bargaining unit member to cooperate reasonably in providing necessary information to enable the Committee to fulfill its functionsact as health and safety representative. The health and safety representative shall have all the powers and responsibilities entitled to a Joint Health and Safety Committee shall respect as stipulated under the confidentiality of the informationAct. (e) The Union agrees to endeavour to obtain It is agreed that the full cooperation of its membership in the observation of all safety rules and practices. (f) Meetings shall be held every third month or more frequently at the call of either coCo-chair, if required. Joint Health and Safety Committee. (a) The Employer Facility and the Union Association agree that they mutually desire to maintain standards of occupational safety and health and safety in the organization, Facility in order to prevent accidents, injury and illness. The parties agree to promote health and safety throughout the organization. The employer shall provide orientation and training in health and safety to new and current employees on an ongoing basis, and employees shall attend required health and safety training sessions. (b) Recognizing its responsibilities The Association shall have one (1) representative chosen from those City of Greater Sudbury nurses covered under the applicable legislation, O.N.A. Agreement on the Employer agrees to accept as a member of its Joint Occupational Health and Safety CommitteeCommittee established under the Occupational Health and Safety Act, 1978, and as amended from time to time, at least one representative from the bargaining unit. The number of committee members will be no less than that determined by legislation and the bargaining unit will be entitled to the same membership as any other employee group on the committees. The Union shall notify the employer of their representativesPioneer Manor Long Term Care Facility. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs, programmes and recommend actions to be taken to improve conditions related to occupational health safety and safetyhealth. (d) The Employer agrees to cooperate reasonably in providing necessary information to enable the Committee to fulfill fulfil its functions. The Committee shall respect the confidentiality of the information. (e) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices. (f) Meetings shall be held every third second month or more frequently at the call of either co-chairthe Chair, if required. The Committee shall keep Minutes maintain minutes of all meetings and make the Minutes same available for review. (f) Any representative appointed or selected in accordance with (b) hereof, shall serve for a term of at least one (1) calendar year from the date of appointment. Time off for such representative(s) to attend meetings of the Joint Health and Safety Committee in accordance with the foregoing, shall be granted and any representative(s) attending such meetings during their regularly scheduled hours of work, shall not lose regular earnings as a result of such attendance. (g) The Association agrees to fully co-operate in having the membership observe all safety rules, policies, procedures and practices. (h) All time spent by a member of the Joint Health and Safety Committee attending meetings of the Committee and carrying out the members duties, shall be deemed to be work time worked for which the member members shall be paid by the Employer Facility at the member's applicable regular rate of pay, and the member shall be entitled to such time off from the member's work as is necessary for those dutiesto attend scheduled meetings. (hi) No nurse shall be disciplined for acting in compliance with the applicable Acts, Regulations and Health and Safety Manual, or for seeking enforcement of the provisions of the Acts, Regulations and Health and Safety Manual. (j) All injuries resulting from on-the-job accidents, however small, shall be reported to their immediate Supervisor. This report must be made as soon as possible after the injury. The employer immediate Supervisor will investigate and report to the Health, Safety and WSIB Claims Co-ordinator, or his or her designate, who will report all injuries to the Joint Safety and Health Committee at its next meeting, on the nature and cause of the accident. (k) All nurses shall take every precaution reasonable in report unsafe acts or unsafe conditions to their immediate Supervisor as per the circumstances for the protection duties of a worker. The parties agree to promote health and safety throughout the organization. The employer shall provide orientation and training in health and safety to new and current employees on an ongoing basis, and employees shall attend required health and safety training sessions. (bi) Recognizing its responsibilities under the applicable legislation, the Employer agrees to accept as a member of its Joint Health and Safety Committee, at least one (1) representative selected or appointed by the Union from amongst bargaining unit employees from each Employer site. Employers will choose either to include a representative from the bargaining unit. The number of committee members will be no less than that determined by legislation unit from each Employer site, or to have a separate Joint Health and Safety Committee at each Employer site, unless the bargaining unit will be entitled to the same membership as any other employee group on the committees. The Union shall notify the employer of their representativesparties agree otherwise. (cii) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs, programs and recommend actions to be taken to improve conditions related to occupational health safety and safetyhealth. (diii) The Employer agrees to cooperate reasonably in providing necessary information and management support to enable the Committee to fulfill fulfil its functions. In addition, the Employer will provide the Committee with access to the Employer’s pandemic plan and related risk assessment, all accident reports, health and safety records, notifications of exposure to an infectious or contagious disease, and any other pertinent information in its possession. The Employer will also provide the Committee with reports on fit testing compliance annually and personal protective equipment inventory on a quarterly basis. The committee shall respect the confidentiality of the information. (e) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices. (fiv) Meetings shall be held every third second month or more frequently at the call of either the co-chairChairs, if required. The Committee shall keep Minutes maintain minutes of all meetings and make the Minutes same available for review. (g) All time spent by a member of the . The Joint Health and Safety Committee attending committee will determine the appropriate mechanism to communicate the minutes of the proceedings of the committee to the organization. v) Any representative appointed or selected in accordance with (d) (i) hereof, shall serve for a term of at least two (2) calendar years from the date of appointment. Time off for representatives to perform these duties shall be granted. A member of a committee is entitled to, (A) one hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting; (B) such time as is necessary to attend meetings of the Committee and carrying out the members duties, shall be deemed to be time worked for which the member shall be paid by the Employer at the member's applicable rate of pay, and the member shall be entitled to committee; (C) such time from as is necessary to carry out [inspections and investigations under subsection 9(26), 9(27) and 9(31) of the member's work as necessary for those dutiesAct.] ref: Occupational Health and Safety Act. Sec 9(34). (hD) The employer shall take every precaution reasonable in where an investigation is required under the circumstances for the protection of a worker. [Occupational Health and Safety Act, s. 25the Committee shall determine the appropriate member or members who will participate in the investigation, recognizing interests of an Union representative to be involved in an investigation involving Union members; and

(c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs, and recommend actions to be taken to improve conditions related to occupational health and safety. (d) The Employer agrees to cooperate reasonably in providing necessary information and management support to enable the Committee to fulfill fulfil its functions. In addition, the Employer will provide the Committee with all accident reports, health and safety records and any other pertinent information in its possession. The Committee shall respect the confidentiality of the information. d) In workplaces with fewer than twenty (20) employees, the Union shall select at least one (1) bargaining unit member to act as Health and Safety Representative (HSR). The Health and Safety Representative shall have all the powers and responsibilities entitled to a Health and Safety Representative as stipulated under the Act. e) The Union agrees In addition, all employees shall have the power to: (i) identify situations that may be a source of danger or hazard to endeavour employees; (ii) make recommendations to obtain the full cooperation employer and the workers for the improvement of its membership in the observation health and safety of all employees; and (iii) recommend to the employer and the workers the establishment, maintenance and monitoring of programs, measures and procedures respecting the health or safety rules and practicesof employees. (f) Meetings shall be held every third month or more frequently It is agreed that at the call of either co-chair, if required. The Committee shall keep Minutes of all meetings and make the Minutes available for review. least three (g3) All time spent by a member members of the Joint Health and Safety Committee attending shall be trained and maintain certification. Committee members shall also undertake all training which the JHSC deems appropriate to protect workers. Such training will be provided on the Employer’s time and expense, and will be considered as time worked with no loss of wages. g) A member of a committee, or Health and Safety Representative where no committee exists, is entitled to: (i) one hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting; (ii) such time as is necessary to attend meetings of the Committee and carrying committee; and (iii) such time as is necessary to carry out the members member’s duties, h) A member of a committee shall be deemed to be time worked for which at work during the times described in (g) and the member’s employer shall pay the member shall be paid by the Employer for those times at the member's applicable ’s regular, premium rate of paypay or time in lieu, and in accordance with the member shall be entitled to such time from the member's work as necessary for those dutiescollective agreement. NOTE: Where there are multiple sites, the Local Parties are referred to the same membership as any other employee group on the committees. (c) It is understood that consultation on issues of mutual concern will occur between the Joint Health and Safety Committee and Infection Control. (d) The Employer Hospital agrees to cooperate reasonably co-operate in providing necessary information to enable the Committee to fulfill fulfil its functions. The Committee shall respect the confidentiality of the information. (e) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices. (f) Meetings shall be held every third second month or more frequently at the call of either a co-chair, if requiredwhen requested. The Committee shall keep Minutes maintain minutes of all meetings and make the Minutes same available for review. (gf) All time spent by Any representative appointed or selected in accordance with 7.07 (a) hereof, shall serve for a member term of at least one (1) calendar year from the date of appointment. Time off for such representative(s) to attend meetings of the Joint Health and Safety Committee attending committee in accordance with the foregoing, shall be granted. A member of a committee is entitled to: i) one (1) hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting; ii) such time as is necessary to attend meetings of the Committee committee; and iii) such time as is necessary to carry out inspections and carrying out investigations contemplated under subsection 9(26), 9(27), and 9(31) of the members duties, Occupational Health and Safety Act R.S.O. 1990 as amended up to and including 1998. A member of a committee shall be deemed to be time worked for which at work during the times described above and the member’s employer shall pay the member shall be paid by the Employer for those times at the member's applicable ’s regular or premium rate of pay, and the member shall as may be entitled to such time from the member's work as necessary for those dutiesproper. (b) Recognizing its responsibilities under The Employer and Union recognizes that they will comply with the applicable legislation, the Employer agrees to accept as a member of its Joint Occupational Health and Safety Committee, at least one representative from Act concerning the bargaining unit. The number selection or appointment of committee members will be no less than that determined by legislation Occupational Health and the bargaining unit will be entitled to the same membership as any other employee group on the Safety representatives and/or committees. The Union shall notify the employer of their representatives. (c) Such Committee Health and Safety representatives and/or committees shall identify potential dangers and hazards, institute means of improving health and safety programs, programs and recommend actions to be taken to improve conditions related to occupational health safety and safetyhealth. (dc) The Employer agrees to cooperate co-operate reasonably in providing necessary information to enable the Committee Health and Safety representatives and/or committees to fulfill its their functions. The Committee shall respect the confidentiality . (d) Health and safety issues arising at one or more of the informationwork locations, which are of significance to the organization as a whole or to more than one work location, shall be addressed to and dealt with by the Joint Occupational Health and Safety Committee. Issues of an urgent nature will be taken up as soon as reasonably possible with Management. (e) The Union agrees to endeavour to obtain the full cooperation co-operation of its membership in the observation of all safety rules and practices. (f) Meetings In work locations with Health and Safety committees, meetings shall be held every third month three months or more frequently at the call of either co-chair, if required. The Committee committee shall keep Minutes maintain minutes of all meetings and make the Minutes same available for review. (g) All Any representative appointed or selected shall serve for a term of two (2) calendar years from the date of appointment that may be renewed for further periods of one (1) year. (h) Preparation time up to one hour and time spent by a member of at the Joint Health and Safety Committee attending meetings of the Committee and carrying out the members duties, shall be deemed to be time worked for which the member meeting shall be paid by the Employer at the member's applicable rate of pay, and the member shall be entitled to such time from the member's work as necessary for those dutiesrate. (hi) The employer shall take every precaution reasonable in Certified Member: the circumstances Employer will provide for the protection cost of a worker. In addition to the foregoing, the Employer agrees the Union may provide Certification training, at the Unions expense, to all Union Health and Safety Representatives and union members on the JHSC. g) A member of a committee, or Health and Safety Representative where no committee exists, is entitled to: (i) one hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting; (ii) such time as is necessary to attend meetings of the Committee committee; and carrying out the members duties, (iii) h) A member of a committee shall be deemed to be time worked for which at work during the member shall be paid by times described in agreement. i) met, the Employer at recognizes that the member's applicable rate safety of pay, and its employees is of primary importance.
