NOTE: Where there are multiple sites, the Local Parties are referred to Article 27 (Multi-site Language) to determine Local Applicability of Health & Safety Committee structure. 7.03 Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programmes and recommend actions to be taken to improve conditions related to safety and health. 7.04 It is understood that consultation on issues of mutual concern will occur between the Joint Health and Safety Committee and Infection Control. 7.05 The Hospital agrees to co-operate in providing necessary information to enable the Committee to fulfil its functions. 7.06 Meetings shall be held every second month or more frequently at the call of a co-chair, when requested. The Committee shall maintain minutes of all meetings and make the same available for review. 7.07 Any representative appointed or selected in accordance with 7.02 hereof, shall serve for a term of at least one (1) calendar year from the date of appointment. Time off for such representative(s) to attend meetings of the Joint Health and Safety Committee in accordance with the foregoing, shall be granted. A member of a committee is entitled to: a) one (1) hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting; b) such time as is necessary to attend meetings of the committee; and c) such time as is necessary to carry out inspections and investigations contemplated under subsection 9(26), 9(27), and 9(31) of the Occupational Health and Safety Act R.S.O. 1990 as amended up to and including 1998. A member of a committee shall be deemed to be at work during the times described above and the member’s employer shall pay the member for those times at the member’s regular or premium rate as may be proper. 7.08 The Hospital will ensure that there is one (1) OPSEU member certified, as described in the Occupational Health and Safety Act R.S.O.1990, as amended up to and including 1998 among the OPSEU bargaining unit(s) at the Hospital. Such member on the committee will be selected or appointed by the Union. All issues relating to salary and costs associated with obtaining certification shall be in accordance with article 14.06. 7.09 The parties agree that the following items are appropriate for discussion at committee meetings: • Proposed changes to diagnostic or medical machines and equipment that will impact the health and safety of employees; • The nature, content and duration of health and safety training programs for employees; • The use of personal protective equipment by employees; The committee may, in addition to the above, discuss other items relating to the health and safety of employees. 7.10 At committee meetings the Hospital shall provide the committee with a summary of all lost-time claims, health care claims, occupational disease claims, reports on accidents and critical or fatal injuries. In addition, all relevant government directives and orders shall be provided to the committee. The committee shall review this information and propose methods of reducing the number of injuries or accidents. 7.11 This section does not apply to a worker (a) when a circumstance described below is inherent in the workers’ work or is a normal condition of the worker’s employment; or (b) when the worker’s refusal to work would directly endanger the life, health or safety of another person. A worker may refuse to work or do particular work where he or she has reason to believe that, (a) any equipment, machine, device or thing the work is to use or operate is likely to endanger himself, herself, or another worker, (b) the physical condition of the workplace or the part thereof in which he or she works or is to work is likely to endanger himself or herself; or (c) any equipment, machine, device or thing he or she is to use or operate or the physical condition of the workplace or the part thereof in which he or she works or is to work is in contravention of the Occupational Health and Safety Act or the regulations and such contravention is likely to endanger himself, herself or another worker. 7.12 A worker who is required by the hospital to wear or use any protective clothing, equipment or device shall be instructed and trained in its care, use and limitations before wearing or using it for the first time and at regular intervals thereafter and the worker shall participate in such instruction and training. 7.13 The committee shall participate in all inquiries and investigations pursuant to the Occupational Health and Safety Act. The co- chairs* will determine the appropriate member or members who will participate in the investigation. If neither co-chair is available, the most appropriate committee member will be designated to participate in the investigation. In determining the appropriate member or members who will participate in the investigation, the parties recognize the interests of an OPSEU representative being involved in an investigation that involves an OPSEU bargaining unit member. *NOTE: If there is only one co-chair available, he or she will determine who will participate in the investigation. 7.14 The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices.

7.04 It is understood that consultation on issues of mutual concern will occur between the Joint Health and Safety Committee and Infection Control.
7.05 iii) The Hospital agrees to co-operate cooperate in providing necessary information and management support to enable the Committee to fulfil its functions. In addition, the Hospital will provide the Committee with access to the Hospital’s pandemic plan and related risk assessment, all accident reports, health and safety records, notifications of exposure to an infectious or contagious disease, and any other pertinent information in its possession. The Hospital will also provide the Committee with reports on fit testing compliance annually and personal protective equipment inventory on a quarterly basis. The Committee shall respect the confidentiality of the information.
7.06 iv) Meetings shall be held every second month or more frequently at the call of a the co-chairChairs, when requestedif required. The Committee shall maintain minutes of all meetings and make the same available for review. Copies shall be sent to the Committee members within a reasonable period of time following the meeting. The Joint Health and Safety Committee will determine the appropriate mechanism to communicate the minutes of the proceedings of the Committee to the organization.
7.07 v) Any representative appointed or selected in accordance with 7.02 (e) (i) hereof, shall serve for a term of at least one two (12) calendar year years from the date of appointment. Time off for such representative(s) representatives to attend meetings of the Joint Health and Safety Committee in accordance with the foregoing, perform these duties shall be granted. “A member of a committee is entitled to:
aA) one (1) One hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting;.
bB) such Such time as is necessary to attend meetings of the committee; and.

7.14 vi) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices.
vii) Pregnant employees may request to be temporarily transferred from their current duties if, in the professional opinion of the employee's physician a risk to the pregnancy and/or unborn child is identified. If a temporary transfer is not feasible, the employee will be granted an unpaid leave of absence before commencement of the pregnancy leave.
viii) Where the Hospital identifies high risk areas where nurses are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the nurses.
ix) At least one of the employees representing workers under the Occupational Health and Safety Act, who are trained to be certified workers as defined under the Act, shall be from the Union. Upon written request, all Union members on the Joint Health and Safety Committee shall be trained as certified workers.
x) A member of a committee shall be deemed to be at work while the member is fulfilling the requirements for becoming certified by the Workplace Health and Safety Agency, and the member's employer shall pay the member for the time spent at the member's regular or premium rate as may be proper". ref: Occupational Health and Safety Act, Sec. 9

(h) All time spent by a member of the Joint Health and Safety Committee attending meetings of the Committee and carrying out her duties, shall be deemed to be work time for which she shall be paid by the Employer at her regular rate and she shall be entitled to such time from work as is necessary to attend scheduled meetings.
(i) Pregnant nurses may request to be transferred from their current duties if, in the professional opinion of the nurse’s physician the pregnancy may be at risk. If such a transfer is not feasible, the pregnant nurse, if she so requests, will be granted an unpaid leave of absence before commencement of the current contractual maternity leave.
(j) Where the Employer identifies high risk areas where nurses are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to nurses.
(k) A member of the Committee shall be deemed to be at work while the member is fulfilling the requirements for becoming certified by the Workplace Health and Safety Agency, and the member’s Employer shall pay for the time spent at the member’s regular or premium rate as may be proper. This provision does not apply with respect to nurses who are paid by the Agency for the time spent fulfilling the requirements for becoming certified.
(l) The Employer and the Union desire to arrest the spread of infectious diseases in the nursing home. To achieve this objective, the Committee may review and offer input into the infection control programs and protocols including surveillance, outbreak control, isolation, precautions, worker education and training, and personal protective equipment. The Employer will provide training and ongoing education in communicable disease recognition, use of personal protective equipment, decontamination of equipment, and disposal of hazardous waste.
(m) The Committee will discuss and may recommend appropriate measures to promote health and safety in workplaces, including, but not limited to: Musculoskeletal Injury Prevention Needle Stick Injury Prevention Personal Protective Equipment Training designed to ensure competency under the Act for those persons supervisor responsibilities.

(aj) when a circumstance described below is inherent in the workers’ work or is a normal condition of the worker’s employment; or
(b) when the worker’s refusal to work would directly endanger the life, health or safety of another person. A worker may refuse to work or do particular work where he or she has reason to believe that,
(a) any equipment, machine, device or thing the work is to use or operate is likely to endanger himself, herself, or another worker,
(b) the physical condition of the workplace or the part thereof in which he or she works or is to work is likely to endanger himself or herself; or
(c) any equipment, machine, device or thing he or she is to use or operate or the physical condition of the workplace or the part thereof in which he or she works or is to work is in contravention of the Occupational Health and Safety Act or the regulations and such contravention is likely to endanger himself, herself or another worker.
7.12 A worker who is required by the hospital to wear or use any protective clothing, equipment or device shall be instructed and trained in its care, use and limitations before wearing or using it for the first time and at regular intervals thereafter and the worker shall participate in such instruction and training.

7.14 (g) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices.
(h) All time spent by a member of the Joint Health and Safety Committee attending meetings of the Committee and carrying out their duties, shall be deemed to be work time for which they shall be paid by the Employer at their regular rate and they shall be entitled to such time from work as is necessary to attend scheduled meetings.
(i) Pregnant nurses may request to be transferred from their current duties if, in the professional opinion of the nurse’s physician the pregnancy may be at risk. If such a transfer is not feasible, the pregnant nurse, if they so request, will be granted an unpaid leave of absence before commencement of the current contractual maternity leave.
(j) Where the Employer identifies high risk areas where nurses are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to nurses.
(k) A member of the Committee shall be deemed to be at work while the member is fulfilling the requirements for becoming certified by the Workplace Health and Safety Agency, and the member’s Employer shall pay for the time spent at the member’s regular or premium rate as may be proper. This provision does not apply with respect to nurses who are paid by the Agency for the time spent fulfilling the requirements for becoming certified.
(l) The Employer and the Union desire to arrest the spread of infectious diseases in the nursing home.
(i) To achieve this objective, the Committee may review and offer input into the infection control programs and protocols including surveillance, outbreak control, isolation, precautions, worker education and training, and personal protective equipment.
(ii) When faced with occupational health and safety decisions, the home will not await full scientific or absolute certainty before taking responsible action(s) including but not limited to, providing reasonably accessible personal protective equipment (PPE) that reduces the risk and protects employees.
(iii) The Home will ensure there is an adequate stock of Pandemic PPE. The Home will advise the JHSC the supply of Pandemic PPE on an annual basis and whenever they are required to advise the government.
(iv) Employees will be fit tested on hire and then on a bi-annual basis or at any other time as required by the Employer, the government of Ontario or any other public health authority.
(v) The Home will maintain a pandemic plan, inclusive of an organizational risk assessment, that will be shared annually with the JHSC.

(i) The parties further agree that suitable subjects for discussion at the joint Union - Management Committee will include aggressive residents. The Employer will review the Joint Health and Safety Committee written policies to address the management of violent behaviour. Such policies will include but not be limited to:
i) Designing safe procedures for employees.
ii) Providing training appropriate to these policies.
iii) Reporting all incidents of workplace violence.

The Hospital will also provide the Committee with reports on fit testing compliance annually and personal protective equipment inventory on a quarterly basis. The Committee shall respect the confidentiality of the information.

The Committee shall maintain minutes of all meetings and make the same available for review. Copies shall be sent to the Committee members within a reasonable period of time following the meeting. 7.07 v) Any representative appointed or selected in accordance with 7.02 (e) (i) hereof, shall serve for a term of at least one two (12) calendar year years from the date of appointment. Time off for such representative(s) representatives to attend meetings of the Joint Health and Safety Committee in accordance with the foregoing, perform these duties shall be granted. “A member of a committee is entitled to:

7.09 The parties agree that the following items are appropriate for discussion at committee meetings: • Proposed changes to diagnostic or medical machines and equipment that will impact the health and safety of employees; • The nature, content and duration of health and safety training programs for employees; • The use of personal protective equipment by employees; The committee may, in addition to the above, discuss other items relating to the health and safety of employees.
7.10 At committee meetings the Hospital shall provide the committee with a summary of all lost-time claims, health care claims, occupational disease claims, reports on accidents and critical or fatal injuries. In addition, all relevant government directives and orders shall be provided to the committee. The committee shall review this information and propose methods of reducing the number of injuries or accidents.
7.11 This section does not apply to a worker
(a) when a circumstance described below is inherent in the workers’ work or is a normal condition of the worker’s employment; or
(b) when the worker’s refusal to work would directly endanger the life, health or safety of another person. A worker may refuse to work or do particular work where he or she has reason to believe that,
(a) any equipment, machine, device or thing the work is to use or operate is likely to endanger himself, herself, or another worker,
(b) the physical condition of the workplace or the part thereof in which he or she works or is to work is likely to endanger himself or herself; or
(c) any equipment, machine, device or thing he or she is to use or operate or the physical condition of the workplace or the part thereof in which he or she works or is to work is in contravention of the Occupational Health and Safety Act or the regulations and such contravention is likely to endanger himself, herself or another worker.
7.12 A worker who Where an investigation is required by the hospital to wear or use any protective clothing, equipment or device shall be instructed and trained in its care, use and limitations before wearing or using it for the first time and at regular intervals thereafter and the worker shall participate in such instruction and training.

7.14 vi) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices.
vii) Pregnant employees may request to be temporarily transferred from their current duties if, in the professional opinion of the employee's physician a risk to the pregnancy and/or unborn child is identified. If a temporary transfer is not feasible, the employee will be granted an unpaid leave of absence before commencement of the pregnancy leave.
viii) Where the Hospital identifies high risk areas where nurses are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the nurses.
ix) At least one of the employees representing workers under the Occupational Health and Safety Act, who are trained to be certified workers as defined under the Act, shall be from the Union. Upon written request, all Union members on the Joint Health and Safety Committee shall be trained as certified workers.

(c) The meetings will take place monthly. It is further agreed that the union members of the Committee shall be allowed time off from work at no loss of earnings to be at attend approved seminars sponsored by the Union for instruction and upgrading on Health and Safety matters.
(d) The Committee shall assist in creating a safe and healthy place to work and shall recommend actions which will improve the effectiveness of the health and safety program and shall promote compliance with appropriate laws, regulations, codes of practice and guidelines. The Company will consider the recommendations of the Committee.
(e) The Company shall make all reasonable provisions for the Health and Safety of all employees during the times described above hours of their employment. The Joint Health and Safety Committee shall determine the memberHealth Center’s employer hours of operations, utilizing the existing number of health care staff. 7.12 A worker who is required by the hospital to wear or use any protective clothing, equipment or device shall be instructed and trained in its care, use and limitations before wearing or using it for the first time and at regular intervals thereafter and the worker shall participate in such instruction and training.

(h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee's physician, her pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will ensure be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 12.06.
(i) Where the Health Centre determines that there is one a risk that employees may be exposed to infectious or communicable diseases (1) OPSEU member certifiedviral or bacterial), as described in the Occupational Health and Safety Act R.S.O.1990or blood borne pathogens, as amended up to and including 1998 among the OPSEU bargaining unit(s) at the Hospital. 7.07 v) Any representative appointed or selected in accordance with 7.02 (e) (i) hereof, shall serve for a term of at least one two (12) calendar year years from the date of appointment. viii) Where the Hospital identifies high risk areas where employees are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the employees.
ix) At least one of the employees representing workers under the Occupational Health and Safety Act, who are trained to be certified workers as defined under the Act, shall be from the Union. Upon written request, all Union members on the Joint Health and Safety Committee shall be trained as certified workers.
x) A member of a committee shall be deemed to be at work while the member is fulfilling the requirements for becoming certified by the Workplace Health and Safety Agency, and the Hospital shall pay the member for the time spent at the member’s regular or premium rate as may be proper”. 7.01 It is a mutual interest equal representation of the parties Union and the Employer. The Union shall elect/appoint its members to promote health and safety in workplaces and to prevent and reduce the occurrence of workplace injuries and occupational diseasesCommittee. The parties agree that at no time shall there be less than two (2) members from each side. Time spent by Union representatives on the Joint committee in meetings or investigations shall be considered as time worked and shall be paid for in accordance with the terms of this Agreement.
30.2 The Joint Committee will be co-chaired, with the chairing of meetings alternating between the Union and the Employer. Minutes of the meetings will be kept and copies distributed to all committee members, the Union and the Employer. 7.06 iv) Meetings shall be held every second month or more frequently at the call of a the co-chairChairs, when requestedif required. The Committee shall maintain minutes of all meetings and make the same available for review. Copies shall be sent to the Committee members within a reasonable period of time following the meeting. The Joint Health and Safety Committee will determine the appropriate mechanism to communicate the minutes of the proceedings of the Committee to the organization.
7.07 v) Any representative appointed or selected in accordance with 7.02 (e) (i) hereof, shall serve for a term of at least one two (12) calendar year years from the date of appointment. (a) any equipment, machine, device or thing the work is to use or operate is likely to endanger himself, herself, or another worker,
(b) the physical condition of the workplace or the part thereof in which he or she works or is to work is likely to endanger himself or herself; or
(c) any equipment, machine, device or thing he or she is to use or operate or the physical condition of the workplace or the part thereof in which he or she works or is to work is in contravention of the Occupational Health and Safety Act or the regulations and such contravention is likely to endanger himself, herself or another worker.
7.12 A worker who is required by the hospital to wear or use any protective clothing, equipment or device shall be instructed and trained in its care, use and limitations before wearing or using it for the first time and at regular intervals thereafter and the worker shall participate in such instruction and training.
7.13 The committee shall participate in all inquiries and investigations pursuant to the Occupational Health and Safety Act, Sec. The co- chairs* will determine the appropriate member or members who will participate in the investigation. If neither co-chair is available, the most appropriate committee member will be designated to participate in the investigation. In determining the appropriate member or members who will participate in the investigation, the parties recognize the interests of an OPSEU representative being involved in an investigation that involves an OPSEU bargaining unit member. *NOTE: If there is only one co-chair available, he or she will determine who will participate in the investigation9 (35).
7.14 vi) The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices.
vii) Pregnant employees may request to be temporarily transferred from their current duties if, in the professional opinion of the employee’s physician a risk to the pregnancy and/or unborn child is identified. If a temporary transfer is not feasible, the employee will be granted an unpaid leave of absence before commencement of the pregnancy leave.
viii) Where the Hospital identifies high risk areas where employees are exposed to infectious or communicable diseases for which there are available protective medications, such medications shall be provided at no cost to the employees.
ix) At least one of the employees representing workers under the Occupational Health and Safety Act, who are trained to be certified workers as defined under the Act, shall be from the Union. Upon written request, all Union members on the Joint Health and Safety Committee shall be trained as certified workers.
x) A member of a committee shall be deemed to be at work while the member is fulfilling the requirements for becoming certified by the Workplace Health and Safety Agency, and the Hospital shall pay the member for the time spent at the member’s regular or premium rate as may be proper”. 7.03 (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programmes programs and recommend actions to be taken to improve conditions related to safety and health. A Violent Incident Review will remain a standing meeting agenda item.
7.04 It is understood that consultation on issues of mutual concern will occur between the Joint Health and Safety Committee and Infection Control.
7.05 (d) The Hospital Employer agrees to co-operate cooperate reasonably in providing necessary information to enable the Committee to fulfil its functions.
7.06 (e) Meetings shall be held every second month month, with the exception of July and August, or more frequently at the call of a co-chairthe Chair, when requestedif required. The Committee shall maintain minutes of all meetings and make the same available for review.
7.07 (f) Any representative appointed or selected in accordance with 7.02 (b) hereof, shall serve for a term of at least one (1) calendar year from the date of appointment. Time off for such representative(s) to attend meetings of the Joint Health and Safety Committee in accordance with the foregoing, shall be granted. A granted and any representative(s) attending such meetings during their regularly scheduled hours of work, shall not lose regular earnings as a result of such attendance.
(g) The Association agrees to fully co-operate in having the membership observe all safety rules, policies, procedures and practices.
(h) All time spent by a member of a committee is the Joint Health and Safety Committee attending meetings of the Committee and carrying out the duties, shall be deemed to be work time for which members shall be paid by the Employer at the regular rate and shall be entitled to:
a) one (1) hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting;
b) such time off from work as is necessary to attend meetings of the committee; and
c) such time as is necessary to carry out inspections and investigations contemplated under subsection 9(26), 9(27), and 9(31) of the Occupational scheduled meetings. The attending Joint Health and Safety Act R.S.O. 1990 as amended up to and including 1998. A Committee member must notify her/his reporting supervisor of her/his required attendance via email in advance of attending a committee Committee meeting.
(i) No nurse shall be deemed to be at work during disciplined for acting in compliance with the times described above applicable Acts, Regulations and the member’s employer shall pay the member for those times at the member’s regular or premium rate as may be proper.
7.08 The Hospital will ensure that there is one (1) OPSEU member certified, as described in the Occupational Health and Safety Act R.S.O.1990Manual, or for seeking enforcement of the provisions of the Acts, Regulations and Health and Safety Manual.
(j) All nurses shall immediately report unsafe acts, unsafe conditions and injuries/illnesses resulting from workplace accidents to their immediate Supervisor. The Supervisor will investigate, report and take corrective action as amended up required and the Employer will report to the Joint Health and including 1998 among the OPSEU bargaining unit(s) at the Hospital. Such member on the committee will be selected or appointed by the Union. All issues relating to salary and costs associated with obtaining certification shall be Safety Committee in accordance with article 14.06legislation and policy.

In addition, all relevant government directives and orders shall be provided to the committee. The committee shall review this information and propose methods of reducing the number of injuries or accidents.
7.11 This section does not apply to a worker
(aj) when a circumstance described below is inherent in the workers’ work or is a normal condition of the worker’s employment; or
(b) when the worker’s refusal to work would directly endanger the life, health or safety of another person. A worker may refuse to work or do particular work where he or she has reason to believe that,
(a) any equipment, machine, device or thing the work is to use or operate is likely to endanger himself, herself, or another worker,
(b) the physical condition of the workplace or the part thereof in which he or she works or is to work is likely to endanger himself or herself; or
(c) any equipment, machine, device or thing he or she is to use or operate or the physical condition of the workplace or the part thereof in which he or she works or is to work is in contravention of the Occupational Health and Safety Act or the regulations and such contravention is likely to endanger himself, herself or another worker.
7.12 A worker who is required by the hospital to wear or use any protective clothing, equipment or device shall be instructed and trained in its care, use and limitations before wearing or using it for the first time and at regular intervals thereafter and the worker shall participate in such instruction and training.
7.13 The committee shall participate in all inquiries and investigations pursuant to the Occupational Health and Safety Actact. The co- co-chairs* will determine the appropriate member or members who will participate in the investigation. If neither co-chair is available, the most appropriate committee member will be designated to participate in the investigation. In determining the appropriate member or members who will participate in the investigation, the parties recognize the interests of an OPSEU representative being involved in an investigation that involves an OPSEU bargaining unit member. *NOTE: If there is only one co-chair available, he or she will determine who will participate in the investigation.
7.14 The Union agrees to endeavour to obtain the full cooperation of its membership in the observation of all safety rules and practices.

Joint Health and Safety Committee. 7.01 It is a mutual interest requirements of the parties Occupational Health and Safety Act, as it may be amended.
a) Union representatives to promote the Joint Health and Safety Committee shall be bargaining unit members selected by the Local Union.
b) The Employer agrees to cooperate in providing necessary information and management support to enable the Committee to fulfill its functions. In addition, the Employer will provide the Committee with all accident reports, health and safety records and any other pertinent information in workplaces and to prevent and reduce the occurrence of workplace injuries and occupational diseasesits possession. The parties agree that health and safety is Committee shall respect the confidentiality of the utmost importance and agree information. All reports shall be provided to promote health and safety and wellness throughout the organization. The employer shall provide orientation and training in health and safety Committee one
(1) week prior to new and current employees, and employees shall attend required health and safety training sessionsthe scheduled meeting date.
7.02 Recognizing c) In addition to its responsibilities under the applicable legislationother responsibilities, the Hospital agrees Joint Health and Safety Committee shall have the authority to accept as a recommend to the Employer and the workers the establishment, maintenance and monitoring of programs, measures and procedures respecting the health or safety of Employees.
d) A member of its the Joint Health and Safety Committee, at least one (1) representative selected or appointed by the Union from amongst bargaining unit employees. NOTE: Where there are multiple sites, the Local Parties are referred to Article 27 (Multi-site Language) to determine Local Applicability of Health & Safety Committee structure.
7.03 Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programmes and recommend actions to be taken to improve conditions related to safety and health.
7.04 It is understood that consultation on issues of mutual concern will occur between the Joint Health and Safety Committee and Infection Control.
7.05 The Hospital agrees to co-operate in providing necessary information to enable the Committee to fulfil its functions.
7.06 Meetings shall be held every second month or more frequently at the call of a co-chair, when requested. The Committee shall maintain minutes of all meetings and make the same available for review.
7.07 Any representative appointed or selected in accordance with 7.02 hereof, shall serve for a term of at least one (1) calendar year from the date of appointment. Time off for such representative(s) to attend meetings of the Joint Health and Safety Committee in accordance with the foregoing, shall be granted. A member of a committee is entitled toprovided:
ai) one (1) hour or such longer period of time as the committee determines is necessary to prepare for each committee meeting;
bii) such time as is necessary to attend meetings of the committee; and
ciii) such time as is necessary to carry out inspections and investigations contemplated under subsection 9(26), 9(27), and 9(31the member's duties.
e) of the Occupational Health and Safety Act R.S.O. 1990 as amended up to and including 1998. A member of a committee shall be deemed to be at work during the times described above and the member’s employer shall pay the member for those times at the member’s regular or premium rate as may be proper.
7.08 The Hospital will ensure that there is one (1) OPSEU member certified, as described in the Occupational Health and Safety Act R.S.O.1990, as amended up to and including 1998 among the OPSEU bargaining unit(s) at the Hospital. Such member on the committee will be selected or appointed by the Union. All issues relating to salary and costs associated with obtaining certification shall be compensated for this time in accordance with article 14.06.
7.09 the collective agreement. The parties agree that the following items are appropriate for discussion at committee meetings: • Proposed changes Employer agrees to diagnostic or medical machines and equipment that will impact the health and safety of employees; • The nature, content and duration of health and safety training programs for employees; • The use of personal protective equipment by employees; The committee may, co-operate reasonably in addition providing necessary information to the above, discuss other items relating to the health and safety of employees.
7.10 At committee meetings the Hospital shall provide enable the committee with a summary to fulfill its functions. Meetings of the JHSC shall be held every month or more frequently as agreed by the co-chairs if required, however, upon agreement by the co-chairs, the JHSC may forego monthly meetings during summer months, upon mutual agreement. The Committee shall maintain minutes of all lost-time claimsmeetings and make the same available for review. Once the meeting minutes are approved by both the Union and Employer's representatives, health care claims, occupational disease claims, reports on accidents and critical or fatal injuries. In addition, all relevant government directives and orders the meeting minutes shall be provided distributed to all staff no more than thirty (30) days after the committee.
