It is understood and agreed that no information will be provided to the Committee which is confidential. This information shall be a standing item recorded in the minutes of each meeting. (f) The Union agrees to endeavour will use its best efforts to obtain the full co-operation cooperation of its membership in the observance compliance of all safety rules and practices. (g) Copies of the minutes from the meeting shall be posted on the Occupational Health and Safety Board. (h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee's ’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the pregnancy leave referred to in Article 17.07current contractual maternity leave. i) Where the Employer identifies high-risk areas where employees are exposed to Hepatitis B, the Employer will provide, at no cost to the employees, a Hepatitis B vaccine.

Joint Health and Safety Committee. a) The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the workplace in order to prevent accidents, injury and illness. b(i) Recognizing its responsibilities under the applicable legislation, the Employer Hospital agrees to accept as a member of its Joint Occupational Health & and Safety Committee (“JOHSC”), at least one (l1) representative selected or appointed by the Union from amongst bargaining unit employees.. At least one of the employees representing workers under the Occupational Health and Safety Act who are trained to be certified workers as defined under the Act shall be from CUPE. Upon written request, all CUPE members on the JOHSC shall be trained as certified workers. A member of the JOHSC shall be deemed to be at work while the member is fulfilling the requirements for becoming certified by the Workplace Health and Safety Agency, and the member’s employer shall pay the member for the time spent at the member’s regular or premium rate as may be proper. [Occupational Health and Safety Act, s.9(36)]. This provision does not apply with respect to workers who are paid by the Agency for the time spent fulfilling the requirements for becoming certified. [Occupational Health and Safety Act, s.9 (37)] c(ii) Such Committee The JOHSC shall identify identity potential dangers and hazards, including infectious and communicable diseases, monitor health and safety conditions and practices, institute means of improving health and safety programs and recommend actions develop and implement plans to be taken to protect employees and improve conditions related to safety and health. The JOHSC shall conduct monthly inspections of the workplace. d(iii) The Hospital shall provide the JOHSC written information which identifies biological agents, compounds, substances, by-products and physical hazards known to be associated with the work environment. Where applicable, this information shall include, but not be restricted to, the chemical breakdown of trade name descriptions, information on known and suspected potential hazards, the maximum concentration exposure levels, precautions to be taken, symptoms, medical treatment and antidotes. The Hospital shall provide the members of the Joint Occupational Health and Safety Committee with the details of every accident, incident, or occurrence of an occupational disease that occurred at the worksite in the previous month. In addition, the Employer agrees shall provide members of the committee with any other health and safety records in the possession of the Employer, including records, reports and data provided to co-operate reasonably in providing necessary information to and by the Committeeworkplace Safety and Insurance Board and other government departments and agencies. e(iv) The JOHSC will determine appropriate solutions to promote health and safety in workplaces, including, but not limited to:  Violence in the workplace (includes verbal abuse)  Musculoskeletal injury prevention  Infectious and communicable diseases  Needle stick injury prevention  Employees who regularly work alone or who are isolated in the workplace  Proposed changes to procedures, machines, materials and equipment that will impact the health and safety of employees  The nature, content and duration of health and safety training programs for employees  The use of personal protective equipment by employees (v) It is understood that communication on issues of mutual concern should occur between the Joint Health and Safety Committee, Infection Control, Risk Management and Emergency Planning. (vi) Meetings shall be held every third month or more frequently at the call of the chair co-Chairs, if required. The Committee JOHSC shall maintain minutes of all meetings and make the same available for review. f(vii) Any representative appointed or selected in accordance with b(s)(i) hereof hereof, shall serve for a term of at least one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) yearappointment. Time off for representatives to perform these duties shall be granted. A member of a committee is entitled to: A) One hour or such representative(slonger period of time as the committee determines is necessary to prepare for each committee meeting; B) Such time as is necessary to attend meetings of the committee; C) Such time as is necessary to carry out inspections and investigations under subsection 9(26), 9(27), and 9(31) of the Act. [Occupational Health & and Safety Committee Act, s.9(34)]; D) Where an investigation is required under the Occupational Health and Safety Act, the JOHSC shall determine the appropriate member or members who will participate in accordance the investigation, recognizing the interest of a CUPE representative to be involved in an investigation involving CUPE members; E) In all cases of lost time work related injuries, the Hospital and the safety representative along with the foregoing injured employee will conduct an accident investigation. Through the investigation, the cause(s) of the accident shall be granted determined, and time so spent attending such meetings shall be deemed the recommendations developed to be work time for which minimize the representative(s) shall be paid by the Employer at his/her regular or overtime rate as may be applicable. g) The Union agrees to endeavour to obtain the full co-operation risk of its membership in the observance of all safety rules and practices. h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee's physician, the pregnancy may be at risk. Joint Health and Safety Committee. a) The Employer A Joint Health and Safety Committee shall be established which is composed of a minimum of two Union members chosen by the Union agree that they mutually desire to maintain standards all of safety and health in the workplace in order to prevent accidents, injury and illness.whom shall be certified b) Recognizing its responsibilities under Two co-chairpersons shall be elected by and from the applicable legislationmembers of the committee. These inspections shall be made of all places of employment, including buildings, structures, grounds, excavations, tools, equipment, machinery and work methods and practices. Such Committee inspections shall identify potential dangers be made at intervals that will prevent the development of unsafe working conditions. ii) Recommend measures required to attain compliance with appropriate government regulations and hazards, institute means the correction of improving hazardous conditions. iii) Consider recommendations from the workforce with respect to health and safety programs matters and recommend actions to be taken to improve conditions related to safety and healthimplementation where warranted. div) The Employer agrees Hold meetings at least once every two months for the review of: • reports of current accidents and occupational diseases, their causes and means of prevention • remedial action taken or required by the reports of investigations or inspections • any other matters pertaining to co-operate reasonably in providing necessary information health and safety v) Record the minutes of the meetings which shall be signed by the co- chairs, distributed to the Committeecommittee members, posted on the bulletin boards and sent to the local Union and national Union representative. evi) Meetings Have access to and promptly receive copies of all reports, records and documents in the Company’s possession or obtainable by the Company pertaining to health or safety. vii) Time spent by members of the committee in the course of their duties shall be held every third month or more frequently at the call of the chair if required. The Committee considered as time worked and shall maintain minutes of all meetings and make the same available for review. f) Any representative appointed or selected in accordance with b) hereof shall serve for a term of one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. Time off for such representative(s) to attend meetings of the Health & Safety Committee paid in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(s) shall be paid by the Employer at his/her regular or overtime rate as may be applicableterms of this Agreement. g) The Union agrees to endeavour to obtain the full co-operation of its membership in the observance of all safety rules and practices. h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee's physician, the pregnancy may be at risk.
