Common use of Joint Health & Safety Committee Clause in Contracts

Joint Health & Safety Committee. (a) The Company and the Union agree to utilize and empower a Joint Health & Safety Committee in accordance with the Occupational Health & Safety Act. (b) The Committee shall be comprised of eight (8) employees, four (4) being appointed by the Company and four (4) being appointed by the Union. There will be two (2) Union representatives on day shift and one (1) on afternoon shift and one (1) on midnight shift, so long as such shifts are operating in the plant. (c) Two (2) Co-chairpersons will be selected, one of the Co- Chairpersons shall be a Union member chosen by the Union members. The other Co-Chairperson will be a Company member chosen by the Company. The Union Co- Chairperson and the Company Co-Chairperson shall be allowed up to two (2) hours per week to jointly meet. Note: During absences of the Co-Chairperson(s), respective alternates will be recognized. (d) Time spent by Members of this Committee in the course of their plant duties shall be considered as time worked and shall be paid in accordance with the terms of this Agreement, including authorized overtime if any. (i) The Company will identify the duties of the Joint Health & Safety Committee in the posted Health & Safety Policy. The following are some of the recognized duties: (1) Identify situations that may be a source of danger or hazard to workers; (2) Receive information from the workers and the Company as well as make recommendations to the Company and the workers for the improvement of the health and safety of workers; (3) Recommend to the Company and the workers the establishment, maintenance, and monitoring of programs, measures and procedures respecting the health and safety of workers; (4) Monthly inspections of the plant of all places of employment including buildings, structures, grounds, tools, equipment, and work methods and practices will be conducted by Management and members of the Joint Health and Safety Committee. Safety tours will include all shifts. (5) Receive prompt notification of any fatalities and/or serious injuries resulting from work related accidents as well as be informed of any major incidents that did not result in serious injuries; and review accident and incident investigations to ensure completeness and ensure preventative measures have been done. (6) Hold regular meetings at least once a month or more frequently if mutually agreed upon by the Co- chairpersons. The Co-chairs shall alternate responsibility for chairing the meeting. (7) Approve the content of the regular health & safety meetings with the plant employees. (8) The Co-Chairs shall be responsible for posting minutes of the Health and Safety Committee no later than five (5) days after meetings. (ii) Concerns will be documented and discussed at JHSC meetings for resolution. (iii) The Company will hold health & safety meetings a minimum of ten (10) times per year.

Joint Health & Safety Committee. (a) The Company Hospital and the Union agree that they mutually desire to utilize maintain standards of safety and empower health in the Hospital in order to prevent accidents, injury and illness. (b) Recognizing its responsibilities under the applicable legislation, the Hospital agrees to accept as a Joint member of its Accident Prevention - Health & Safety Committee at least one (1) representative selected or appointed by the Union from amongst bargaining unit employees. (c) Such Committee shall identify potential dangers and hazards, institute means of improving health and safety programs and recommend actions to be taken to improve conditions related to safety and health. (d) The Hospital agrees to co-operate reasonably in providing necessary information to enable the Committee to fulfil its functions. (e) Meetings shall be held every third (3rd ) month or more frequently at the call of the chair if required. The Committee shall maintain minutes of all meetings and make the same available for review. (f) Any representative appointed or selected in accordance with (b) hereof shall serve for a term of one (1) calendar year from the date of appointment which may be renewed for further periods of one (1) year. Time off for such representative(s) to attend meetings of the Accident Prevention - Health & Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(s) shall be paid by the Hospital at his regular or premium rate as may be applicable. CUPE’s representative(s) to the Joint Occupational Health and Safety Committee shall be given one (1) hour of paid preparation time as per the Occupational Health & Safety ActAct to prepare for each meeting. (bg) The Committee shall be comprised Union agrees to endeavour to obtain the full co-operation of eight (8) employees, four (4) being appointed by the Company and four (4) being appointed by the Union. There will be two (2) Union representatives on day shift and one (1) on afternoon shift and one (1) on midnight shift, so long as such shifts are operating its membership in the plantobservance of all safety rules and practices. (ch) Two (2) Co-chairpersons Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be selected, one granted an unpaid leave of absence before commencement of the Co- Chairpersons shall be a Union member chosen by the Union members. The other Co-Chairperson will be a Company member chosen by the Company. The Union Co- Chairperson and the Company Co-Chairperson shall be allowed up maternity leave referred to two (2) hours per week to jointly meet. Note: During absences of the Co-Chairperson(s), respective alternates will be recognized. (d) Time spent by Members of this Committee in the course of their plant duties shall be considered as time worked and shall be paid in accordance with the terms of this Agreement, including authorized overtime if anyArticle 12.06. (i) The Company Where the Hospital identifies high risk areas where employees are exposed to Hepatitis B, the Hospital will identify the duties of the Joint Health & Safety Committee in the posted Health & Safety Policy. The following are some of the recognized duties: (1) Identify situations that may be a source of danger or hazard to workers; (2) Receive information from the workers and the Company as well as make recommendations provide, at no cost to the Company and the workers for the improvement of the health and safety of workers; (3) Recommend to the Company and the workers the establishmentemployees, maintenance, and monitoring of programs, measures and procedures respecting the health and safety of workers; (4) Monthly inspections of the plant of all places of employment including buildings, structures, grounds, tools, equipment, and work methods and practices will be conducted by Management and members of the Joint Health and Safety Committee. In the event that the full committee is not available, the inspection will be conducted by Management carried out with the remaining Committee members and such members of will represent both the Joint Health Union and Safety Committee. Safety tours will include all shiftsthe Company. (5) Receive prompt notification of any fatalities and/or serious injuries resulting from work related accidents as well as be informed of any major incidents that did not result in serious injuries; and review accident and incident investigations to ensure completeness and ensure preventative measures have been done. (7) Approve the content of the production supervisors' regular health & safety meetings with the plant employees. (8) The Co-Chairs shall ii) Supervisors who receive concerns from employees during health and safety meetings will address such concerns. A copy of employee concerns will be responsible for posting minutes of available to the JHSC members in the Health and & Safety Committee no later than five (5) days after meetings. (ii) Concerns will be documented and discussed at JHSC meetings for resolutionOffice. (iii) The Company Supervisors will hold health & safety meetings a minimum of ten (10) times per year.

Joint Health & Safety Committee. (a) The Company and the Union agree to utilize and empower a Joint Health & Safety Committee in accordance with (the Occupational Health & Safety Act“Committee”) shall continue, which is composed of Union and Employer representatives. A minimum of two (2) Union members chosen by the Union, one of which shall be certified, shall be Committee members, and at no time shall the number of Employer Committee members be allowed to outnumber the amount of Union Committee members. The training of the certified member shall be paid for by the employer. (b) The Committee Union Co-Chair shall be comprised selected by and from the members of eight (8) employeesthe Union side of committee. One Co-Chair shall be a Union member; the other shall be an Employer member, four (4) being appointed by which will take turns chairing the Company and four (4) being appointed by the Union. (c) Two (2) Co-chairpersons will be selected, one Without limiting the generality of the Co- Chairpersons shall be foregoing, the Committee shall: (i) determine that inspections have been carried out at least once a Union member chosen month by the Union members. The other Co-Chairperson will be a Company member chosen by the Company. The Union Co- Chairperson and the Company Co-Chairperson shall be allowed up to two (2) hours per week to jointly meet. Note: During absences of the Co-Chairperson(s)Chairs or designates. These inspections shall be made of all places of employment, respective alternates machinery and work methods and practices including ergonomic assessments. Such inspections shall be made at intervals that will prevent the development of unsafe working conditions; (ii) recommend measures required to attain compliance with appropriate government regulations and the correction of hazardous conditions; (iii) consider recommendations from the workforce with respect to health and safety matters and recommend implementation where warranted; (iv) record the minutes of the meetings which shall be recognizedsigned by the Co-Chairs, distributed to the committee members, posted on the bulletin board; (v) have access to and promptly receive copies of all reports, records and documents in the Employer’s possession or obtainable by the Employer pertaining to health and safety; and (vi) engage in all other required activities under the Occupational Health and Safety Act. (d) Time spent by Members members of this the Committee in the course of their plant duties duties, as defined in the Occupational Health and Safety Act, shall be considered as time worked and shall be paid in accordance with the terms of this Agreement, including authorized overtime if any. The following are some of the recognized duties: (1) Identify situations that may be a source of danger or hazard to workers; (2) Receive information from the workers and the Company as well as make recommendations to the Company and the workers for the improvement of the health and safety of workers; (3) Recommend to the Company and the workers the establishment, maintenance, and monitoring of programs, measures and procedures respecting the health and safety of workers; (4) Monthly inspections of the plant of all places of employment including buildings, structures, grounds, tools, equipment, and work methods and practices will be conducted by Management and members of the Joint Health and Safety Committee. Safety tours will include all shifts. (5) Receive prompt notification of any fatalities and/or serious injuries resulting from work related accidents as well as be informed of any major incidents that did not result in serious injuries; and review accident and incident investigations to ensure completeness and ensure preventative measures have been done. (6) Hold regular meetings at least once a month or more frequently if mutually agreed upon by the Co- chairpersons. The Co-chairs shall alternate responsibility for chairing the meeting. (7) Approve the content of the regular Union health & safety meetings with committee shall meet without company representatives for at least one hour prior to the plant employees. (8) The Co-Chairs committee meeting. This time is considered worked time and shall be responsible for posting minutes of the Health and Safety Committee no later than five (5) days after meetingspaid accordingly. (ii) Concerns will be documented and discussed at JHSC meetings for resolution. (iii) The Company will hold health & safety meetings a minimum of ten (10) times per year.

Joint Health & Safety Committee. (a) The Company Employer and the Union Association agree that they mutually desire to utilize maintain standards of health and empower a safety the Lodge order to prevent injury and illness. The Joint Health & and Safety Committee in accordance shall be constituted, with representation of at least half by employees from the Occupational various bargaining units and of employees who are not represented by unions and who do not exercise managerial functions, which shall identify potential dangers, recommend means of improving the Health & and Safety Act. (b) Programs and obtain information from the Employer or other persons identification of hazards and standards elsewhere. One member of this bargaining unit shall be designated by the Association to sit on the Committee. The Committee shall normally meet at least once a month. Time spent in such meetings is to be comprised considered time worked and will be paid at the appropriate rates. Minutes shall be taken of eight (8) all meetings and copies shall be sent to the Employer and to the Association. Two representatives of the Joint Health and Safety Committee, one from management and one from the employees on a rotating basis designated by the employees, four (4) being appointed by the Company and four (4) being appointed by the Union. There will be two (2) Union representatives on day shift and one (1) on afternoon shift and one (1) on midnight shift, so long as such shifts are operating in the plant. (c) Two (2) Co-chairpersons will be selected, one shall make monthly inspections of the Co- Chairpersons work place and equipment and shall report to the Health and Safety Committee the results of this inspection. In the event of accident or injury, such representatives shall be a Union member chosen by notified immediately and shall investigate and report as soon as possible to the Union members. The other Co-Chairperson will be a Company member chosen by Committee and to the Company. The Union Co- Chairperson Employer on the nature and the Company Co-Chairperson shall be allowed up to two (2) hours per week to jointly meet. Note: During absences causes of the Co-Chairperson(s)accident or injury. Furthermore, respective alternates will such representatives must be recognized. (d) notified of the inspection of a government inspector and shall have the right to accompany him on his inspections. The following are some of the recognized duties: (1) Identify situations that may be a source of danger or hazard to workers; (2) Receive information from the workers and the Company as well as make recommendations to the Company and the workers for the improvement of the health and safety of workers; (3) Recommend to the Company and the workers the establishment, maintenance, and monitoring of programs, measures and procedures respecting the health and safety of workers; (4) Monthly inspections of the plant of all places of employment including buildings, structures, grounds, tools, equipment, and work methods and practices will be conducted by Management and members of the Joint Health and Safety Committee. Safety tours will include all shifts. (5) Receive prompt notification Committee and the representativesthereof shall have reasonable access to the annual summary of any fatalities and/or serious injuries resulting data from the Workers' Compensation Board relating to the number of work related accidents accident fatalities, the number of lost workday cases, the number of lost workdays, the number of non-fatal cases that required medical aid without lost workdays, the incidence of occupational injuries, and such other data as well as be informed of any major incidents that did not result in serious injuries; and review accident and incident investigations the Workers' Compensation Board may decide to ensure completeness and ensure preventative measures have been done. (6) Hold regular meetings at least once a month or more frequently if mutually agreed upon by the Co- chairpersonsdisclose. The CoAssociation agrees to endeavour to obtain the full co-chairs shall alternate responsibility for chairing operation of its membership in the meetingobservation of all safety rules and practices. (7) Approve the content of the regular health & safety meetings with the plant employees. (8) The Co-Chairs shall be responsible for posting minutes of the Health and Safety Committee no later than five (5) days after meetings. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 12.06. (8) The Co-Chairs shall be responsible for posting minutes of i) Where the Health and Safety Committee Hospital identifies high risk areas where employees are exposed to Hepatitis B, the Hospital will provide, at no later than five (5) days after meetings. (ii) Concerns will be documented and discussed at JHSC meetings for resolution. Time off for such representative(s) to attend meetings of the Accident Prevention - Health & Safety Committee in accordance with the foregoing shall be granted and time so spent attending such meetings shall be deemed to be work time for which the representative(s) shall be paid by the Hospital at his regular or premium rate as may be applicable. CUPE’s representative(s) to the Joint Occupational Health and Safety Committee shall be given one (1) hour of paid preparation time as per the Occupational Health & Safety Act to prepare for each meeting. g) The Union agrees to endeavour to obtain the full co-operation of its membership in the observance of all safety rules and practices. h) Pregnant employees may request to be transferred from their current duties if, in the professional opinion of the employee’s physician, the pregnancy may be at risk. If such a transfer is not feasible, the pregnant employee, if she so requests, will be granted an unpaid leave of absence before commencement of the maternity leave referred to in Article 12.06. i) Where the Hospital identifies high risk areas where employees are exposed to Hepatitis B, the Hospital will p rovide, at no cost to the employees, a Hepatitis B vaccine. The Hospital accepts that one (1) CUPE member who is to serve on the Joint Occupational Health and Safety Committee will be selected among those to be trained as certified workers under the Occupational Health & Safety Act. Any costs associated with the initial training of a certified worker will be paid by the Hospital, or as may be prescribed pursuant to the Occupational Health & Safety Act. (b) The Committee shall be comprised of eight (8) employees, four (4) being appointed by the Company and four (4) being appointed by the Union. There will be two (2) Union representatives on day shift and one (1) on afternoon shift and one (1) on midnight shift, so long as such shifts are operating in the plant. (c) Two (2) Co-chairpersons will be selected, one of the Co- Chairpersons shall be a Union member chosen by the Union members. The other Co-Chairperson will be a Company member chosen by the Company. The Union Co- Chairperson and the Company Co-Chairperson shall be allowed up to two (2) hours per week to jointly meet. Note: During absences of the Co-Chairperson(s), respective alternates will be recognized. (d) Time spent by Members of this Committee in the course of their plant duties shall be considered as time worked and shall be paid in accordance with the terms of this Agreement, including authorized overtime if any. (i) The Company will identify the duties of the Joint Health & Safety Committee in the posted Health & Safety Policy. The following are some of the recognized duties: (1) Identify situations that may be a source of danger or hazard to workers; (2) Receive information from the workers and the Company as well as make recommendations to the Company and the workers for the improvement of the health and safety of workers; (3) Recommend to the Company and the workers the establishment, maintenance, and monitoring of programs, measures and procedures respecting the health and safety of workers; (4) Monthly inspections of the plant of all places of employment including buildings, structures, grounds, tools, equipment, and work methods and practices will be conducted by Management and members of the Joint Health and Safety Committee. Safety tours will include all shifts. (5) Receive prompt notification of any fatalities and/or serious injuries resulting from work related accidents as well as be informed of any major incidents that did not result in serious injuries; and review accident and incident investigations to ensure completeness and ensure preventative measures have been done. (6) Hold regular meetings at least once a month or more frequently if mutually agreed upon by the Co- chairpersons. The Co-chairs shall alternate responsibility for chairing the meeting. (7) Approve the content of the regular health & safety meetings with the plant employees. (8) The Co-Chairs shall be responsible for posting minutes of the Health and Safety Committee no later than five (5) days after meetings. (ii) Concerns will be documented and discussed at JHSC meetings for resolution. (iii) The Company will hold health & safety meetings a minimum of ten (10) times per year.

Joint Health & Safety Committee. (a) The Company and the Union agree to utilize and empower a Joint Health & Safety Committee in accordance with the Occupational Health & Safety Act. (b) The Committee shall be comprised of eight (8) employees, four (4) being appointed by the Company and four (4) being appointed by the Union. (7) Approve the content of the production supervisors' regular health & safety meetings with the plant employees. (8) The Co-Chairs shall ii) Supervisors who receive concerns from employees during health and safety meetings will address such concerns. A copy of employee concerns will be responsible for posting minutes of available to the JHSC members in the Health and & Safety Committee no later than five (5) days after meetings. (ii) Concerns will be documented and discussed at JHSC meetings for resolutionOffice. (iii) The Company Supervisors will hold health & safety meetings a minimum of ten (10) times per year.
