Joint Tenancy. From 1 November 2019 if you want another person to be a joint tenant, the house must have been the only or principal home of the person who is to become a joint tenant for at least 12 months immediately before the date of your written request and you, a joint tenant or the person you now wish to become a joint tenant must have notified us of them moving into the house. The person you wish to add as a joint tenant, and any existing joint tenants must apply to us in writing along with you. The length of time the person you want to add as a joint tenant must have been living in the property starts from the date we are notified that the person is living in the property as their only or principal home. You can give us notice of someone living with you before 1 November 2019 and that time will count towards the length of time they have been living at the property.
Joint Tenancy. If Seller, immediately preceding this Agreement held title to the Property in joint tenancy with full rights of survivorship, and the joint tenancy is not later destroyed by operation of law or by acts of Seller, then the proceeds of this sale and any continuing or recaptured rights of Seller in the Property shall belong to Seller as joint tenants with full rights of survivorship and not as tenants in common; and Buyer, in the event of the death of either Seller, agrees to pay any balance of the price due Seller under this Agreement to the surviving Seller and to accept a deed from the surviving Seller.
Joint Tenancy. As a joint tenant with respect to some or all of the Shares subject to this Agreement, the Joint Tenant hereby represents and acknowledges that she has read and understands the terms and provisions set forth herein. In furtherance of the consummation of the transactions described in this Agreement, the Joint Tenant hereby expressly gifts and transfers to the Executive all right, title and interests in such of the Shares held in joint tenancy, such gift and transfer taking effect immediately prior to and in connection with the consummation of the transactions described herein. The Joint Tenant hereby agrees and acknowledges that the effect of this Section 2.6 is to terminate her joint tenancy interest in any of the Shares held in joint tenancy as of the date hereof.
Joint Tenancy. If the joint owners hold the Account as tenants in common, they should notify SoFi HK in writing and provide such documentation as SoFi HK may require. Otherwise, SoFi HK is entitled to presume that the joint owners expressly intend to hold as joint tenants with rights of survivorship. In the event of death of any of the joint owners who hold as joint tenants, the surviving joint owner(s) must immediately notify SoFi HK in writing. The entire interest of the deceased in this Agreement and any Account will be automatically vested in the surviving joint owner(s). The estate of the deceased joint owner will have no interest therein, but will together with each surviving joint owner be jointly and severally liable to SoFi HK in respect of all liability incurred prior to the death of the deceased.
Joint Tenancy. If this a joint tenancy, and one of the tenants dies, the tenancy will pass automatically to the remaining joint tenant. This is known as a 'succession'. When both joint tenants have died, there is no further right of succession. Your housing officer can give you more information on the rules of succession.
Joint Tenancy. 2.1 If more than 1 person is named as the “Tenant” the tenancy shall be deemed to be a joint and several tenancy. The Landlord is entitled to treat the persons named as “the Tenant” as a group and is not obliged to deal with each person individually.
2.2 Each person named as the Tenant can be held liable for all the Tenants obligations contained within this Agreement.
2.3 The person named as Lead Tenant has no greater liability to the Landlord than any other named Tenants.
4.2 We will not unreasonably refuse permission for an assignation, subletting, joint tenancy, giving up of possession or taking in a lodger request. Reasonable grounds for refusing permission include the following: • We have served a notice on you warning that we may seek eviction on certain grounds because of your conduct • We have obtained an order for your eviction • It appears that you propose to receive a payment or an unreasonable rent or deposit • The proposed change would lead to the criminal offence of overcrowding • We intend to carry out work on the house (or the building of which the house forms part) which would affect the part of the house connected with the proposed change From 1 November 2019 we will have the following additional reasonable grounds for refusing permission for an assignation, subletting or joint tenancy request: • We have not been notified that the relevant person has been living in the property as their only or principal home • The relevant person has not been living in the property for the required 12-month period • For assignation requests additional grounds for us refusing permission are: • if the proposed assignee would not be given reasonable preference (priority) in terms of our allocations policy • if the house would be under-occupied as a result of the assignation These examples do not in any way alter our general right to refuse permission on reasonable grounds. If we give permission, you cannot increase the rent or other payments made to you by the other person unless we give our permission. See paragraph 10.2 for more detail on getting permission.
4.3 We will...
Joint Tenancy. If this Account has more than one owner, the manner in which Stifel carries the names of the owners on its records shall designate the nature of the joint tenancy. You, and each of you, agree jointly and severally with Stifel:
1. To be fully and completely responsible for this Securities Account and to pay on demand any debit balance at any time.
2. That each of you has full power and authority to make purchases and sales, withdraw monies and property, or do anything else with reference to said Account, and Stifel is authorized and directed to act upon instructions of any of you; provided, however, that Stifel will make all checks payable to all tenants jointly and deliver property registered in the names of all tenants jointly unless all tenants provide Stifel with other written instructions. The authority of each of you to act in connection with this account shall continue until Stifel receives written notice from any of you revoking that authority.
3. That any notice of any kind sent to any of you shall be notice to each of you.
4. That this Agreement shall survive the disability or incompetence of any of you.
5. That in the event of the death of any of you, Stifel shall in good faith without actual notice of such death, continue to act under this Agreement. Any and all action so taken by Stifel shall be binding on the survivor(s) and his or her legal representatives, beneficiaries, and assigns, who shall also be bound by any payment or delivery made to or any transaction made by the survivor(s), and Stifel shall look only to the survivor(s).
Joint Tenancy. If Sellers title is held in joint tenancy this Agreement shall not sever such joint tenancy. Therefore all Owners must sign this Agreement. If Buyer(s) are husband and wife, their interest hereunder shall be held in joint tenancy with rights of survivorship unless otherwise specifically indicated in this Agreement.
Joint Tenancy. Unless otherwise agreed in writing, all money which is now or may later be credited to the Account (including, but not limited to, all interest) is joint property with the right of survivorship. That means that if one of you dies, all money in the Account automatically becomes the property of the other accountholder(s). In order to make this legally effective, you each assign such money to the other accountholder (or the others jointly if there is more than one other accountholder).
