JURISDICTION OF THE MAGISTRATES COURT. The parties hereby agree in terms of Section 45 of the Magistrates Court Act, No. 32 of 1944 (as amended) to the jurisdiction of the Magistrates Court should any claims arise from this Agreement.
JURISDICTION OF THE MAGISTRATES COURT. 30.1 Not limiting the jurisdiction that any other court may have, the Parties consent in terms of section 45 of the Magistrates’ Courts Act, 32 of 1944, (or any similar section of an act replacing such act) to the jurisdiction of the Magistrate’s Court for the purpose of any proceedings in terms of or incidental to this Lease, notwithstanding that the amount claimed or the value of the matter in dispute may exceed such jurisdiction.
JURISDICTION OF THE MAGISTRATES COURT. 21.1. The Subscriber consents to the jurisdiction of the Magistrates Court having jurisdiction over any dispute arising from this agreement, irrespective of the amount of the claim.
JURISDICTION OF THE MAGISTRATES COURT. The parties hereby consent to the jurisdiction of the magistrate's court, having territorial jurisdiction, in respect of any dispute which may arise from this agreement.
JURISDICTION OF THE MAGISTRATES COURT. Each party consents in terms of section 45 of the Magistrate’s Courts Act, 32 of1944, to the jurisdiction of the magistrate’s court in respect of any proceedings pursuant to this agreement.
JURISDICTION OF THE MAGISTRATES COURT. Shipping & General shall be entitled to institute any proceedings against the Client in any Magistrates Court having jurisdiction over it, even though the cause of action or amount claimed is beyond that jurisdiction of the court.
JURISDICTION OF THE MAGISTRATES COURT. GSF shall be entitled to institute any proceedings against the Client in any Magistrates Court having jurisdiction over it, even if the cause of action or amount claimed is beyond that jurisdiction of the court.
JURISDICTION OF THE MAGISTRATES COURT. 7.1. The parties hereto bind themselves and submit to the jurisdiction of the Magistrate's Court having jurisdiction in terms of the provisions of Section 45 and 28 of the Magistrate's Court Act No. 32 of 1944, as amended, in respect of any dispute or difference or legal proceedings arising out of or in connection with this Agreement including action for payment of the price or ejectment of the Purchaser from the unit whether or not such action is within the present or future jurisdiction of the said Court.
JURISDICTION OF THE MAGISTRATES COURT. Governing Law 26.1. This Lease Agreement is governed by South African law.
JURISDICTION OF THE MAGISTRATES COURT. FENESTRA ALUMINIUM may at its option and notwithstanding that the amount of its claim exceeds the jurisdiction of the Magistrate’s Court, be entitled to institute action out of such a Court. Nothing herein contained shall invalidate FENESTRA ALUMINIUM’srights to proceed in any other Court of competent jurisdiction.
