Jury Duty and Court Appearance. 11.4.1 When summoned to serve on a jury; when subpoenaed as a witness in criminal proceedings, or as a witness in a civil action if not a party thereto; when appearing as a defendant in a criminal or traffic case if acquitted therefrom; the employee, to qualify for permission from the Xxxx/delegate to be absent with pay, shall produce the summons or subpoena or submit such other evidence showing the necessity for court appearance.
11.4.2 An employee shall also provide statements from officials of the court of the time taken and the fees (if any) paid to him/her and shall pay all such fees to the College.

Jury Duty and Court Appearance. 11.5.1 Employees will be entitled to leave with pay: • when summoned to serve on a jury; • when subpoenaed as a witness in criminal proceedings; • when subpoenaed as a witness in a civil action if not a party to the action; • when appearing as a defendant in a criminal or traffic case, if acquitted.
11.5.2 For employees to qualify for this leave, they will produce a summons or subpoena or other evidence to show the necessity of attendance at court.
11.5.3 Employees will also provide a statement from an official of the Court of the time taken and the fees paid, if any. Employees may retain the small sum paid to them by the courts in lieu of expenses incurred.
Jury Duty and Court Appearance. Employees who are subpoenaed to serve as a juror or appear as a witness, or required to attend a coroner's inquest, will be granted leave with pay for that purpose. The Employee shall, however, pay the Company any fees paid for such duty.
Jury Duty and Court Appearance. Any employee who is subpoenaed for jury duty during school hours by any person or party and any employee who is subpoenaed by any person or party to appear in any court proceeding shall be provided leave for such duty and appearances and shall return to work upon completion of their jury duty or court appearance. The School District shall pay the employee the difference between the fees or remuneration granted by the court or subpoenaing party and the regular School District pay.

Employees shall be provided paid leave for all working time lost up to a full shift when called to serve on jury duty, provided that fees paid by the court (except travel and parking expenses) shall be remitted to the District. Court service when subpoenaed as a witness will be treated the same as jury duty, provided the employee or a member of the employee’s family as defined in Article 13 Section 8 A. 2. is not a party to the action. An employee who reports for jury duty, or who has been subpoenaed and is dismissed, shall report for work the remainder of the working day, provided that at least two hours of a working shift would remain after the employee travels to the work assignment. Second and third shift employees will be given the same consideration. Employees who do not work on the first shift, if called to jury duty, shall be considered to be on the first shift during the jury duty assignment; if such employee does not serve on jury duty for at least five (5) hours, that employee will contact the Operations Department or appropriate High School principal immediately when dismissed from jury duty for the day and will be assigned a duty station for the remainder of the first shift work day at the discretion of the Operations Department. An employee's annual leave shall be charged and then reinstated once the employee has remitted to the District the fees paid by the court, less travel and parking expenses.

Jury Duty and Court Appearance. 16.4.1 Employees are entitled to leave without loss of pay if:
a) summoned to serve on a jury;
b) subpoenaed as a witness in any court or tribunal, subject to Clause 16.4.2;
c) appearing as a defendant in a criminal or traffic case, if acquitted.
16.4.2 Clause 16.4.1(b) does not apply to:
a) employees subpoenaed by the Union in an action against the College;
b) employees who have initiated the action;
c) actions concerning employees’ outside business or personal interests.
16.4.3 Employees must produce a summons or subpoena or other evidence to show it is necessary for them to attend.
16.4.4 Employees will provide a statement from an official of the court or tribunal of the time taken.
16.4.5 Employees will return any conduct money received to the College. Employees will keep any expense money received
Jury Duty and Court Appearance. Any member of the bargaining unit summoned to jury duty or issued a court subpoena shall be paid his/her full salary for each working day of absence, provided that the member pays the District the jury fee or witness fee. Part-time employees would pay back a prorated amount of the jury fee. If payment is not paid within forty (40) days, it will be withheld from subsequent pay. This provision is not applicable if the staff member is a plaintiff against the School District, the Board of Education, or its representative as a result of any legal actions commenced by or on behalf of the Decatur Educational Support Personnel Association, or as the result of any legal actions arising from collective negotiations between the Decatur Educational Support Personnel Association and the Board of Education.
