Landlord's Covenant of Quiet Enjoyment. Provided Tenant performs the terms, conditions and covenants of this Lease, and subject to the terms and provisions hereof, Landlord covenants and agrees to take all necessary steps to secure and to maintain for the benefit of Tenant the quiet and peaceful possession of the Demised Premises, for the Lease Term, without hindrance, claim or molestation by Landlord or any other person lawfully claiming under Landlord.
Landlord's Covenant of Quiet Enjoyment. Landlord covenants and warrants that Tenant, and all those claiming through Tenant, shall have quiet and peaceable enjoyment of the Premises by and through Landlord provided Tenant, and all those claiming through Tenant, are not in default of this Lease.
Landlord's Covenant of Quiet Enjoyment. Landlord's Covenant of Quiet Enjoyment. Landlord covenants that Tenant, upon paying the Basic Rent and Additional Rent provided for hereunder and performing and observing all of the other covenants and provisions hereof, may peaceably and quietly hold and enjoy the Premises for the Term as aforesaid, without hindrance or ejection by any persons lawfully claiming under Landlord to have title to the Premises superior to Tenant subject, however, to all of the terms and provisions of this Lease and to all matters of record; the foregoing covenant of quite enjoyment is in lieu of any other covenant of quiet enjoyment, express or implied.
Landlord's Covenant of Quiet Enjoyment. Landlord hereby covenants to Concessionaire that Landlord has title, subject to the Tidelands Trust, to the Premises, free of all claims, liens and encumbrances. Upon Concessionaire paying the Base Rent, Percentage Rent and other amounts payable hereunder and observing and performing all of the covenants, conditions and provisions on Concessionaire's part to be observed and performed hereunder, Concessionaire shall peaceably hold and quietly enjoy the Premises for the entire term hereof without hindrance, molestation or interruption by Landlord or any party claiming through or under Landlord.
Landlord's Covenant of Quiet Enjoyment. Provided Tenant performs the terms, conditions and covenants of this Lease, Landlord covenants and agrees to take all necessary steps to secure and to maintain for the benefit of Tenant the quiet and peaceful possession of the Demised Premises, for the Lease Term, without hindrance, claim or molestation by Landlord or any other person acting by, through or under Landlord. Landlord warrants to Tenant that Landlord has good and marketable fee simple title to the Real Property and that the Foundry Park II Parcel is owned in fee simple by Foundry Park II, LLC, a Virginia limited liability company (“Foundry Park II”). Landlord shall cooperate with and keep Tenant reasonably advised in connection with Landlord’s title and survey work being conducted in the course of developing and financing the Project, and will execute and deliver commercially reasonable documents as may reasonably be necessary for Tenant to obtain a leasehold title policy in the event Tenant elects to obtain same. Foundry Park II executes this Lease to evidence its consent to, approval of and agreement to be bound by the rights of Tenant to the Foundry Park II Parcel and the express obligations of Foundry Park II contained in Articles 33, 47.2, 48, 54, 57.1 and 57.3 of this Lease. Subject to a request for confidential treatment, certain portions of this agreement have been intentionally omitted. The omitted portions subject to the confidential treatment request are designated by three asterisks [***]. Landlord's Covenant of Quiet Enjoyment. Landlord represents and warrants that it has full right and authority to enter into this Lease and Landlord agrees that upon Xxxxxx’s paying the rent and performing and observing the terms, provisions, conditions and covenants on its part to be performed and observed, Tenant shall, and may, peaceably and quietly have, hold, occupy and enjoy the Premises and may use in common with others the common facilities of the Building and Lot, as herein provided, without any manner of hindrance or molestation from Landlord or anyone claiming under Landlord, subject, however, to the terms of this Lease and any instruments having priority thereto.
Landlord's Covenant of Quiet Enjoyment. Provided Tenant performs the terms, conditions and covenants of this Lease, and subject to the terms and provisions hereof, including Landlord’s right to perform any Construction Work, and the rights of any mortgagees or ground lessors of the Project, Landlord covenants and agrees to take all necessary steps to secure and to maintain for the benefit of Tenant the quiet and peaceful possession of the Premises, for the Lease Term, without hindrance, claim or molestation by Landlord or any other person lawfully claiming under Landlord. The foregoing covenant is in lieu of any other covenant, express or implied.
Landlord's Covenant of Quiet Enjoyment. Landlord covenants and agrees that Tenant shall have the peaceful and quiet possession and enjoyment of the Premises (subject to all mortgages and other matters to which this Lease, is or shall become, subordinate in accordance with the provisions of Section 25) for the conduct of its business operations during the Term of this Lease, without hindrance by Landlord or any party whatsoever.
Landlord's Covenant of Quiet Enjoyment. TITLE The Landlord covenants that the Tenant, upon paying the Basic Rent and Additional Rent provided for hereunder and performing and observing all of the other covenants and provisions hereof, may peaceably and quietly hold and enjoy the Premises for the Term as aforesaid, subject, however, to all of the terms and provisions of this Lease and to the title matters set forth or referred to in Exhibit A attached hereto. 18.
