Late Discovery of Cultural Resources. In the event that previously unidentified historic properties or significant archaeological sites are discovered during project activities, the contractor or project manager shall immediately halt all construction work in the area of the property or site and for a minimum of 100 ft all around the property or site. The contractor shall then immediately notify the coroner, SHPO, and Tribes (as appropriate) by telephone and/or email within two (2) business days. • An appropriate heritage professional meeting the SOI professional qualifications will inspect the property and determine the nature and area of the affected property. Project activities may continue in the area outside the identified historic property once the area to be avoided has been defined by the appropriate heritage professional. • Within ten (10) business days of the original notification of the discovery, KHC or Energy and Environment Cabinet, in consultation with the SHPO and Tribes, shall determine the eligibility of the property and provide the eligibility determination to the SHPO for concurrence. • If the property is determined eligible for the National Register, or contains human burials, the SHPO shall prepare a plan for avoidance, protection, and recovery. The plan shall be submitted to the SHPO and Tribes for review and approval prior to implementation. • Work in the area of the historic property or archaeological site shall not proceed until one or the other are completed 30 days from discovery: o The development and implementation of the appropriate data recovery or other mitigation procedures is complete, or o The determination is made that the property is not eligible for listing on the National Register of Historic Places.

  • Cultural Resources If a cultural resource is discovered, the Purchaser shall immediately suspend all operations in the vicinity of the cultural resource and notify the Forest Officer. Operations may only resume if authorized by the Forest Officer. Cultural resources identified and protected elsewhere in this contract are exempted from this clause. Cultural resources, once discovered or identified, are not to be disturbed by the Purchaser, or his, her or its employees and/or sub- contractors.

  • FINANCIAL RESOURCES The Adviser has the financial resources available to it necessary for the performance of its services and obligations contemplated in the Pricing Disclosure Package, the Prospectus, and under this Agreement, the Investment Management Agreement and the Administration Agreement.

  • Professional Development Reimbursement Management will provide reimbursement for approved professional development expenses for Lieutenants and Sergeants. Funds may be used for the purpose of improving job performance, maintaining and increasing proficiency, preparing Lieutenants and Sergeants for greater responsibility, or increasing promotional opportunities. Management must approve of the specific professional development request in advance. Denial will require written notification to the requesting Lieutenant or Sergeant.

  • Resources Contractor is responsible for providing any and all facilities, materials and resources (including personnel, equipment and software) necessary and appropriate for performance of the Services and to meet Contractor's obligations under this Agreement.

  • Surgery Services This plan covers surgery services to treat a disease or injury when: • the operation is not experimental or investigational, or cosmetic in nature; • the operation is being performed at the appropriate place of service; and • the physician is licensed to perform the surgery. Preauthorization may be required for certain surgical services. Reconstructive Surgery for a Functional Deformity or Impairment This plan covers reconstructive surgery and procedures when the services are performed to relieve pain, or to correct or improve bodily function that is impaired as a result of: • a birth defect; • an accidental injury; • a disease; or • a previous covered surgical procedure. Functional indications for surgical correction do not include psychological, psychiatric or emotional reasons. This plan covers the procedures listed below to treat functional impairments. • abdominal wall surgery including panniculectomy (other than an abdominoplasty); • blepharoplasty and ptosis repair; • gastric bypass or gastric banding; • nasal reconstruction and septorhinoplasty; • orthognathic surgery including mandibular and maxillary osteotomy; • reduction mammoplasty; • removal of breast implants; • removal or treatment of proliferative vascular lesions and hemangiomas; • treatment of varicose veins; or • gynecomastia. Preauthorization may be required for these services.

  • Resourcing 5.1. NHS England may, at its discretion provide support or staff to the CCG. NHS England may, when exercising such discretion, take into account, any relevant factors (including without limitation the size of the CCG, the number of Primary Medical Services Contracts held and the need for the Local NHS England Team to continue to deliver the Reserved Functions).
