Late Payment Penalties. If the Producer fails to pay any musician covered by this agreement within the time periods established by same, the following schedule of late penalty will become due and payable: 1. A penalty of 5% of the above-mentioned amount due and unpaid if the delinquent payment is made within five (5) days (excluding Saturday, Sunday and holidays) after payment was due. 2. A penalty of 7½% of the above-mentioned amount due and unpaid (excluding the penalty in 1., above) if the delinquent payment is made between the 6th and 10th business days (excluding Saturday, Sunday and holidays) after payment was due. 3. A penalty of 10% of the above-mentioned amount due and unpaid (excluding the penalty in 1. and 2., above) if the delinquent payment is made between the 11th and 15th business days (excluding Saturday, Sunday and holidays) after payment was due. 4. A penalty of 15% of the above-mentioned amount due and unpaid (excluding the penalty in 1., 2. and 3., above) if the delinquent payment is made between the 16th and 30th business days (excluding Saturday, Sunday and holidays) after payment was due. 5. Late Payment Penalties. Rent and any other Tenant incurred charges appearing on the Landlord's monthly invoices are due and payable to the Landlord on the first day of each month. There will be a four (4) day grace period through the fifth (5th) day of the month for the payment of such due bills. However any such unpaid bills after said date will be assessed at the late charge rate of 2% per month, computed from the first day of the month in which said xxxx is due, to the date of payment to the Landlord. The Landlord's failure to demand or collect said late charges shall in no way be deemed a waiver of any right thereto or any other rights or remedies that the Landlord may have under the terms of this lease, by summary proceedings or otherwise.
Late Payment Penalties. All payments to Musicians are due within 15 business days of their services. Reuse payments are due within 30 calendar days of the rebroadcast. Foreign area payments or the first-tier foreign distributor’s gross payments are due within 60 days of foreign broadcast. Subsequent tier payments under the foreign distributor’s gross formula are due within 60 days after such tier has been reached. Late Payment Penalties. All Royalties, System Contributions, amounts due for purchases by you from us, and any interest accrued thereon, and any other amounts which you owe us, or our affiliates, are subject to a late payment fee of $250 for payment or report received by us 5 days after its due date. The late payment fee is due immediately on any delinquent payments and for dishonored checks. The provision in this Agreement concerning late payment fees does not mean that we accept or condone late payments, nor does it indicate that we are willing to extend credit to, or otherwise finance, the operation of your Restaurant. In the event that you are delinquent in providing payment or reports during any 2 or more Accounting Periods, we may require you to pay all amounts due us by electronic transfer or cashier’s check.
