Common use of Leased Facilities Clause in Contracts

Leased Facilities. A. If the project is located in a leased facility, the lease must be in effect until the Loan is repaid in full. B. In addition, if Borrower leases a privately-owned facility or building that does not have a separate meter, or Borrower leases a privately-owned facility or building, and the lease payment includes the utility cost, then Borrower confirms that it has already provided to the California Energy Commission, a certificate from the building owner, indicating that building owner has committed to transferring the cost savings of the energy improvements to Borrower, either through a reduced lease payment, or other form of monetary reimbursement.
