Common use of Leave for Court Appearance Clause in Contracts

Leave for Court Appearance. (a) The Employer shall grant paid leave to permanent employees, other than employees on leave without pay, who serve as jurors or who are subpoenaed to give evidence in a court action, provided such court action is not occasioned by the employee's private affairs, and the leave is on a day on which she would normally have worked. (b) In cases where an employee's private affairs have occasioned a court appearance, such leave to attend at court shall be without pay. (c) An employee in receipt of her regular earnings while serving at court shall remit to the Employer all monies paid to her for those services except travelling and meal allowances not reimbursed by the Employer, and shall furnish proof of jury or witness service and pay received. (d) Time spent at court by an employee in his/her official capacity shall be at his/her regular rate of pay. (e) Court actions arising from employment with the Kid's Cottage Day Care requiring attendance at court shall be with pay. (f) In the event an accused employee is jailed pending a court appearance, such leave of absence shall be without pay. If the employee fails to notify the Employer, he/she will be considered to have abandoned his position as per Article 9.7. (g) For all the above leaves, the employee shall advise his/her supervisor as soon as he/she is aware that such leave is required.
