Length of Performance. (1) A performance, including any pre or post artist activity, shall run no longer than 2 hours inclusive of intermission. A production created and/or scheduled to run longer than 2 hours may be presented only by special arrangement with Equity. (2) In the event a 2 hour production unexpectedly exceeds 2 hours, the Producer shall pay to each Actor no less than the prevailing overtime rate for each half-hour or part thereof for each such occurrence. (See Rules 46(H) and (J)(4).)

  • Suspension of Performance Notwithstanding any other provision hereof, if an Event of Default or a Potential Event of Default has occurred and is continuing, the Non-Defaulting Party, upon written notice to the Defaulting Party, has the right (i) to suspend performance under any or all Transactions and (ii) to the extent an Event of Default has occurred and is continuing, to exercise any remedy available at law or in equity, except as limited be Section 5.7.
