Level 4-Board Sample Clauses

Level 4-Board. If the grievant is not satisfied with the decision at Level 3, the grievant may, within 10 days, appeal to the Board of Trustees. The Board will schedule a meeting to hear the grievance. At the Board meeting, the grievant and his/her representative shall have the opportunity to present the grievance to the Board in closed session. Any evidence presented by the grievant shall be limited to what had been presented at the lower levels of this procedure. The Board meeting shall not be an evidentiary hearing but shall provide both the grievant and the administration with an opportunity to fully address the grievance. Within fifteen (15) days after the matter has been submitted, the Board shall render its decision in writing.

At the Board meeting, CSEA and his/her representative shall have the opportunity to present the grievance to the Board in closed session. Within ten (10) days after the matter has been submitted, the Board shall render its decision in writing. Level 5-Mediation. In the event that CSEA is not satisfied with the decision at Level 4, CSEA and the District request the services of a mediator from the California State Mediation and Conciliation Service within fifteen (15) days. CSEA and the District shall attempt to mediate a settlement of the grievance. In no instance will the form or matter of the discussion and/or proposals during the mediating process be revealed. Only the terms of a settlement, if any, may be revealed.
