LIABILITIES AND INSURANCES. 10.1. The Organiser shall have valid public liability insurance for the Event.
10.2. The Sponsor shall have and provide evidence to the Organiser of public liability and employers liability insurance of at least £1 million. This condition does not apply to Non-attending Sponsors
10.3. The Sponsor shall undertake and provide evidence to the Organiser of an appropriate risk assessment and method statement including mitigations for the Sponsor involvement in the Event. This condition does not apply to Non-attending Sponsors
10.4. All Sponsor incidents or accidents at the Event shall be immediately reported by the Sponsor to a member of the Security team, Xxxxxxx or Team Leader with radio contact so that it is recorded and/or mitigated accordingly
10.5. The Sponsor shall be liable for all fees, fines and other costs as a result of an incident or accident caused by the Sponsor at the Event.

CERIC-XXXX and the UzhNU agree to regulate the liabilities and insurances related to the common activities with reference to the Internal Regulations of parties and to the legal framework of the country hosting the joint facilities. Any specific issue related to this aspect will be addressed in the specific agreement.

10.4. All Stallholder incidents or accidents at the Event shall be immediately reported by the Stallholder to a member of the Festival Organising Team so that it is recorded and/or mitigated accordingly.
10.5. The Stallholder shall be liable for all fees, fines and other costs as a result of an incident or accident caused by the Stallholder at the Event.
LIABILITIES AND INSURANCES. 12.1 Liabilities in case of claims by the Owner
12.1.1 Each Party shall be liable to the other Party for claims by the Owner in accordance with this Article Article 12. and subject to Article 4.3.2.
12.1.2 If any claim is raised by the Owner (subject to Article 4.3.2) against the Consortium in connection with the performance of the Contract, for which claim a particular Party is solely responsible, then the responsible Party (“Indemnifying Party”) shall indemnify and hold harmless the other Party (“Indemnified Party”) from all liabilities in this regard.
12.1.3 If the Parties are collectively responsible for any claim(s) made by the Owner, the extent of the individual liability of each Party shall be determined by the degree to which such Party has caused or contributed to the total amount of the claim. In the event the Parties cannot agree on who is responsible for the claim, or the Parties agree that they are collectively responsible but cannot agree how to share the liability, then any such liability shall be provisionally shared between the Parties according to their respective Proportionate Share in the Contract Price, until it is finally determined pursuant to the terms of this Agreement which and to what extent each Party is responsible for the claim.
12.2 Liabilities in case of claims by Third Parties
12.2.1 Each Party (“Indemnifying Party”) shall be liable and agrees to indemnify and hold the other Party (“Indemnified Party”) harmless from and against any claims, demands, liabilities in respect of injury, damage to or loss suffered by any Third Party to the extent that such injury, damage, loss or expense is attributable to negligence or default (or any other act or omission giving rise to a cause of action by a Third Party) on the part of the Indemnifying Party or its employees, agents, subcontractors or suppliers, their respective employees and agents in the course of or arising out of the Project.

The Activity Sponsor shall undertake and provide evidence to the Organiser of an appropriate risk assessment and method statement including mitigations for the Activity Sponsor involvement in the Event. 9.4. All Activity Sponsor incidents or accidents at the Event shall be immediately reported by the Activity Sponsor to the Organiser so that it can be recorded and mitigated accordingly
9.5. The Activity Sponsor, if providing goods and or services, shall be liable for all fees, fines and other costs as a result of an incident or accident caused by the Activity Sponsor at the Event.

The EuroHPC Joint Undertaking shall not be liable for any damage or loss caused by the Hosting Entity, including any damage or loss to third parties during or as a consequence of performance of the Agreement, and the operation of the EuroHPC supercomputer operated on its behalf, unless the loss or damage was caused by wilful misconduct or gross negligence of the EuroHPC Joint Undertaking.

All Participant vehicles parked at the Event are there at the Participant’s own risk.
