Limitation on University Liability. IN NO EVENT SHALL UNIVERSITY BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, LOST PROFITS OR LIKE EXPECTANCY DAMAGES ARISING OUT OF THE AGREEMENT. UNIVERSITY’S TOTAL LIABILITY UNDER THIS AGREEMENT IS THE FEE PAYABLE BY ORGANIZATION AS SET FORTH IN SECTION 3.

Limitation on University Liability. A. The University does not assume any obligation or liability for personal injury or for loss or damage to items of personal property which may occur in its buildings or on its grounds, prior to, during or subsequent to the terms of this Contract, provided that in the event of personal injury or property loss or damage directly resulting from negligent acts or omissions on the part of a University employee or agent, the University shall be responsible for such negligence to the extent provided by applicable law. This disclaimer of liability includes but is not limited to damage or loss whether by fire, water, theft, or otherwise, or for any direct or consequential damages arising from loss of, or any interruption of, any utility service, including Internet service. The student assumes any and all risk of such loss. No interruption of utility services, heating and cooling shall be deemed as an eviction or disturbance of residents’ use of the facilities or render the University liable for damages unless the University willfully refused to supply said services without cause or excuse. You are urged to purchase independent renter’s insurance for protection against loss or property damage.
Limitation on University Liability. UNC Charlotte shall have no responsibility for loss of, or damage to, the guest’s personal property anywhere in the residential facilities, whether by fire, theft, or otherwise, or for direct or consequential damages arising from loss of, or any interruption of, any utility service provided by UNC Charlotte or any other person or organization in connection with residence services. The guest assumes all risk of all such loss. Insurance against such loss is the guest’s responsibility; a homeowner’s or renter’s insurance policy may provide coverage. A supplemental renter’s insurance policy covering campus residence is strongly recommended.

The University’s liability under this contract is subject to the provisions of the Colorado Governmental Immunity Act. It is specifically understood and agreed that nothing contained in this paragraph or elsewhere in this contract shall be construed as an express or implied waiver by the University of its immunity or as an express or implied acceptance by the University of liabilities arising as a result of actions which lie in tort or could lie in tort. The APPLICANT/RESIDENT shall indemnify and hold the University and its agents harmless from any and all claims and judgement for loss, damages, or injury to persons or property caused by or contributed to by the acts or omission of the APPLICANT/RESIDENT or its agents.

It is specifically understood and agreed that nothing contained in this paragraph or elsewhere in this contract shall be construed as an express or implied waiver by the University of its HOUSEKEEPING Daily housekeeping service is provided only for public areas. Residents are responsible for maintaining assigned living areas, including kitchens and bathrooms, in a clean and orderly condition. Failure to keep shared living areas in a clean, uncluttered and safe condition will result in cleaning charges and could result in termination of the contract.
Limitation on University Liability. In no event, shall the University be liable for any indirect, consequential, incidental, lost profits, or like expectancy damages arising out of the Agreement. The University’s maximum obligation under this Agreement shall not exceed the amount set forth in section 4.
