Common use of Line Positions Clause in Contracts

Line Positions. A. In those instances where a candidate in the pool is passed over (a candidate lower on the eligible list is selected to fill a vacancy) for a line position, the passed-over candidate will be afforded an opportunity to meet with the Chief (no designee) within a reasonable amount of time after being notified that he/she has been passed over. During the meeting with the Chief, the candidate will be informed of the reason for the decision to pass him/her over and any perceived deficiencies in the candidate’s acceptability for promotion. The candidate will be allowed to take notes but there will not be any written documentation prepared in regard to this aspect of the meeting. Any concerns or performance problems raised in the feedback meeting and serving as a basis for denying a candidate a promotion must have previously been brought to the candidate’s attention and the candidate must have previously been given a chance to correct them.
