Vacant Positions. The Employer will undertake a good-faith effort to place employees who are subject to layoff in comparable vacant positions. Vacant positions are comparable if they are in the same or similar classification, are at the same or greater base rate of pay, are on the same shift, and are within .2 FTE of the employee’s position at the time of layoff. An employee who is subject to a layoff will be considered eligible for a vacant position if, in the Employer’s opinion, the employee has the necessary skills and ability to perform the work required within an orientation period of four (4) weeks. If the employee has not achieved a satisfactory level of performance in the judgment of the Employer based upon established criteria within the four-week period, the employee will be placed on layoff status. Employees who decline the offer of a comparable vacant position are not eligible to exercise the options set forth in this agreement.
Vacant Positions. If through death, resignation, retirement, termination, or reassignment of the incumbent, a position becomes vacant, the appropriate Vice President, in consultation with appropriate divisional, program, and/or department stakeholders, will decide whether to recommend to the Executive Team elimination of the position, maintaining the position and appointing a new individual to it, maintaining the position but designating it as frozen for financial reasons, holding the position for future consideration, or creation of a different or modified position in its place.
Vacant Positions. Positions in the same job classification requiring comparable skills will not be filled during the period beginning with the notice of layoff to the date of the layoff. Additionally, subject to skill, competence and ability being substantially equal in the opinion of the Employer, the use of agency/registry employees in a vacant position in the affected unit will be discontinued prior to layoff.
Vacant Positions. If a position becomes vacant after the Rank Order List Certification Deadline and the program is participating in a Specialties Matching Service Match that has implemented the All In Policy, the position may be filled outside the Match at any time between 12:00 p.m. eastern time on Match Day and prior to the day registration opens for the next Match in which the program participates. After registration opens for the next Match, the vacant position must be placed in the Match.
Vacant Positions. 31.01 When any vacancy occurs or a new position is created within the bargaining unit, the Employer shall post notice of the vacancy for a minimum of seven (7) calendar days. (a) The successful candidate, if already an employee as defined in this Agreement, shall be placed on a trial basis in the new classification or position for a period of 300 worked hours. Subject to the mutual agreement of the Hospital and the Local, such trial period may be extended for a reasonable period. If the employee proves unsatisfactory during the aforementioned trial period or if the employee satisfies the hospital he is unable to perform the duties of the new position, he shall be returned to his former position or in the case of a casual employee he shall be returned to casual status as per Article 2.03(c), without loss of seniority or former salary, and any other employee promoted or transferred because of the rearrangement of positions shall be returned to his former position without loss of seniority or former salary. Conditional on satisfactory service, appointment to the position shall become permanent after the trial period. (b) If the successful candidate returns to his former position or status in accordance with 31.04 (a), the Hospital shall appoint the next senior qualified applicant who applied for the position. Should such applicant not be successful then the Hospital shall repost the vacancy. (a) Within fourteen (14) calendar days of the close of competition, notice shall be posted for a minimum of seven (7) calendar days of either the name of the successful candidate, or the fact that the position has not been filled. Such notice shall also be sent to the Local. Upon written request by the employee, the Employer shall provide a written explanation as to why the employee was not appointed to the position. (b) Upon being awarded the position, the Hospital will make every reasonable effort to move the employee to the new position...

Vacant Positions. Any employee displaced due to the implementation of a reduction-in-force who meets the minimum qualifications for a vacant position that is equal to or less than their previous position will be able to fill that position if he/she has the most seniority of those applying for the vacancy in question. It is the employee's responsibility to monitor the vacancy list and notify the Personnel Department of his/her desire for the vacancy in question. After a Reduction In Force has occurred, vacancy (in this section) shall be defined as those positions not filled during the initial R.I.F. procedure or following a recall procedure.
Vacant Positions. (a) The employee shall be moved into a vacant position that the university intends to fill in the employee’s same classification. (b) If no positions are accessible under subsection (a), above, the employee shall be moved into a vacant position that the university intends to fill in the same salary range but a different classification. (c) If no positions are accessible under subsection (b), above, the employee shall be moved into a vacant position that the university intends to fill in a lower salary range. In applying this step of the process, the Employer will place the employee in a salary range as close to the employee’s current salary range as possible but no more than a five (5) salary range difference unless mutually agreed upon. Also, if there is more than one such vacant position, the Employer shall reasonably consider employee preferences in placing the employee. Employees who demote under this subsection shall be placed on any geographic area layoff recall list of the employee’s choice within the University for the classification from which the employee demoted.
Vacant Positions. The District will endeavor to fill vacant positions within twenty-five (25) workdays from the time the vacancy is posted. The District will inform the Association of the reasons when this timeline cannot be met.
