List of Eligible Voters. If the AAA representative determines that the Union’s showing of interest is adequate, and that 30% or more of the non-tenure-track faculty in the Agreed Bargaining Unit who are eligible to vote have signed written evidence indicating that they wish to be represented by the Union in group bargaining, the AAA representative will so advise both the University and the Union. Within ten (10) business days of being so advised, the University shall provide the Union with a list, in a searchable electronic format, of all non-tenure-track faculty in the Agreed Bargaining Unit, and to the extent the University maintains such information as part of its records, their home addresses, cellular telephone numbers, personal and work e-mail addresses, formal job titles, school and/or college for which they teach, and work locations. The University shall provide the Union this contact information irrespective of whether the employee’s information was provided in paragraph 5(a) above. As with respect to all information provided under this Agreement, the Union agrees not to use this information for any purpose other than internal Union administration and communication with non-tenure-track faculty in the Agreed Bargaining Unit for purposes of the election procedures. If a majority of the voting non-tenure-track faculty in the Agreed Bargaining Unit vote to select the Union to represent them in group bargaining, the Union may use the information provided for internal Union administration and communication necessary Deleted: neutral third party Deleted: tenured Deleted: Group to conduct such bargaining, or for such other purposes consistent with the Union’s representation of the unit.

Failure by any Member to provide such affidavit by the date of such disposition shall authorize the Manager to withhold ten percent (10%) of each such Member’s distributive share of the amount realized by the Company on the disposition.
