Pendahuluan Semakin tahun semakin besar kebutuhan akan tanah, baik untuk kepentingan pembangunan perumahan atau gedung maupun untuk pelaksanaan usaha, termasuk usaha pertanian, sedangkan tanah 1 Xxxxx Xxxxxx,XX.XX. adalah Xxxxx Xxxxx III Fakultas Hukum Universitas Batanghari Jambi xxx Xxxxx Tetap PS. Ilmu Hukum Fakultas Hukum Universitas Batanghari Jambi. kosong yang tersedia sudah semakin sedikit xxx tidak pula memiliki tanah sendiri. Dikarenakan tanah sendiri tidak ada atau sangat kecil sedangkan kebutuhan untuk usaha sangat besar, maka diperlukan pihak xxxx xxxx memiliki lahan tanah yang luas untuk menggunakan tanahnya. Pihak yang membutuhkan lahan tanah yang luas untuk usahanya tidak hanya orang perorangan melainkan juga suatu badan usaha. Salah satu badan usaha yang memerlukan lahan tanah yang cukup luas untuk usahanya di kabupaten Muaro Jambi adalah PT. Era Sakti Wiraforestama. Perusahaan ini membutuhkan lahan tanah yang luas guna usaha perkebunan kelapa sawit. Dari usaha yang dilakukan, akhirnya PT. Era Sakti Wiraforestama mendapatkan lahan tanah yang diinginkannya dengan menggunakan tanah xxxxx masyarakat kecamatan Xxxx Xxxx. Penggunaan tanah masyarakat adat Xxxx Xxxx untuk keperluan usaha perkebunan PT. Era Sakti Wiraforestama bukanlah terjadi dengan sendirinya xxx penguasaan semena-mena, melainkan diawali dengan suatu perjanjian kepada xxxxx masyarakat pemilik tanah tersebut. Perjanjian yang diadakan antara PT. Era Sakti Wiraforestama dengan masyarakat adat Xxxx Xxxx adalah perjanjian penggunaan tanah untuk keperluan usaha, yang dituangkan dalam surat perjanjian. Dalam perjanjian yang diadakan, ditentukan xxx xxx kewajiban masing-masing pihak, umumnya hak dari pihak PT. Era Sakti Wiraforestama dapat menggunakan tanah milik masyrakat adat untuk kegiatan usaha perkebunannya hingga jangka waktu yang ditentukan dengan kewajiban membayar sejumlah harga dari hasil perkebunan yang dilakukan xxx mengembalikan pengelolaan tanah tersebut kepada xxxxx masyarakat adat pada saat berakhirnya jangka waktu perjanjian. Sedangkan hak masyarakat adat selaku pemilik tanah selain mendapatkan bagian hasil perkebunan juga mendapatkan tanahnya kembali setelah berakhirnya perjanjian. Dikarenakan penggunaan tanah untuk usaha perkebunan memakan waktu yang cukup lama, maka banyak terjadi perubahan- perubahan dalam pelaksanaan perjanjian yang kadangkala tidak diketahui oleh pihak xxxxx masyarakat, sehingga merugikan xxxxx masyarakat itu sendiri. Dengan terjadinya perubahan-perubahan dalam pelaksanaan perjanjian tanpa diketahui oleh pihak xxxxx masyarakat adat Xxxx Xxxx, timbulah berbagai permasalahan berupa :

Irrigation The City shall provide water to the Premises for the purpose of irrigating the facility. The City specifically reserves the right to restrict water usage under this Agreement if water restrictions are placed on other water users within the City. Prior to the start of the season, City will provide charge up and run through the automatic irrigation systems to check for proper operation. City will provide Lessee with a radio for remote operation of the irrigation system, which Lessee shall use for the day to day maintenance, repair, and monitoring of the irrigation system. If the radio is lost, stolen, broken, or is rendered unusable, Lessee shall pay $1500 for the replacement radio. City is responsible for the maintenance and repair of the following irrigation elements, to the extent applicable: curb stops, backflow prevention devices, backflow enclosures, main line pipings, electric control valves, and controllers. Lessee shall notify Parks Division Water managers by email if any of these irrigation elements are malfunctioning or broken.
Brakes Master cylinder, wheel cylinders, hydraulic lines and fittings, power booster and brake callipers. Excludes linings, pads, drums and discs.
PAVING Provide a standard bubble map, as part of the plans, showing locations of numbered points, and a table with point number, northing and easting coordinates, description, and BL station for each point, for the following: ▪ all platted control irons (set or not), including plat boundary irons, for the entire sub-division, not just the current phase ▪ benchmarks, including TBM set with preliminary survey In addition to the required coordinate information, the following shall be included in all plans, at a minimum, as needed for construction staking on all City projects. ▪ Include copy of plat(s) on all plans, as relevant and approved by the Design Engineer ▪ Benchmarks – minimum of two City standards, four total desirable; as close to project as possible, even if TBM set with preliminary survey. ▪ Benchmark elevations must be in the same datum as the design (i.e. NAV 88 design needs NAV 88 benchmarks, not NAV 29) ▪ All control irons/identified property irons shall be shown on plans, with BL stationing and offset ▪ Show deflection angles in BL, and/or bearing/azimuth of BL sections ▪ Arterial project side streets – provide BL station at CL of intersection of the two streets, on the BL; BL station and offset to CL of side street at removal limits; include deflection angle from BL to CL of side street ▪ Existing FL/pavement grades shown at all match points ▪ Top of curb grades and stationing at all ends-of-return and horizontal/vertical P.I.’s, not just even stationing ▪ CL top of pavement grades for arterial ▪ CL elevation for streets on mass grading work @ 100’ Sta in tangent sections and 50’ on curves.

Platby In consideration for the services rendered by the Institute, in the Study, the Sponsor agrees to pay to the Institute according to the Budget, attached as Exhibit B hereto (the “Fee”). The Fee shall be payable for each eligible Subject properly enrolled according to the Protocol upon proper completion and delivery to the Sponsor of the Case Report Forms (the “CRF”) for each Subject. The Fees, plus VAT calculated in the legal amount, shall be the full remuneration and payment by Sponsor for all costs incurred in the course of the clinical Study. Any and all taxes or other registration charges shall be borne by the Institute. The Sponsor will not pay Fees, reimburse any expense, charge, cost, nor bear any liability to the Institute, nor to any other person or entity, in respect of any Subject in excess of the maximum number of Subjects specified in the previous sentence. Toilets Papers, dust, cobwebs, peels, cans/bottles, cigarette butts, excrement on floor, bad smells, water pools, leaking sewage, rodents, animals (dead or alive), overflowing sanitary bins. 0 = NOT APPLICABLE 1 = UNACCEPTABLE (Toilets out of order. Toilets not cleaned on daily basis.) 2 = POOR (Toilets cleaned, but still visible signs of dirt, e.g. dust, cobwebs.) 3 = GOOD (Obvious sign that toilets are cleaned daily.) 4 = EXCELLENT (Extra effort is put in to ensure cleanliness, e.g. using detergents.)
