Common use of Loss of Acceptable Position Requirements Clause in Contracts

Loss of Acceptable Position Requirements. An employee may be reassigned within the Police Department due to the loss of acceptable position requirements, such as, for example, a driver's license. Any such reassignment shall be made subject to an available job opening, and if there is no available job opening the employee shall be granted an unpaid leave of absence pending resolution of the loss. With respect to the application of this Section it is understood that: • The assignment shall be made only if the employee is qualified to perform the available job; • This Section shall not apply to an employee who has lost an acceptable position requirement as a result of having been disciplined; • An employee reassigned under this Section shall be paid at the rate of the position to which he/she is reassigned; • Any reassignment under this Section shall not exceed a period of three (3) months; and, • Any unpaid leave of absence under this Section shall not exceed a period of six (6) months.
