Common use of Loss of Seniority Clause in Contracts

Loss of Seniority. An Employee shall lose seniority and shall no longer be an Employee only in the event the Employee: a) is discharged for just cause; b) resigns; c) is absent from work in excess of two (2) working days (of the Employee) without sufficient cause or without notifying the Employer, unless such notice was not reasonably possible; d) no longer has recall rights; e) is permanently moved to a position outside the bargaining unit after six (6) months from the date of the move; f) retires.

Loss of Seniority. An Employee Employees shall lose seniority and shall no longer be an Employee only in the event the Employee: a) is when they: • Voluntarily quit; • Are discharged for just cause; b) resigns; c) is absent good reason; • Absent themselves from work in excess without notice for three (3) consecutive working day; • Fail to return from approved leaves of two (2) working days (absence unless specifically provided for by this Agreement; • Accept other employment during leaves of the Employee) without sufficient cause or without notifying the Employer, absence unless such notice was not reasonably possible; d) no longer has recall rights; e) is permanently moved to a position outside the bargaining unit after six (6) months from the date of the move; f) retiresspecifically provided for by this Agreement.

Loss of Seniority. An Employee employee shall lose seniority and shall no longer be an Employee only in the event the Employeethat: (a) the employee is discharged for just causecause and not reinstated; (b) the employee resigns; (c) the employee is absent struck from work the recall list in excess of two (2) working days (of the Employee) without sufficient cause or without notifying the Employer, unless such notice was not reasonably possibleaccordance with Article 37.18(d); (d) no longer has recall rights; ethe employee is laid off for more than twenty-four (24) is permanently moved to a position outside the bargaining unit after six (6) consecutive months from the date of the move; f) retireswithout recall.

Loss of Seniority. An Employee employee shall be terminated and lose her/his seniority and shall no longer be an Employee only in the event the Employeerights if she/he: a) is discharged for just cause1. Quits; b) resigns2. Is discharged and not reinstated; c) is absent from work in excess 3. Is laid off for a period of two (2) working days (of the Employee) without sufficient cause or without notifying the Employer, unless such notice was not reasonably possibleyears; d) no longer has recall rights4. Retires; e5. Is absent from work for three (3) or more days without giving appropriate notice by calling in unless there are extenuating circumstances justifying the lack of notice. Any such employee who is permanently moved to a position outside the bargaining unit after six (6) months from the date later rehired shall forfeit all previous seniority and length of the move; f) retiresservice credit for longevity.

Loss of Seniority. An Employee shall lose seniority and shall no longer be an Employee only deemed to have terminated their Bargaining Unit position in the event the Employeethat: (a) the Employee is discharged for just causecause and not reinstated; (b) the Employee resigns; (c) the Employee is absent laid off for more than twenty-four (24) consecutive months without recall; or (d) the Employee has been employed in a position excluded from work any bargaining unit for a period in excess of two eighteen (218) working days (of the Employee) without sufficient cause or without notifying the Employer, unless such notice was not reasonably possible; d) no longer has recall rights; e) is permanently moved to a position outside the bargaining unit after six (6) months from the date of the move; f) retiresmonths.

Loss of Seniority. An Employee shall lose seniority and shall no longer be an Employee only deemed to have terminated their Bargaining Unit position in the event the Employeethat: (a) the Employee is discharged for just causecause and not reinstated; (b) the Employee resigns; (c) the Employee is absent laid off for more than twelve (12) consecutive months without recall; or (d) the Employee has been employed in a position excluded from work any bargaining unit for a period in excess of two eighteen (218) working days (of the Employee) without sufficient cause or without notifying the Employer, unless such notice was not reasonably possible; d) no longer has recall rights; e) is permanently moved to a position outside the bargaining unit after six (6) months from the date of the move; f) retiresmonths.

Loss of Seniority. An Employee employee shall lose seniority and shall no longer be an Employee only in the event the Employeeemployee: a(i) is discharged for just causeproper cause and is not reinstated; b(ii) resigns; c(iii) is absent from work in excess of two five (25) working days (of the Employee) without sufficient cause or without notifying the Employer, Employer unless such notice was not reasonably possible; d(iv) no longer has recall rightsis laid off and does not accept offered work for a minimum of ten (10) shifts per year; e(v) is permanently moved to Is not on approved leave and does not accept offered work for a position outside the bargaining unit after six minimum of twenty (620) months from the date of the move; f) retiresshifts per year.

Loss of Seniority. An Employee Seniority shall lose seniority be lost and shall no longer be an Employee only in the event employment relationship terminated if any of the Employeefollowing occurs: (a) The employee resigns or quits; (b) The employee retires; (c) The employee is discharged for just causeor permanently removed from the payroll, and the separation is not reversed; b(d) resignsThe employee does not return to work at the expiration of a leave of absence; c(e) The employee is absent from work in excess of two for three (23) working days consecutive scheduled workdays without authorization; or (of the Employee) without sufficient cause or without notifying the Employer, unless such notice was not reasonably possible; d) no longer has recall rights; e) is permanently moved to a position outside the bargaining unit after six (6) months from the date of the move; f) retiresThe employee does not return to work when recalled from layoff.

Loss of Seniority. An Employee Seniority shall lose seniority and shall no longer be lost when an Employee only in the event the Employee: a) employee resigns; is discharged for just cause; b) resigns; c) , and is not reinstated through the grievance procedure; is absent from work in excess of two ten (210) consecutive working days (of the Employee) without sufficient cause or without notifying the Employer, unless such notice was not reasonably possible; d; fails to notify the Employer of her/his intention to return to work within ten (10) no longer has working days following receipt of recall rights; e) notice; or when an employee’s employment is permanently moved to a position outside the bargaining unit terminated after six total or partial layoff in accordance with Article 12.02 (6) months from the date of the move; f) retiresTermination).

An Employee Seniority shall lose seniority and shall no longer be lost if an Employee only in the event the Employeeemployee: (a) voluntarily leaves the employ of the Employer, or (b) is discharged for just cause;, or b(c) resigns;after a layoff fails, without good cause, to report for work within five (5) working days after being recalled by registered letter, or c(d) is absent from work in excess of two without leave for five (25) working days without a satisfactory reason, or (of the Employee) without sufficient cause or without notifying the Employer, unless such notice was not reasonably possible; d) no longer has recall rights; e) is permanently moved to a position outside the bargaining unit after six (6) months from the date of the move; f) retireson continuous layoff for more than one year.

Loss of Seniority. (a) An Employee employee shall lose seniority and shall no longer be an Employee only in the event the Employeeevent: a(i) the employee is discharged terminated for just causecause and is not reinstated; b(ii) the employee resigns, retires, or xxxxxx the employment relationship; c(iii) is absent the employee has been laid off from work in excess of two employment for longer than twelve (212) working days consecutive months, or fails to accept recall under Subsection 15:09 (of the Employee) without sufficient cause b), or without notifying the Employer, unless such notice was not reasonably possible; d) no longer has recall rights; e) is permanently moved fails to a position outside the bargaining unit after six (6) months from report on the date of the move; f) retiresand time required when recalled.

Loss of Seniority. An Employee employee shall lose his/her seniority and shall no longer be an Employee only in the event the Employeeif he/she: (a) is discharged for just cause; b) quits or resigns; (b) is discharged, terminated, or retires; (c) fails to report to work upon recall from xxxxxx immediately, if available, but in any event within ten (10) working days after receipt of notice of recall provided that notice of his/her return was made within 72 hours of being recalled; or (d) is absent from work in excess of for any reason, including xxxxxx, for a continuous period equal to his seniority, not to exceed two (2) working days (of the Employee) without sufficient cause or without notifying the Employer, unless such notice was not reasonably possible; d) no longer has recall rights; e) is permanently moved to a position outside the bargaining unit after six (6) months from the date of the move; f) retiresyears.

(c) The employee is discharged and shall no longer be an Employee only the discharge is not reversed through the procedure set forth in this Collective Bargaining Agreement. (d) If the employee does not return to work when recalled from layoff as set forth in the event the Employee:recall procedure. a) is discharged for just cause; b) resigns; c) is absent from work in excess of two (2) working days (of the Employee) without sufficient cause or without notifying the Employer, unless such notice was not reasonably possible; d) no longer has recall rights; e) is permanently moved to a position outside the bargaining unit after six (6) months from the date of the move; f) The employee retires.

Loss of Seniority. An Employee employee shall lose seniority and shall no longer be an Employee only in the event the Employeeof: (a) is discharged discharge for just cause; (b) resignsvoluntary termination of employment; (c) xxxxxx and their recall period as outlined in Clause 3.5(a) has expired; (d) the employee is absent from work in excess of unavailable or declines two (2) working days (offers of reemployment in which the Employee) without sufficient cause or without notifying duration and nature of work is similar to that which the Employer, unless such notice was not reasonably possible; d) no longer has recall rights; e) is permanently moved employee carried out prior to a position outside the bargaining unit after six (6) months from the date of the move; f) retireslayoff.

Loss of Seniority. An Employee shall lose seniority and shall no longer be an Employee only in the event the Employeethat: (a) the Employee is discharged for just causecause and not reinstated; (b) resignsthe Employee resigns or retires; (c) the Employee is absent from laid off for more than eighteen (18) months without recall. (d) the Employee does not report for work in excess of two for three (23) working days (of the Employee) consecutive shifts without sufficient cause or without notifying the Employernotice, unless such notice was not reasonably possible; d) no longer has recall rights; e) is permanently moved to a position outside the bargaining unit after six (6) months from the date of the move; f) retires.
